  • Bush quietly seeks to make war powers permanent, by declaring indefinite state of war

    John Byrne
    Raw Story
    Sunday, Aug 31, 2008

As the nation focuses on Sen. John McCain’s choice of running mate, President Bush has quietly moved to expand the reach of presidential power by ensuring that America remains in a state of permanent war.

Buried in a recent proposal by the Administration is a sentence that has received scant attention — and was buried itself in the very newspaper that exposed it Saturday. It is an affirmation that the United States remains at war with al Qaeda, the Taliban and “associated organizations.”

Part of a proposal for Guantanamo Bay legal detainees, the provision before Congress seeks to “acknowledge again and explicitly that this nation remains engaged in an armed conflict with Al Qaeda, the Taliban, and associated organizations, who have already proclaimed themselves at war with us and who are dedicated to the slaughter of Americans.”

The New York Times’ page 8 placement of the article in its Saturday edition seems to downplay its importance. Such a re-affirmation of war carries broad legal implications that could imperil Americans’ civil liberties and the rights of foreign nationals for decades to come.

    (Article continues below)

It was under the guise of war that President Bush claimed a legal mandate for his warrantless wiretapping program, giving the National Security Agency power to intercept calls Americans made abroad. More of this program has emerged in recent years, and it includes the surveillance of Americans’ information and exchanges online.

“War powers” have also given President Bush cover to hold Americans without habeas corpus — detainment without explanation or charge. Jose Padilla, a Chicago resident arrested in 2002, was held without trial for five years before being convicted of conspiring to kill individuals abroad and provide support for terrorism.

But his arrest was made with proclamations that Padilla had plans to build a “dirty bomb.” He was never convicted of this charge. Padilla’s legal team also claimed that during his time in military custody — the four years he was held without charge — he was tortured with sensory deprivation, sleep deprivation, forced stress positions and injected with drugs.

Times reporter Eric Lichtblau notes that the measure is the latest step that the Administration has taken to “make permanent” key aspects of its “long war” against terrorism. Congress recently passed a much-maligned bill giving telecommunications companies retroactive immunity for their participation in what constitutional experts see as an illegal or borderline-illegal surveillance program, and is considering efforts to give the FBI more power in their investigative techniques.

“It is uncertain whether Congress will take the administration up on its request,” Lichtblau writes. “Some Republicans have already embraced the idea, with Representative Lamar Smith of Texas, the ranking Republican on the Judiciary Committee, introducing a measure almost identical to the administration’s proposal. ‘Since 9/11,’ Mr. Smith said, ‘we have been at war with an unconventional enemy whose primary goal is to kill innocent Americans.’”

If enough Republicans come aboard, Democrats may struggle to defeat the provision. Despite holding majorities in the House and Senate, they have failed to beat back some of President Bush’s purported “security” measures, such as the telecom immunity bill.

Bush’s open-ended permanent war language worries his critics. They say it could provide indefinite, if hazy, legal justification for any number of activities — including detention of terrorists suspects at bases like Guantanamo Bay (where for years the Administration would not even release the names of those being held), and the NSA’s warantless wiretapping program.

Lichtblau co-wrote the Times article revealing the Administration’s eavesdropping program along with fellow reporter James Risen.

He notes that Bush’s language “recalls a resolution, known as the Authorization for Use of Military Force, passed by Congress on Sept. 14, 2001… [which] authorized the president to ‘use all necessary and appropriate force’ against those responsible for the Sept. 11 attacks to prevent future strikes. That authorization, still in effect, was initially viewed by many members of Congress who voted for it as the go-ahead for the administration to invade Afghanistan and overthrow the Taliban, which had given sanctuary to Mr. bin Laden.”

“But the military authorization became the secret legal basis for some of the administration’s most controversial legal tactics, including the wiretapping program, and that still gnaws at some members of Congress,” he adds.

