Congresswoman Marcy Kaptur boldly slammed the bailout bill this past weekend as the work of criminal insiders who have shut down the normal legislative process to commit “high financial crimes” and defraud the American people, while Rep. Michael Burgess warns that “martial law” has been declared.
The two Congress members are part of a growing minority of representatives sounding the alarm about the dictatorial nature of the bailout bill, which is expected to be up for a vote in the House today, with most in Congress having not had the opportunity to even read the legislation.
The bill is expected to reach the Senate on Wednesday as a raft of outraged politicians cry foul about being strong-armed and accused of being unpatriotic for opposing the carte-blanche passage of a piece of legislation that fundamentally centralizes control of the financial infrastructure of the country into the hands of the government and the Federal Reserve.

“We are Constitutionally sworn to protect and defend this Republic against all enemies foreign and domestic. And my friends there are enemies,” Kaptur told the House floor.
“The people pushing this deal are the very ones who are responsible for the implosion on Wall Street. They were fraudulent then and they are fraudulent now.”
“My message to the American people don’t let Congress seal this deal. High financial crimes have been committed,” added the Democrat from Ohio.

“The normal legislative process has been shelved. Only a few insiders are doing the dealing, sounds like insider trading to me. These criminals have so much political power than can shut down the normal legislative process of the highest law making body of this land,” Kaptur concluded.
Elsewhere, Rep. Michael Burgess (R-TX) said that the only information he had received about the bailout was what talking points to use on the American people and that he had been thrown out of meetings for not blindly supporting the bill.
Ominously, Burgess also comments, “Mr. Speaker I understand we are under Martial Law as declared by the speaker last night.”
Absent any proper hearings concerning the legislation, Burgess called for the legislation to at least be posted on the Internet for 24 hours so that the American people could “see what we have done in the dark of night.”

Mussolini-Style Corporatism in Action: Treasury Conference Call on Bailout Bill to Investors (Updated)
combs through and analyzes the transactions, the deed will have been done. But if Paulson makes a statement that assets will be bought at par before the bailout’s even begun, that will be reported and might kill the deal.
Various readers wrote us, and it was confirmed by a detailed report on the call at DealBreaker, that the Treasury Department held a conference call this evening for investors on the bailout bill. A memo was evidently sent to SIFMA members; others may have been contacted by other means. But the report I got from one person who was on the call was the the questions came from financial services industry members. In other words, this was most assuredly not intended to be a call open to the public at large. If anyone from the media or other member of the great unwashed was listening in, it was by accident.
This is simply scandalous. To have a group of interested parties get a privileged briefing by government officials on a matter of keen public interest flies in the face of what a democracy is supposed to be about. The proper method would either be a published FAQ on the Treasury website or a briefing with the media included. But why should I be surprised? Favoritism has been a staple of the Bush Administration.
There is a live blogging recap at DealBreaker. Someone who was on the call is going over his notes and other recaps on the Web and sending me his version, which I hope will add some color. Check back for that update.
Update: Here are the notes promised. Calculated Risk had put up the conference call number. so some of this is the listener’s notes, some are hoisted from CR. They are admittedly skeletal at points, but track and enhance the live blogging report at DealBreaker. You can download a torrent for the call here, which I intend to do post haste and will amend the post accordingly. I’ve included the long form notes below, but some items jump out:
1. The tranching is a mere formality, and the Treasury boys as much as said so. They could take the $700 billion max as soon as the bill has passed,
2. However, they do not plan any action immediately, will wait a couple of weeks. They want to focus their efforts on stronger companies but also made noise about protecting the financial system. This, by the way, is the Japanese convoy system all over.
3. There seemed to be a lot of tap dancing about what price they will pay for assets and no straight answer about their policy on warrants. They did say that if the amount sold was greater than $100 million, they would take warrants. FYI, the current draft allows them to pay up to the price at which the assets were initially booked (yikes) . I wonder if this is obfuscation, if they have an idea of what the plan to do but will not admit it in any public forum.
4. As the person who listened to the call stressed, DealBreaker wasn’t clear on the bifurcated process. If you come to the Treasury and you are in trouble, you get reamed. Bear/AIG style treatment, execs probably fired. But if you participate on a voluntary basis, the intent is to make it very user friendly. That is consistent with Paulson’s position during the negotiations.
5. The exec comp provisions sound like a joke, They DO NOT affect existing contracts, they affect only contracts entered into during the two years of the authority of this program and then affect only golden parachutes. More detail on that point, but I don’t need more detail to get the drift of the gist.
Further below are the notes, admittedly somewhat cryptic at points, but hopefully helpful. But if you have time, listen to the download. Be warned I may revise and add to the post once I have done so.
Update 12:30 AM: Have queued up recording of conference call but not yet listened to it. But reader and sometime contributor Lune provides a useful take. Hoisted from comments:
1) If even the Treasury is saying tranching is a formality, then it really is nothing. Not sure why Dems fought so hard for a fig leaf.
2) Waiting a couple of weeks because no one has any idea when or where the next bomb will blow up. In other words, all their doomsday scenarios about Black Monday were B.S. They screamed the check had to be written by Monday, but now they’re saying they actually have a few weeks before they need to cash it. Plus, this will allow them to “seek guidance” from GS, JPM, and other selfless public servants about where the money should be funneled.
3. The tap dancing is because they don’t want it to get out that they’ll be giving a sweetheart deal. The public won’t be following each individual transaction to see exactly what price is being paid. So ridiculously overpriced asset sales can be hidden in the details, and by the time some reporter (or blogger

