ACLU: DNC Protesters Arrested, Shackled, Denied Attorneys, Forced To Plead Guilty
Denver police used pre-printed forms to issue charges, misled arrestees

The ACLU has accused the Denver Police Department of violating the constitutional rights of protesters arrested in the vicinity of the Democratic National Convention by denying them access to lawyers, forcing them to plead guilty to inappropriate charges and placing some of them in leg shackles.
The charges are detailed in a letter (Click here for PDF) which at time of writing is yet to appear on the website of ACLU Colorado but has been obtained by alternative news website Raw Story.
The letter summarizes how basic facts of law and criminal justice were either ignored or turned on their head by the police in the absence of legal counsel for arrestees, itself a violation of the Constitution.
The ACLU alleges that police effectively forced some protesters into pleading guilty, by tricking them into believing they had to do so in order to post bond and gain access to a phone call.
In addition it is thought that some arrestees were led to believe that only they could post bond, rather than having a third party do it on their behalf.
“This meant that no one was allowed to make a phone call unless they plead guilty, thus making it impossible for arrestees to even call a lawyer until admitting guilt.” Raw Story writer John Byrne comments.
Furthermore, the letter charges that some of those in custody were told that pleading not guilty would result in a “double sentence” if convicted.

If the people who were arrested are so stupid that they believe things like “you’ll get a double sentence if you don’t plead guilty” then they deserve whatever they get. They should have had a plan already in place, ready to go if they were arrested. All they had to do was get together and kick in fifty bucks each and they could have had a lawyer standing by. I hate to say things like “they deserve what they got”, but for Heaven’s sake, couldn’t they think just five minutes ahead?

As an exprobation officer I can tell you if you had stood up for you rights in this sitution you would be taken back to a room and beaten or they would have just backed off and let you go if they were honest for fear of law suit. forcing defendants to plead guilty with the threat of a maximum sentence usually a maximum term of confinement should one choose to go to trial is a widespread practice. police when they discuss sentencing like judges mention the maximum sentence in conditional terms. judges and police are typically too smart to make an explicit threat. people misinterpret what is told to them due to the inherent stress of arrest and confinement. the truth about the tacit or implicit threat to the right to jury trial and presumption of innocence is really more grave than this. many conservative, lazy, and corrupt judges make the threat known to criminal law professionals by their actions rather than words or threats because they know what they are doing is unconstitutional. no one speaks out because the judges are in a position to retaliate. usually, counsel advise silence and the not guilty plea. when counsel find out the judge assignment if its the unconstitutional retalitory judge they may advise an innocent client to take a plea deal that doesn’t include confinement depending on the weight of the evidence and whether one is entitled to a jury.

The Denver police have been doing a great job overall. There may be a couple who have gone too far, but look at what some of the anarchists have been doing. I’ve been a subject of police abuse before and I know how scary it is. I cooperated within reason and was still demanded an attorney no matter how many times they denied my rights. I ended up being let go because I didn’t do anything wrong. These folks should have shut up, demanded a phone call, and spoke to an attorney instead of the cops.

this is why it’s important for protesters to organize and train beforehand. they have to know how to repsond to every provocation and lie the police will throw at them. they have to know how to circumvent police attempts to restrict their movement via cellphone/walkie-talkie message systems, so that they can appear to scatter, only to regather at another planned location. they have to know how to hand out flyers with brief explanations of ALL these procedures and FAQS at gatherings, so that the majority, who inevitably will NOT have had such training, will know what to do. if you’re going to fight back, make sure you do it in the best possible way.

This is a common tactic now, they will say and lie and do anything to get you to say you are guilty, even if you are not. They will tell you , that you cannot have an attorney. Somehow it is legal for them to lie to you.It should be unconstitutional. They are only in it mostly for money alone. The police state is mainly for revenue, to steal from you. With the exception of a few, a police officer you can trust is like an animal that is going extinct.A dying breed. They are now robots.They are brainwashed.Its sad but true. I’ve protested now for years and have told all the groups that I’ve been involved with to have educational sessions with protesters before an event explaining to them they’re rights and also artful police tactics that are used to circumvent those rights. I’m very sadden to see what’s happened in Denver. For the most part it seems as if these robot thugs have been trained and also, delight in they’re set up roll as “so called” keepers of the peace. In addition, after seeing that ABC affiliate reporter getting bullied and arrested and seeing not one report of what happened to one of they’re own on ABC….I think we all would be pretty safe in assuming that the MSM is truly Cooperate/Government controlled. None of this brutality against peaceful protesters has been shown on any MSM outlet. All we can do is keep moving forward and fighting the good fight.

Winston: It’s not hypocritical to REPORT on something the ACLU says or does, but to have the opinion that overall they aren’t good. Have you heard of journalism? It’s where someone writes about what has happened for the benefit of those not present. In this case, reporting on the accusations ACLU has made. I don’t see anywhere in the article where Steve Watson expresses an opinion agreeing with or disputing the claims.
But even if Alex Jones or Steve Watson expressed agreement with a statement by the ACLU on what happened at the DNC, it is not hypocritical to agree on facts of what happened or that this kind of behavior is reprehensible. So what are you talking about?

The ACLU has always been there to defend civil liberties whether we agree with what the person is saying or not. We may not always agree with the opinions of the people they defend but we must always defend their right to express them peacefully.
The ACLU is our last legal line of defense against the fascist regime.

As for grounds for arrest: “The carrying of arms in a quiet, peaceable, and orderly manner, concealed on or about the person, is not a breach of the peace.