Great story with important information. The only problem is…who cares? Americans will sleep while their country transforms into a fascist dictatorship. By the time they wake up it will be in a FEMA camps with RFID chips stuck in their ass.

if you’ve seen the videos of what happened in denver … its gonna take more of that kind of action to get people to wake up. of course its too late by then. but we still must stand up and expose this ridiculous abuse of power. its nothing short of a new Nazi like oppression. In this day … the lines are being drawn … be a revolutionary … or be a slave .. you decide.

i thought war was good for the economy ?

if so, why is the USA econmoy the worse it has been since the depression. you would have thought that after 8 years of war with iraq, afghan, and other hotspots, that the USA would have a great economy.

i see mass anarchy within 5 years for USA, no jobs, oil supply cutoff, empty cities due to financial crisis, health care only for the rich, drought, famine, hurricanes, flooding, the who prophecies of the bible unleashed in the worlds “in money we trust” country.

What are you waiting for, big internet tough guy. WHAT ARE ANY OF YOU KEYBOARD COMMANDOS WAITING FOR!?!?!?!? They killed 3,000 of your own citizens and are now trying to kill and/or enslave you! Far from your big, anonymous boasting on a message board, you continue to work for them (corporate America) and continue to give your money to them (U.S. Government, via taxes). So I have to assume that the brave words you write here are but that, words only, written by people who are actually cowards and sheep who serve corporate America and the U.S. Government because, when they log off their computer and go into the real world, they are too cowardly to do anything.

    16. Zammy Says:

Just like in George Orwell’s 1984, all attempts to kill or capture “Emmanuel Goldstein” must fail, he must forever remain at large, the war must go on forever, to preserve a “state of emergency” in which all “normal” logic is suspended.

[with a severe dash sarcasm]I love how some people here have equated evangelicals, and speaking in tongues, with nutbars in government … while I do agree that many of these people in gov’t profess to be these types of said evangelicals, that does not mean they uphold the way of Christ. Just because someone says they are an evangelical, speak in tongues, does _not_ mean they supports all these nutbars, believe the same things they do, or are ‘holy rollers’. Stop slamming everyone into the same box, you’re spouting the same type of rhetoric as they are, just from the other side of the fence. Take the high road. And to the one chap that mentioned greed, you can add gluttony to that as well.

all of Bush’s credibility went down the toilet when he let Bin Laden and Co. slip away in Tora Bora. Then he went after Iraq, completely ignoring Al Qaeda. Im sorry if i had been president, i would have gotten the job done, and brought those who attacked us to justice. NOT invade another sovereign nation, and let the people we were supposed to be hunting slip away.

something this incredible stinks badly too.

      To JamesM

The below comment you made is badly flawed.
It’s main flaw is the assumption people “SEND” their kids to war.
Would I be right in assuming the U.S is the same as the U.K and that only “ADULTS” can sign up for warmongering????
If yes then where does “SEND YOUR KIDS TO FIGHT” come into play???
If your parents turned up at your house, assuming that like most 18 year olds they have actually begun to live their own lives and dont sleep in the barbiedoll room upstairs in mommys house, if the parents turned up and said to their 18 year old daughter or son “GO SIGN UP” what would the response be??? Maybe something like “FUCK OFF”.
Who in the 21st century is under the illusion that parents order their 18-25 year old daughters and sons to go and fight. I say 18-25 because I imagine Jenna Bush is older than 18. I dont know. But its pretty relevant. Only some backward, 3rd world country would have parents ordering their 20 year old offspring to join the armed forces. And I cant think of one where that attitude exists except America.

I think you should do some more thinking. I also dont rate your poetry? very highly. Its 2 notches better than dire.

      Jamesm

Now if makers of the wars seem painstakingly slow,
To send their children, why should anyone go?

    24. Bahb Silent Says:

As long as you keep the second amendment safe, politicians should be too scared to truly curtail US citizens other protected rights.

For you history buffs, remember our constitution and out bill of rights came from a bunch of rebellious tax dodgers who probably all had a real negative view of people telling them how to live thier lives.

We as US citizens were given 10 basic rights by these people, and included in them is the average citizen’s recourse if someone tries to take them away.

