    The district attorney in Prince George’s County, MD, is considering filing charges against an officer after dashcam video shows the officer punching a suspect who was hesitant to get out of his car during a traffic stop.

    The Washington Post reported:

    Prince George’s County police are reviewing the actions of an officer who arrested a motorist on charges of slugging and tackling him during a traffic stop in Hyattsville. A police video of the encounter last year shows the officer yanking the man out of his car, slugging him twice and tackling him.

    “Step out of the car now, or I’ll have you out of the car,” Cpl. Steven Jackson says after the motorist does not comply with three rapid-fire demands to exit the car.

    “You yelling, but you have to give me a reason to step out of the car,” Shawn M. Leake, 24, replies.

    Jackson opens the driver’s side door and pulls Leake out of the car. Almost immediately, Jackson makes a fist and slugs Leake in the face, then quickly slugs him again in the face, the video shows. Leake does not hit or appear to try to punch Jackson.

    Fox News’ Megyn Kelly talked with defense attorney Mark Eiglarsh and Fox News legal analyst Mercedes Colwin about the case.

      Cops think because of the recent legislation passed (Patriot Act) they can do whatever they want without repercussions. Its quite funny how a cop who tries to exercise this “patriotic Act” of duty by inflicting any mean on anyone who questions their authority; then they get media and public attention and prosecuted by the very people who they thought would protect them and keep them immune to indictment. So sad, yet so funny.

      1. IF A COP HITS HIS LIGHTS TO PULL YOU OVER, DO SO IMMEDIATELY, AND PULL OVER OUT OF THE FLOW OF TRAFFIC. IF POSSIBLE MAKE SURE YOU ARE IN FULL VIEW OF OTHER PEOPLE OR WITNESSES IN THAT AREA.
      2. ROW DOWN YOUR WINDOW JUST ENOUGH TO TALK TO THE OFFICER, ABOUT 2-3 INCHES ONLY, AND KEEP YOUR CAR DOOR LOCKED.       Ellis said Jackson stopped Leake, who was driving a Cadillac, in part because the vehicle’s windows were tinted.
      The tinted windows made the situation more dangerous for Jackson because he could not see whether other people were in the vehicle, Ellis said.

      Ellis said Leake had been previously arrested in Anne Arundel County for resisting arrest, a charge that was dropped.
      Ellis said he did not know whether Jackson knew of that charge at the time of the traffic stop.

      My comment on this story is that his original reason for investigating the license plate number was due to the tinted windows. When he ran the cars background check and saw the drivers name he pulled up his history possibly (Most Likely) showing the resisting arrest charge thats why the cop began by man-handling the dude. If the officer asked him to get out of the car he should have probable cause for a Pat Down, etc. If his probable cause was the guy might get resist arrest thats entrapment or something.

      The cop would have done the same thing whether Jackson complied and exited his vehicle immediately or not. He was pulled over for this crime: Driving While Black.

      First off, the guy shouldn’t have been giving the cop lip. That already right there put the cop in a defensive position because that is an indicator of a troubling motorist. Save the smart mouth for court.

      Second, I think the cop was too quick to start throwin’ blows. He was too aggressive with the lippy motorist.

      Third, I think that they are both wrong. The guy being lippy and the cop being over aggressive. The cop does sort-of have a right to be alarmed; his life is at stake. But he is a professional (with a badge) and his held to a higher standard. The cop has full right to use lethal force or necessary force. This time I think the cop made an honest mistake of losing his cool. He should be reprimanded and put back on the force with supervision for some time. And then after that he goes back to the force as a better officer.

      Conclusion, the cop gets to apologize and do one of those classes where they learn to not be overly and unnecessarily aggressive with motorists. And the guy get a disorderly conduct or something like that. They both get punished.

      This is a very fine line we must look at…..

      A smarter mind than mouth is required at these times in our detentions….
      The traveller could have engaged the officer in conversation that didn’t include conflict…

      both the officer and traveller are human at the basic level…..when that is breached by submission of either party, there will arise conflict….

      Police fall under a couple of different catagories, but at no time are they above the common man…

      A “Driver” of a vehicle is a commercial title given to “licensed” vehicle operators…
      A “Passenger” is the valuable content the “Driver” is transporting…
      Once a Traveller responds as the “Driver” of the Vehicle, he has crossed the societal line, and is engaged in commerce….

      In that instance, all bylaws and policies apply….

      If the traveller stated he would love to get out of the car for any personal reasons ( not as a form of submission) then no power is given away….

      Confilct is avoidable 99% of the time….When it is unavoidable , you agree to submit but only under Duress…

      It is not a crime to be “lippy,” jackass, nor does it justify the officer’s criminal behavior.
      Not only that, but the motorist had every right to ask the officer what his alleged offense was, and didn’t appear to be rude in the slightest.