I thought a bailout should be the absolute last option for a bank. I.e., it should be so unpalatable, so unprofitable for a bank and its executives that they exhaust every private means of survival before coming for their public “reaming”. I wonder if foreclosed homeowners would rate their foreclosure process as “user friendly”.
5. Of course the exec comp provisions are a joke. Who do you think is going to be hiring all those banking cmte staffers and newly retired congresspeople next year during the inevitable post-election turnover? Do you really think they’re going to vote to limit their salaries? Remember that for lots of people on the Hill (including elected reps), govt work is merely time you spend accumulating credentials in preparation for your real life’s work in the vastly richer private world.
Taxpayer losses: “golly, let’s just pray to Jesus and hope he’ll make sure that in a few years our country won’t be bankrupt.”
Oversight: “let’s appoint a committee which will file toothless reports that no one will ever read”.
I’m glad to see that while much time was spent in Exec comp. and tranching kabuki theater, the real points of protection of taxpayer losses and implementation of new regulation seem to be afterthoughts.

Residential and commercial mortgages. But very importantly, it can be any asset.
Excited about ability to guarantee assets in exchange for a guarantee fee.
Sought as much authority and as much flexibility as possible.
Eligibility: as broad participation by institutions as possible. The
more participation, the more effective it will be. Want banks of all
sizes or any financial institution that has a meaningful presence in
the US to be interested and enthusiastic.
Purpose is to help private sector clean up their balance sheets.
Highest priority: make sure it works, will attract companies to
participate. Warrants and exec comp. were very highly negotiated.

Direct purchases from failing institution e.g. Bear Stearns, AIG, F&F: will do the same thing, take maybe 79.9% equity.
Market mechanism: Congress wanted taxpayer benefit in upside. Sell
warrants for assets over $100M , but the amount of warrants is still
TBD. WE want healthy institutions to participate so it should not be
punitive.

Direct deal: fire the management, like AIG etc.
Market mechanism: if sell over $300M into fund, some exec comp limits
come with it. For 2 years, the firm could not enter into NEW contracts

We feel really good that we have encouraged healthy institutions to participate, not just bailouts of sick institutions.