We were also given a duty in the declaration of independence to oppose tyranny in all of it’s forms. But what if it is the US government that is becoming the tyrant? That is what our second amendment was for. Politicians, knowing that a sizable percentage of citizens have access to firearms, are reluctant to make sweeping changes to our system of government.

Which is why political action groups and politicians sway popular opinion to their side. Fear, plain and simple.

So my statement is, keep our second amendment safe, and it will do the job of keeping our other Rights safe.

    29. not me Says:

Those who advocate the exclusive use of nonviolent peaceful protest and using the existing and hopelessly corrupt political and electoral process to bring about change within the fascist USA should be reminded of certain facts.

Mahatma Gandhi was not entirely a pacifist in his political philosophy. On a number of occasions Gandhi admitted that while he advocated the Satyagraha Movement’s methods of nonviolent peaceful protests against the British Colonial occupation of India, Gandhi also recognized that Satyagraha’s methods of nonviolent peaceful protest would not work against the German Nazis or the Japanese Imperialists.

At the outbreak of World War Two, Mahatma Gandhi and the Congress Party, which organized and led the Satyagraha Movement, made an agreement with the British government that for the duration of the War, the Congress Party would direct its leaders and its followers to ’stand down’ and refrain from Satyagraha demonstrations and protests. Furthermore, the Congress Party, including Gandhi, encouraged the Indian population to support the British war effort against the Germans and the Japanese. The Congress Party even helped recruit Indians for the British Army.

Thus we see that Mahatma Gandhi, the fabled leader of the nonviolent Satyagraha movement, advocated violent measures against the Germans and the Japanese during World War Two. This seeming paradox in Gandhi’s behavior demonstrates that Gandhi was not a purist, but a pragmatist, when it came to choosing between the nonviolent Satyagraha methods or violent resistance. Those who consider themselves to be followers of Gandhi and Satyagraha need to be reminded of this fact, because many of them espouse a rigid adherance to Satyagraha that Gandhi himself did not advocate or follow.

Nonviolent Satyagraha purists often point to the domestic protests and demonstrations against the Viet Nam War as an example of successful nonviolent peaceful protest. That is, however, mythmaking and revisionist history, because the protesters DID NOT end the Viet Nam War with their peaceful demonstrations.

The leaders of the US government, including LBJ, Nixon, McNamara, Agnew, Westmoreland, Dulles, and many others, repeatedly stated that their prosecution of the Viet Nam War was never influenced by the anti-War protesters, and history shows that they were speaking truthfully about that. The Viet Nam War ended because the long-suffering and resilient Viet Namese people, who had lost three million of their population during the War, finally drove the US Imperialist aggressors out of their country.

An obsession with, and the idealization of, nonviolent peaceful protest as the only valid form of political action can emasculate and render ineffective a movement for political reform. Dictatorial governments know this quite well, and it is very much in their own interest to encourage a rigid philosophy of non-violent peaceful protest as a way of emasculating, disarming, and rendering futile a reform movement. A strict adherance to a policy of nonviolent peaceful protest allows the government to continue its own corrupt and violent ‘business as usual’ without the threat of serious disruption.

When the day-to-day business of the government is violent in the extreme, such as the US genocides in Iraq, Guatemala, Viet Nam, Cambodia, and Indonesia, cooperation with the government is a cooperation with State-sponsored violence. A strict adherance to nonviolent peaceful protest as the only method of political action often masks a ‘cop-out’, an inclination to maintain the socio-political status quo and to do nothing really serious or substantive to bring about reform.

Anyone who cooperates with the US government is cooperating and collaborating with the most violent institution on earth. It is sheer hypocrisy that anyone would support or cooperate with the US government and then claim to believe in nonviolence. The question must be asked, if you truly believe in nonviolence, why do you support the US government? And if you believe in reform, why aren’t you putting your life on the line in support of reform?

A strict adhereance to the method of nonviolent peaceful protest often becomes a way of delaying or defusing a badly needed Revolution.