      My husband is a police officer(almost 10 years), and I’m a member to Alex Jones’s sites. My husband as well as I agree with you. As well as most of the other posts. My spouse has seen and heard some messed up stuff coming from his co-workers. He refused to tell me about something the other day because he said I’d be on the internet blabbing my mouth about it on our local news site. It’s all about treating everyone with the same respect you would like. He follows this, and he’s never had a problem with anyone. He tried telling one of the newer officers about his approach, and they wanted to hear nothing of it. He is very good at diffusing a situation with his words and not his actions. I’m not saying he’s never gotten into with anyone because you will have those people that want to fight. I believe all officers need extensive training in how to properly deal with the public, as in how to talk to them and how to verbally diffuse a situation before it escalates out of control. The officer could’ve answered the driver, but then he might’ve been going to arrest him and didn’t want him driving off, turning a simple stop and arrest into a police chase. Chances are that’s what happened in this case. That in NO WAY excuses the officers actions. Sure, pull him out of the car if you have to, but don’t beat his ass over it. Any other ‘good officer’ would tell you this. I was quite surprised that I found a retired chief that agrees that most officers need to take a chill pill, and should be held accountable for their actions. What really irks me is the fact that we have the video evidence and the report where the officer lied in this case, and the dept is still backing him. They need to be investigated just like every other dept in this country. There still are good ones officers out there, guys, though. They’re just few and far between, a rarity you might say. I hope the officer in the video gets fired and charged with assault for his actions. If that were me, my butt would be in jail.

      You seem to forget that citizens have the right to resist unlawful arrest and has been considered by the supreme court to be equal in measure to someone being kidnapped.

      We dont have to put up with this crap. In fact the supreme court held that citizens can come to the aid of another citizen being unlawfully arrested as they would if they saw someone being assaulted, raped, murdered or kidnapped.

      The supreme court also held that in the same case, the citizen has the right to use lethal force to defend his/her right to life liberty and the pursuit of happiness.

      2. Why didn’t the other law enforcement officer assist his partner in the take-down. His testimony will be crucial.

Sure the guy should have gotten out but he wasn’t getting loud and the cop should have simply chilled out and kept his cool. The stupid brunette is saying he took a combative stance…he was trying to get his balance you idiot. The cop CLEARLY lied to either try and save his own ass or justify his lust for power. Just because the traffic stop is one of the most dangerous things a cop does in NO way justifies their using violence in such an aggressive and unnecessary manner. If they’re SO paranoid that they can’t control themselves, then give them a desk job, take a leave of absence, go see the cop psychologist or find another line of work!

      There is another older video some might have seen, the person pulled over cusses, screams, yells obsenities at the officer, but the TRAINED officer is polite, even makes the guy aware he is littering after the guy rips up the ticket and throws it on the ground, and still the officer is polite and does his duty to SERVE and PROTECT, the guy leaves and neither the officer or the violator is harmed, NO scuffle, no punching…Now THAT was a trained Police Oficer whom I can respect, respect is EARNED, it does not automatically come with a badge! This cop in this video is plainly a thug and deserves NO respect, sure the ofender is an ass, but there are a lot of those in the world and cops can’t BEAT them into submission or change their attitude, but RESPECT for the citizens whether they are rude or not can EARN MY RESPECT in return, and actually make more people respect them also, all the officer in this video earned was my disrespect and cause me to be hesitant as to the motives of others like him!

      All officers in Maine, or everywhere in the US? Most are not that way everywhere. Officers usually just don’t have a video shoved right in there face so you can see every action, someone causing that big of a fit over a ticket, or they have other officers backing their every word. One time an officer didn’t back another, and thought his side was put in the way he recalled, now there is question to whether this dept wrote down what he recalled, or made up a bull story to cover their butts. He is too afraid to ask, the dept already in a nonchalant way said they could fire him for things being brought into the light. If you are one of the good ones, it’s not so great because of all the stuff that goes on.

      1. The most dangerous routine job of a police officer is actually a “Domestic Dispute”.

      2. The “suspect” should have exited his vehicle when asked without any questions.

      3. The cop used excessive force and should be arrested. Police have NO SPECIAL privileges when it comes to breaking the law. We are a nation of laws, not men.

      4. Losing your cool in a stressful situation is not excuse for battering a person.

      For those interested check link 2 – I was a young marine on leave brutally beaten by police in a State Police barracks for making a complaint after witnessing 2 policeman beating a suspect at a local McDonalds. My father was a Narcostics Detective at this time in another city. the police dragged my brother and I out of our parents home in the middle of the night with no warrant. After going public with an attorney, the police hired Todd Vachon to kill me and another gentleman. The police did not know that I knew Todd Vachon at the time. Todd Vachon made his testimony on video which can be seen on Link – 3. The officers were allowed to resign the day before they would be fired. they never saw the inside of a cell. During this time, I was stabbed 13 times by a police informant who worked closely with these 2 officers. The stabber was on probation for burglary and several assaults at the time of the stabbing. He never saw the inside of a cell though he was arrested and ordered to pay restitution. I have never in my life committed a crime. Served honorably in the USMC, Army Guard, Coast Guard Aux and now have a family of 5 children. I, to this day, have not been twarted from seeking justice and will test the police and their superiors because they work for me, for us and should carry out their work related responsibilities with honor & justice.

