The BART police officer who fatally shot an unarmed man on an Oakland train platform and then refused to explain his actions to investigators was arrested Tuesday in Nevada on suspicion of murder, authorities said.
Johannes Mehserle, 27, of Lafayette was taken into custody in Douglas County, Nev., said Deputy Steve Velez of the Douglas County sheriff’s office. The arrest was also confirmed by David Chai, chief of staff to Oakland Mayor Ron Dellums.

Mehserle was arrested in the New Year’s Day shooting of Oscar Grant, a 22-year-old supermarket worker from Hayward who was lying facedown after being pulled off a BART train by police investigating a fight. An Alameda County judge signed an arrest warrant alleging murder, and Mehserle surrendered without incident, authorities said.
The shooting, which was recorded by passengers in videos widely circulated on the Internet and television, prompted public outrage, and some viewers said that the shooting appeared to be an execution.

What do you think the chances are that this guy walks, scott free. When the perverbial dookey hits the fan, they will open the door and let this guy back in uniform to kill more cattle.

In the early morning of February 4 Diallo was standing near his building after returning from a meal. Police officers Edward McMellon, Sean Carroll, Kenneth Boss and Richard Murphy passed by in a Ford Taurus when they thought Diallo matched the description of a (since-captured) serial rapist and approached him. The officers were in plain clothes. The officers claimed that they loudly identified themselves as NYPD officers and that Diallo ran up the outside steps toward his apartment house doorway at their approach, ignoring their orders to stop and “show his hands.” As the suspect reached into his jacket, Carroll believed Diallo was drawing a firearm and yelled “Gun!” to alert his colleagues. The officers opened fire on Diallo and during the burst McMellon fell down the steps, appearing to be shot. The four officers fired forty-one shots, hitting Diallo nineteen times. Investigation found no weapons on Diallo’s body; the item he had pulled out of his jacket was not a gun, but a wallet.
On March 25 a Bronx grand jury indicted the officers on charges of second-degree murder and reckless endangerment. On December 16 a New York appellate court ordered a change of venue to Albany, New York, stating that pretrial publicity had made a fair trial in New York City impossible. On February 25, 2000, after two days of deliberations, a jury unanimously voted to acquit the officers of all charges.

I have to say if he does walk I highly doubt he will be put back on the job, but to site the Diallo case is kind of absurd compared to this. When was the last time you put your life on the line and pursued someone suspected of being a violent serial rapist? You people watch too many robocop movies to think that out of the thousands of confrontations that occur every year between police and possibly violent suspects, that mistakes arent going to happen. Every time a cop chases someone there is a certain level of fear thats involved and fear clouds any mans judgment. Unfortunate?… yes. Criminal?… no. As for this particular incident I think this officer is going to have a very hard time explaining his actions. And I dont think an AD (accidental discharge) is going to cut it. Most departments require atleast a 12lb trigger pull on their duty pistols to avoid AD’s.

Honestly, the chances he will walk are really good…
They are just pressing charges, to allow things to cool off, and the rioters to go back to their homes, wives, families, and children. Our of sight, out of mind… they will let him cool off in a holding cell, protected from other prisoners, and then…they will find that it was in self defense, or perhaps the harshest punishment being involuntary manslaughter… aka Ooops! Then they will push the trial quietly out of the lime light… and give him back his badge.
Bad cop, NO DONUT!
That’s about as harsh of a punishment as they will give him.

Hopefully they will add the charge of interstate flight to avoid prosecution. This cop knows he
committed murder, thats why he ran. We should all hope that he gets to bunk up with Bubba.
Give him a fair trial and then HANG THE SOB. We have to stop this police state SS BS now.

Well another warrant is needed, and quick! 1600 Pennsylvania Ave, Washignton DC! Get him before he skips out after the innaugaration in a few days!
But on a serious note, I agree with the previous poster, not likely this guy will do any time. Maybe if we’re lucky, some prisoners will have a little fun with him before he leaves. Hopefully, he won’t get out on bail before his trial. Sounds all too good to be true.