Entire 700B is appropriated entirely by the act, no further appropriation necessary.
Tranching: first $250B
Then Secretary determines that more is needed and tells Congress, another $100B
Then Secretary determines that more is needed and Congress has 15 days to refuse, the remaining $350B
No time limits. Can request all the tranches at once, no need for delays.

To block the last $350B, Congress has to say no. Then the President can
veto that. To override that veto, Congress needs 2/3 majority.
ALL of that must happen within 15 days, otherwise the money goes out.

They approve what they don’t read all the time. This time, however, it looks like the voters back home might throw them out. That’s the one and only reason they are ‘concerned.’ Actually it was one-third of the colonial population tossing the Brits out–one third anti-Brit, one-third ‘neutral,’ and one-third pro-Brit. In other words, two thirds of the population didn’t lift a finger during the Revolution, or aided the enemy. Its the same thing now. About half the Senate and House are pro-Bush and pro-Republican. Look at Pelosi–she claims to be a Democrat and leader of the non-existent ‘opposition,’ but she is really a yes-woman, GOP stooge and handmaiden and Bush-Cheney-Paulson enabler. Franks the same way. We are adults here (most of us anyway),and need to put our voting power to work.Let’s find out who the culprits are,and vote these people out of office.Something like this could really create civil havoc! As far as money is concerned: “Give to Caesar - what is Caesar’s”.The money belongs to the Federal Reserve…so let them have what is theirs!
I do however think that since Wall Street is being “bailed-out”,these “bad” mortgages should be “reset” to affordable mortgages…or forgiven altogether! Implement strict regulation,and adjust the prime lending rates.This would “reinitialize” the system,and promote stable recovery.
Let’s think of ways to repair the system - not destroy it!

HERE’S MY SOLUTION TO THIS BAILOUT SCAM!
Nobody ever asked the people paying for the bailout for their approval. They think they can just ram it up our ass and make us pay. NOT. Here’s what I’m going to do and suggest everyone do the same.
1. Tell your boss at work that you no longer want to be paid by payroll check. You would prefer being paid “cash only”, for your work. That means no federal tax deducted, no state tax, no fica, no social security ect. Don’t send your hard earned money to Washington to bailout these crooks, period.
2. Since it’s the corporations like JP Morgan (Chase Visa), and all the rest of the investment banks that are on the payoff end of this bailout scam here is what I’m going to do! I have 25 credit cards each with very high credit limits. I’m going to “rack up” these cards to the max, everyone of them and then default on them all. If everyone did this JP Morgan (Chase Visa) could never sue everybody. Even if they did just don’t pay them a cent. In seven years your credit reports are wiped clean anyway and in the mean time you can screw JP Morgan and the banksters ten’s of thousands of dollars. Do it with me you all, LETS GET EVEN !!!

It’s sobering to reflect what “sub-prime” rate mortgage loans were in the first place! This whole scam was a smokescreen ploy to conceal the the destructive effects of the wholesale export of high output, high precision and high productivity productive manufacturing enterprises to cheap, unregulated foreign slave labor camps in helpless third world nations so that corporatist profits and pollution concerns could be erased for the TRAZIs.
The phony false economic ‘boom’ of interest payment mortgage tax deductibility combined with lowered usury supplying a new false ‘growth’ in the housing and commercial real estate markets was a jobs program devised by the private Federal Reserve Usury Corporation to blindfold the public to the catastrophic and permanent irreversible harm they were deliberately doing to the US economy to destroy the middle and lower classes, overflow their noble elite coffers and maintain the destructive sell out of “Free for Us only Trade”. Meanwhile it also offered them a convenient way to undercut the working class of America by housing illegal foreign slave workers to sweat for pennies doing the ‘jobs’ that “Americans won’t do”…
Thus the cornerstones of the neo-con Transnational Elite Corporate Socialists whole sell-out game plan was to create this false bubble to disguise and deceive their opposition to the TRUTH about what the deliberate. selfish and self serving treasonous irresponsibility their plans where causing. Many were never fooled but powerless to prove the corruption except by the telltale balanceof trade figures that could not be made to lie for the conspirators!
Now who are we to blame the Federal Reserve Usury Corporation’s unkind and uncharacteristic ’sub prime rate’ mortgage lending usury program on? Why on earth would they gamble (tossing them into futures derivative trading) with such high risk and unprofitable INsecurities that were maliciously and irresponsibly designed expressly to mask the effects of thier hidden “Free For Us Only” Trade Agenda? The answer was they pawned them off and leveraged them to both to ensure a catastrophic and phony ‘crisis’, and to try to blame their helpless customers for their own ineptitude and hidden self-serving agenda..
They have more than plenty enough money to finance their own misdeeds, in fact, they have all the money they can print and they better get busy backing that paper up with their own funds!