      I work at a major university and one day a guy was causing trouble in a store breaking things because of a dispute with the store owner, some students “protesting” were being monitored by two police officers, the students had to point out the scuffle ’cause the police were more concerned with the peacefull demonstration “just some kids with signs” so one officer runs to investigate, the other was negotiating with his bike and trying to get to the situation when the perpitraitor breaks and runs to our campus while the other officer talks to the store owner, I pointed this out to the bike cop and he ignores me, all the while struggling to get to his buddy talking to the owner, meanwhile the guy runs through our campus disappearing into the buildings with who knows what type of weapon.       Everytime Ive been pulled over by the police for a traffic stop, I knew what brought it on. And I bet most everyone else does when it happens to them. I respect the officer and expect him to respect me in return. I put the window down, and then keep both hands on the wheel until they ask for my registration, license and insurance card. That way they dont have to wonder if I’m getting a weapon as they approach my vehicle. If it’s dark, I’ve put my interior light on when I put the window down. There should be no reason to exit your car without a reason being provided by the officer. At that point you need to make the decision to comply or cause trouble. ONLY if you are in fear for your life should you cause trouble. Everything else can be settled in a better way. Unfortunatley, a traffic stop is not the venue to defend your constitutional rights no matter how you feel because you will be consider guilty untill proven inocent. Let the cop play the victim and then prove them guilty and vindate yourself later. Having said all that, If I felt i was in real danger I would fight for my life and freedom. But not over a ticket……….

      First of all the driver was stupid for having his door able to be opened by the police officer. There are only two reasons why legally a police officer can order you to get out of your vehicle. One, if you are physically intoxicated. Two, if they DECLARE they are specifically placing you under arrest.       These talking heads conclude that the drive had to get out of the car for a routine traffic stop when the officer told him to. And they further state that the officer telling him to get out of the car was completely legal.

      I don’t know the law on this one and maybe it varies from one state to another.
      But from what I know, I don’t believe you have to say anything to a cop for a traffic stop, just present license, registration, proof of insurance, nor step out of the vehicle unless their is some other more serious reason backed up by probable cause and there is no reason why a driver cannot be informed as to why.

      At 3:00 they show it in slow motion.

      You can see that the driver does give the cop a little extra flail and lands one on the cop’s chin or cheek…whether on purpose or accident. But if you are flailing it matters little.
      The cop’s head even tilts to the side as a result of the impact. Not to be confused with just a bit after that the cop jerks the guy up to a full vertical position and the cops head moves backward as part of his pulling the guy up….as no blow occurs here. But the actual contact from driver to cop happens just before this as the driver is halfway out of the car but not yet standing vertical. It is a bit dark and shadowy but you can see the cops head respond to the hit as his head turns over his right shoulder from the impact.
      This sends off the cop who now delivers a flurry of pitiful jabs to the driver.
      So the cop’s report is not necessarily false.

      Bad policing…definitely.

      Hey now, some cops are totally on powertrips. Others can be pretty cool. I’ve had the misfortune of dealing with them on about 11 occasions. 8 traffic violations, and 3 “other”. Among the traffic violations, I’ve met cops ranging from sketchy nervous paranoid scumbags, to paranoid orderly types, to orderly laid back, to damn cool. This is among all states.

      Now for the “other”, which has always been possession of cannabis, I’ve once had a cop try to scare the shit out of me, then vanish without a warning, citation, nothing. I file this in the “damn cool” category. Another time, I had some older cops show up, who were very orderly yet laid back. Then showed up some younger cops fresh out of the academy who were jacked up on adrenaline and an endless supply of crappy jokes. Still sore on those punks.

      One thing most cops will never be accused of is being mental giants, okay. Their ego’s dictate their actions. So you have to approach these roid-ragers with kit gloves and be smarter than them. Learn how to speak their language basically.

      Here’s what i would do. First of all, i have Pre-Paid Legal Services. I am not promoting them or advertising for them, i’m just saying i have them and it’s cheap too, $25 a month.
      If that cop would have asked me to step out of the car, i would have said “no problem”, then locked the car door and handed him a card that pre-paid legal sends you to keep in your wallet entitled, “Legal Shield”, and it tells the cop basically that you refuse to answer any questions and that you request the right to contact your attorney immediately. Once they see this, they generally back off.
      Either way, you can’t stoop to the retarded cops level. You have to use a little more intelligience when talking to them and if they flip out on you…SUE THE SHIT OUT OF THEM!