If he walks they will spin it to be like some unfortunate family not getting justice, but no big deal, like some distant event that doesn’t affect you and doesn’t matter.

He wont do any time. He’ll say he thought he was pulling his stun gun and they’ll give him a fine, probation and he’ll lose his “official” badge. What he did to this kid (who it sounds like was turning his life around somewhat, not that they even knew his name).. is exactly what they are going to do to us in a few months. Shoot 1st and pretend to resign later. I’m sure this cop will end up working for “border” CONTROL later this year.. he’s great at HIS JOB!! He is a “well trained ass-as-sin for the elitist pigs!

(1) There will be a phony trial, for all the “Sheeple” to see.
(2) After he is convicted, he will be seen walking away in shakles.
(3) The “Sheeple” will be satisfied that justice has been served.
(4) In time, when this fades from the “Sheeples” memory,in the
undisclosed location they have him in, somewhere in the wee
hour in the morning, they will lead him out, change his identity,
and relocate him in a remote place to live, PERIOD!

Hey, why so angry? He was goin’ after the bad guys, just like on that show cops: they’re just happy to be one of the Good guys that gets to round up the bad guys. Trust them, they know what they’re doing.
To make the place safer.
Of course if this world happens to be a little muddled up, say, a little off it’s axis and something a little dark parading as something a little light has wound up running the show that would make things a little more complex. Everything would be a lot more complex.

I don’t think they recruit ANY cops these days that have so much as an average IQ, they are looking for the ones whose IQ is at the approximate level of room temperature.
I work with two people who have, at a minimum an average IQ and they were dismissed from the training for less than valid justification and to me it seems that this is the trend taking place in America because they cannot have the ones that have the ability to rationalize in ANY situation and I equate this to the “Stress Cards” being issued in the Army during training which produces pathetic, non-trained soldiers that will be crushed in a firefight.

If there had not been violent protests, this arrest would not have occurred. It is fortunate that so many people were taping this incident. Withouth the tapes, there would not have been such outrage. I hate to say it, but we need more of this until there is a cleansing of this filth. These pigs need to be charged as traitors, too – they take an oath to uphold the Law.

Interesting how the desire of many of those in government, is to disarm everyone. Yet those prone to extreme violence, within the justification of law enforcement, are provided firearms. They take out their perverted responses on those unable to defend themselves. The psychological screening, ( if any was done at all in this instance ), failed to weed out a sociopath of the worst order. The day when mankind no longer feels the need for violence, is the day that we may be safe in giving up all reasonable means for self defense. I doubt that I will live that long. I regret that so much time and money will be spent now on the actions of the attacker, and so little on the survivors.

You would think the fact that police don’t typically survive prison would be enough motivation for them to not break the law they’ve sworn to up hold. I don’t feel the least bit sorry for this officer and i hope that he will relies that the hell he is about to pass through was completely manifested from his own dis-concern for his oath to serve and protect. Police should be here to help and protect us, not intimidate and suppress us.

IF he gets convicted (big IF) and IF he is not kept seperate from the general prison population, he will probably be killed in prison, much like Jeffrey Dahlmer was. Someone with nothing to lose will kill him. I’m glad he has been arrested and charged. His only defense is going to be “taser confusion”, which of course begs the question: “Why were you planning to taser a guy who was down, cuffed and on his belly? He was CLEARLY not a threat to you (cop) or anyone else.” I hope in goes to trial and I hope the jury is all homeboys and disinfranchised folks. My guess is that the “authorities” (BART police force, mayor’s office, city council) will now abandon him, claim he was a rascist, bad seed, etc. and let him hang out to dry.

If you think about it, the ” I confused my gun with my tazer” defence would demonstrate that tazers should be outlawed. If the cops didn’t have tazers, then there couldn’t be any confusion between their gun and their tazer.
How do “We the people” petition our government for redress of grievances regarding the use of tazers? Does anyone know how to get this started? Tazers should be made illegal, period.
