Cybersecurity: Obama’s Promise to Trash the Constitution

During a speech today on “cybersecurity,” Obama told a whopper. He said the government’s effort to protect us from cyber bad guys “will not include monitoring private sector networks or Internet traffic. We will preserve and protect the personal privacy and civil liberties that we cherish as Americans.”
Is it possible Obama has never heard of Mark Klein, the retired AT&T communications technician who said years ago that the company shunted all Internet traffic — including traffic from peering links connecting to other Internet backbone providers — to semantic traffic analyzers, installed in a secret room inside the AT&T central office on Folsom Street in San Francisco? There are similar rooms in Seattle, San Jose, Los Angeles and San Diego, all sucking up internet data.
Klein explained that the multinational corporation is doing this at the behest of the NSA. It is “vacuum-cleaner surveillance” approach that grabs everything. “Despite what we are hearing, and considering the public track record of [the Bush] administration, I simply do not believe their claims that the NSA’s spying program is really limited to foreign communications or is otherwise consistent with the NSA’s charter or with FISA [the Foreign Intelligence Surveillance Act],” said Klein in 2006.
After the NSA showed up in 2002 at AT&T’s Folsom Street facility, Klein began connecting the dots. “You might recall there was a big blowup in the news about the Total Information Awareness [TIA] program, led by Adm. [John] Poindexter, which caused the big upsetness in Congress, because what Poindexter was proposing to do was draw in databases from everywhere — and this was in The New York Times — draw in Internet data, bank records, travel records, everything into one big conglomeration which could be searchable by the government so they could find out everything about what anybody’s doing at any time of day,” Klein told PBS. “And all this would be done without any warrants. This is how it was presented by Poindexter himself in The New York Times, and that caused a great upset, brouhaha, in Congress.”
On January 16, 2003, Senator Russ Feingold introduced legislation to suspend the activity of the Total Information Awareness program pending a Congressional review of privacy issues involved. In February 2003, Congress passed legislation suspending activities of the IAO (Information Awareness Office) pending a Congressional report of the office’s activities.
Congress acted after William Safire published an article in the New York Times claiming “[TIA] has been given a $200 million budget to create computer dossiers on 300 million Americans” (see You Are a Suspect, November 14, 2002).

Of course, the program didn’t go away. Legislators included a classified annex to the Defense Appropriations Act that preserved funding for TIA’s component technologies, if they were transferred to other government agencies. TIA projects continued to be funded under classified annexes to Defense and Intelligence appropriation bills.
“Total Information Awareness — the all-seeing terrorist spotting algorithm-meets-the-mother-of-all-databases that was ostensibly de-funded by Congress in 2003, never actually died, and was largely rebuilt in secret by the NSA, according to the Wall Street Journal’s Siobhan Gorman,” Ryan Singel wrote for Wired on March 10, 2008. “There’s been no real debate in Congress or in the press about whether the government should be allowed to track every Americans phone calls, emails and web browsing.”
Jon Stokes, writing for Ars Technica, notes that TIA technology is nothing new. “TIA-like efforts are still going on” Stokes wrote in 2005, and “the government has been trying to use new technology, like database tech and voice recognition, for domestic surveillance for a long time. And when I say a long time, I mean well before the current administration came into office.” It really got a boost under Clinton in 1995 when the Communications Assistance for Law Enforcement Act (CALEA) was passed. “CALEA mandated that the telcos aid wiretapping by installing remote wiretap ports onto their digital switches so that the switch traffic would be available for snooping by law enforcement.” In other words, Mark Klein had but scratched the surface.
Truman created the NSA in 1952, supposedly to serve as “America’s ears” abroad, but the agency has long served as a secret Stasi-like organization dedicated to snooping on Americans. The NSA, writes Siobhan Gorman for the Wall Street Journal, “and other intelligence agencies were found to be using their spy tools to monitor Americans for political purposes.”
The NSA’s predecessor, the Armed Forces Security Agency, launched Project SHAMROCK in 1945. It obtained copies of all telegraphic information exiting or entering the United States with the full cooperation of RCA, ITT and Western Union. A sister project known as Project MINARET involved the creation of “watch lists,” by each of the intelligence agencies and the FBI, of those accused of “subversive” domestic activities. The watch lists included such notables as Martin Luther King, Malcolm X, Jane Fonda, Joan Baez and Dr. Benjamin Spock, according to Patrick S. Poole, writing for Nexus Magazine in 1999. The FBI, the NSA, and other intelligence agencies were actively involved in creating the watch lists.
NSA has attempted to keep up on technology as the secretive agency continues to snoop on “subversives” and others the government considers miscreants. In February, trade publications reported the agency is offering “billions” to any firm able to offer reliable eavesdropping on Skype IM and voice traffic. Skype is particularity troublesome because it utilizes P2P networks, that is to say peer-top-peer (no central server owned and operated by a telecom required). The government and the corporate media may tell you they want to crack down on P2P — for instance, the vastly popular BitTorrent — because of copyright infringement, but a more practical reason is because the government has yet to figure out how to crack the file sharing protocol. Skype and BitTorrent account for a large amount of traffic on the internet.
If you think Obama will roll back the government’s massive and unconstitutional snoop program, think again. On April 3, the Obama Department of Justice filed a motion to dismiss one of the Electronic Frontier Foundation’s landmark lawsuits against illegal spying by the NSA. The DOJ demanded that the entire lawsuit be dismissed based on both the Bush administration’s claim that a “state secrets” privilege bars any lawsuits against the executive branch for illegal spying, as well as a novel “sovereign immunity” claim that the Patriot Act bars lawsuits of any kind for illegal government surveillance (see the EFF press release, Obama Administration Embraces Bush Position on Warrantless Wiretapping and Secrecy).
In March, Obama’s coordinator for cybersecurity programs, Rod Beckstrom, a former Silicon Valley entrepreneur, quit because he opposed the role of the NSA in the so-called cybersecurity initiative. Beckstrom said “the threats to our democratic processes are significant if all top level government network security and monitoring are handled by” the NSA.
“Obama’s moves drew praise from key lawmakers on Capitol Hill, who vowed to work with the president to implement new security measures as needed,” CQPolitics reported shortly after his “cybersecurity” speech. “Obama said his cybersecurity adviser — who will be a member of both the National Security Staff and the National Economic Council staff — will head a new office within the White House.”
“We applaud President Obama for highlighting the extraordinarily serious issue of cybersecurity,” Sens. Johns D. Rockefeller IV, D-W.V., and Olympia J. Snowe , R-Maine, said in a joint statement. “No other president in American history has elevated this issue to that level and we think him for his leadership.”
No other president so far has had the power to shut down the internet. The Rockefeller-Snowe bill, S 778, would grant Obama dictatorial power declare a so-called “cyber emergency” and pull the plug, or at least cripple networks deemed a threat. The U.S. government is not seriously worried about Chinese hackers or mischievous kids in Latvia (as Rockefeller cited as a danger) but rather fear free and unfettered speech and activism on the part of its own citizens.
Obama’s promise is merely an effort to string you along with a big fat lie. He has absolutely no respect for you or the Bill of Rights.