That is not the half of it. Recent polls set the whole country against it. Polls are often good at skewing results so take them with a grain of salt yet in a recent USA Today/Gallup, just 22 percent of the sample said they wanted Congress to “pass a plan similar to what the Bush Administration has proposed” That leaves 78% against it.
Citing the Washington Post/ABC News poll AFP states ” Americans divided on plan: 45% support bail out while 47 percent opposed it.
The American People have spoken and all the fear mongering in the world will not convince them that giving bankers anything but a pink slip is a good idea…Like bankers go to jail. It is good to see what goes around comes around faster and faster these days.
America has turned the corner and is now starting coming about. This once majestic nation sold into prostitution by these same bankers is raising herself up by the will of her people. We are waking up at a faster and faster rate each and every day.
The ability for these lairs to manipulate the system is coming to an end. America may not know this but there is a great force working to save this nation and the world from slavery.
That vote made me proud to be an American….

An Analysis Of The Change Issue
As yet another Presidential election season has come due, it is well worth noting that “change” has become a constantly recurring campaign slogan in American elections. Those intellectuals who opt to continue onward with such a tired refrain are well aware that very little will change for the betterment of the American public-at-large, in spite of the media-controlled flood of campaign rhetoric on behalf of the respective nominees.
Many Americans may well wonder, “Why is it that we desire change in the first place?”
Whereas the Constitution of the United States was originally fabricated in order to give the American citizens a simple guideline for their representative government, more than two- hundred years of incessant Legislation has produced a miasma of orders, acts, statues and laws that are repugnant to the Constitution - each time these ideas have been merged into public policy in the name of change.

And now the Senate has passed yet another bailout bill during the hours of darkness on 10/02/2008. Except now the bailout is being referred to as a Rescue Plan. The tax payers of this country are the ones who need to be rescued, not Wall Street and corrupt politicians.
The new Senate bill is an even bigger step towards socialism. It contains a provision whereas the government can dictate to corporations the amount of money that can paid to their top executives. If this isn’t socialism then someone pray tell me what is. Where does it end? First the government places a cap on top executive’s pay, then tomorrow it’s extended to upper management, then mid management, then lower management and so on, until it reaches the lowest employee in the food chain.
Are some top executives overpaid? Absolutely, but the corporation and their shareholders are the ones who should be responsible for setting the salaries, not the US Government. And, the corporations should be held responsible for their failures, not the tax payers. After all, isn’t that what happened to the ENRON executives?
I say no bailout, period. If government does anything, it should be to get the hell out of the way and let the market take care of itself. The failure of Fannie and Freddie is yet another prime example of how the government is incapable of running anything. Name me just one government program that has been successful.
And even more unbelievable is the fact that the same members of congress who are responsible for the failure of Fannie and Freddie are the same ones who want us to trust THEM to clean up their own mess. I think NOT.

We here in our part of the country are having to say bye, bye to what WAS a very good program for the homeless ( namely homeless VETERANS ) where they could get winter clothing, very warm sleeping bags, and assistance, all in one place, once a year! Our wonderful CONgress definitely showed us their TRUE priorities!
