According to a story in Friday’s New York Times, Vice-President Cheney advocated in 2002 for the Bush administration to send military troops to Buffalo to arrest the so-called Lackawanna Six as enemy combatants.

This would have violated both Fourth Amendment guarantees against search and seizure without probable cause and the Posse Comitatus Act of 1878, which makes it illegal to use the military for law enforcement.

Despite those prohibitions, Cheney argued that the president did have the power to use the military on US soil, citing an October 23, 2001 Justice Department memorandum co-authored by John Yoo which claimed that presidential power extended to the domestic use of the military as long as it served a national security purpose.

The Lackawanna Six were a group of young Yememi-Americans who had attended an al Qaeda training camp in 2001. They were arrested in September 2002, and President Bush bragged of having broken their “cell” in his January 2003 State of the Union address.

However, an investigation by Salon failed to turn up any evidence that they were actually a “sleeper cell” or that they had been planning any kind of violent attack. Most of them were convicted merely of providing material aid to terrorists.

According to Salon, all six were very ordinary young men who had been led to believe they were traveling to Afghanistan for religious studies. The evidence against them was tenuous — which was one reason Cheney pressed for them to be held as enemy combatants instead of being arrested — and many of their Muslim neighbors told Salon they believed the entire case against them was a scam.

The October 2001 Yoo memorandum was declassified last March, but the accounts given to the Times by anonymous Bush administration officials are the first indication that there was serious consideration of actually using it.

Cheney’s legal advisor David Addington and some Defense Department officials supported Cheney’s position, but several aides to President Bush opposed it, along with then-National Security Adviser Condoleezza Rice and FBI Director Robert Mueller. President Bush ultimately turned the plan down and ordered the FBI to make the arrests.

One thing I do see so far is, it is really telling the level of pessimism on this site amongst its user. The gyst of the story is, “Cheney and friends suggested using military in the US streets, and GW Bush denied it”. The fact that your focusing on the idea that was purposed instead of the more important aspect of it being denied is telling.
It also shows how NOTHING controversial can be kept secret. But you guys keep thinking 9/11 was an inside job and they kept that secret…..just not this idea.

Heinlein, one of my favorite authors. He was a radio officer on the U.S.S. Utah before WW2. My father was on it at the same time I found out to late to see if he had known Heinlein. My dad was transferred from the Utah on 12-4-41 and left Pearl Harbor for San Francisco on the 5th. Many good men that my dad knew died on the Utah. Interesting fact. My dad’s ship picked up sonar soundings of what they knew was a Jap sub just outside the sub nets as they left Pearl Harbor on the 5th.

Let me add to the facts as presented here, from a field officer’s perspective, and one who knew of numerous JAG officers resigning over Yoo’s interpretation of the Constitution. As Abu Ghraib and other field detention centers were sprouting up, the legality of holding POWs for interrogation and without formal charges was being debated among the JAG corps officers, at least in the Army.

Yoo’s interpretations and their legality within U.S. Law, but also under International Law, esp. with concerns re: the Geneva Convention, which is U.S. Law were specifically being discussed sub rosa among the JAG corps. Those of us who are and were field officers had gotten wind of the possible repercussions, including the likelihood that we, as U.S. commissioned officers could be up for international war crimes charges should we follow the orders of our superiors in a systematic grabbing of Iraqi citizens under the ROE.

What made matters worse was the midnight passage of the 2006 Military Commissions Act which specifically protected the President and his Caibinet from any war crimes, but conveniently omitted the U.S. Military from standing trial. The Bush Gang had protected their butts.

JAG officers began resigning when they could over these very concerns. Those of us who are Infantry officers did not have this option. I, decided, more to protect those under me, should the inevitable happen and I was charged under the Bush Administration with War Crimes (in order to cover their own sorry arses). It is always to the field officer where blame is usually attributed to, when the top brass begin to protect themselves.