What you’re saying is that 18 year olds are not ‘kids’ or ‘children’, and if they enlist in the military or go to war, they do so on their own intitiative.

I actually agree with you about that. I also think that in a country with as much schooling and alternative media as we have in the USA, there is practically no excuse for any adult 18 years old or older to continue believing in the US government and
      in the mainstream media propaganda.

So the question should not be “Why don’t the wealthy and the politicians make their own sons and daughters enlist in the military and send them to fight in the wars that the wealthy and the politicians start?”

Instead the question should be, “Why don’t the sons and daughters of the wealthy and the politicians VOLUNTEER to enlist in the military and go fight in the wars that their wealthy and politician parents start?”

If what was in the Dutch media is true (imminent attack on Iran)(I myself think its unlikely they would give a heads-up), this would constitute a reason to declare a state of emergency and postpone (indefinetly) the US elections.

How is it the son of a Nazi traitor rose to such prominence in this country? Obviously this family had help and couldnt have done it alone. You know something funny I read the other day was that Barbara Bush could be the daughter of Alliester Crowley, self declared Beast. Her mother had an affair with him while visiting France with her girlfriend. This would make more sense. Is Bush the Omen? lol

To Gregory F. Fegel using the id of not me.
Just for the record you are partly correct in saying Nonviolent Satyagraha purists often point to the domestic protests and demonstrations against the Viet Nam War as an example of successful nonviolent peaceful protest.
The Viet Nam War ended because the long-suffering and resilient Vietnamese people, who had lost three million of their population during the War, finally drove the US Imperialist aggressors out of their country.
The part that is incorrect is the last sentence. The Vietnam War did not end when the Vietnamese drove the US Imperialist aggressors out of their country. It actually ended after the much delayed Paris Peace talks finally came to an agreement.
After the 1968 Tet offensive when the North Vietnamese forced tried to capture as much of the south as possible and were beaten back that the North agreed to talks in Paris The talks started on May 10 1968 and after 3 1/2 years, all they had agreed on was the shape of the table. US and other forces started reducing troops in June 1969.
It was not until January 27 1973 that a peace accord was finally signed.
The US along with the other Free World Forces and the North Vietnamese agreed to withdraw and reduce the military forces in both parts of the country. A general election was to be held with international observers within two years.
By December 1973 all Free World Forces had left the country. Only troops required to protect the various embassies remained, and all military aid was suspended
While the South complied with the agreement the North continued to build up forces and in 1975 launched an offensive that was in effect a separate war and that swept through the country mainly because of the weakened position of the forces in the South. Saigon fell on April 30 1975.
Even though most of the main stream media claim that the war ended in April 75 it did in fact end in January 73. For the first time in history, the United States, Australia, New Zealand, South Korea and the Philippines have claimed to have lost a war that they were not involved in.

aah Geraldine Ferraro! yes they were DEMS, but roles in parties can and do switch. i think that this is a remake of the 1984 elections were Reagen won by a major landslide, although there is 2 differences, 1. this time its the republican party with the female running mate, to its not a re-election year, some thing else that catches my eye is that Obama attended the bilderburg group meeting this year, and we know what happens there. so Obama is a shue in, no matter who would run against would win the election is FIXED so everyone think about it

The Warmachine totally needs those Islamic and Communist enemies to suck the lifeblood out of the people. I’m not a big fan of false flag Putin (Beslan, Moscow theaTRE, apartment bombings), but his efforts to be a regular western-style trading partner has been systematically reproached, and the former satellites aren’t being allowed to co-exist peacefully, they’re being overtaken by covert ops to make them US puppets by the NWO NeoCons. Castro I like better, even though a communist dictator, he’s been forced to run a hardened Soviet-council style society by the enemy-hungry CIA-Mafia based just to the north in Miami and the trade embargo. But his people have made great strides in education , health care , basic survival amenities, totally unlike under CIA-Mafia puppet Batista. If nations of the world would open trade barriers, and people were allowed to communicate more, the whole Warmachine system would become dismantled, and the Elites would melt like the occult witches they are..