They will shut down the internet, and that will be the call to arms. It will doubtless be disguised as another 9/11 stylized attack, but the 9/10ths of that 10% will know better. It will be a call to the lone wolf type actions espoused in your name. And yes, I am in shape, can do all of that, and the last time I shot (I do so infrequently nowadays) I was not overly disapointed in my ability to make a head shot seem quite easy.

Actually… there are 30% that will support anything done by someone with a (R) beside their name… and I suppose there are probably only 20% that would support anything done by someone with a (D) beside their name (God and Guns draw a more loyal flock) – so that’s half the people in America. These people are not only ignorant – they are also brainwashed.
Then there’s 30% who are not brainwashed… but who are still ignorant. They feel courageous and well informed, because they “vote the issues regardless of party.” But the “issues” to them are just sound-bites. They do see the ignorance in the brainwashed… but they do not see the ignorance in themselves.
The last 20% is made up of at least two groups of people. Some don’t get involved at all in politics – they don’t want to know anything about it. They are the willfully ignorant… and that’s the type of ignorance that is the most blissful.
The rest are people who know the truth. They see the ignorance in their peers, and they see the bullshit from the ruling class. They know that something has to be done – and preferably done in a civil manner. But this group is small – maybe 5% if you leave out the anarchists and the fakers – and 5% of a population is not going to change anything.
The only hope is that the 5% number gets bigger. That’s what Alex is trying to do. If you see him has a prophet, then it’s your paradigm that needs a shift.
We need to inform and educate until enough people know the truth. You get all the supporting evidence here, and you educate your friends, relatives, and everyone you come in contact with each and every day. When enough people know the truth, there will be a real change.

You bring up some very good points, I believe the most revolutionary act we can all do right now is STOP debt serfdom. STOP credit cards, STOP car payments, STOP paying to much for shelter, STOP lottery tickets/gambling, the list goes on and on how WE support the ruling elite. I have friends (two professionals) who just sold everything, got rid of all debt and are living free. You have to realize Alex’s info is biased and I don’t believe he really has the info or the ability to expose the key players in our downfall. Don’t think myself that passive resistance will do much but we will see.

But at the same time, if we stand up and say “FUCK THIS SHIT, our constitution have given us the right to bear arms SPECIFICALLY to take back our government and assure it is correctly operated, and we want to use these rights” we will be considered domestic terrorists.. After a few episodes like that, the only ones left would be the purely ignorant, and then they would have their wish – total contol over society in more ways than one.. Personally, I don’t look at those rights in the constitution as god-given and inalieanable. If they were, lawyers couldn’t gut them so thouroughly. No, they are merely socially agreed upon norms which were then codified into law. A law which immediately went about gutting them. The only true god-given, and inalienable right is the right of conquest. Not a right you have to survive to win, but one you insist on dying before it is taken away from you. You, persnoally. Just my two-cents worth.

Getting people in debt was part of the problem/plan. Debt means you owe them. When it comes to national debt they lump every working American together which isn’t fair. I do not nor never had used credit. I do not own a house or have a car payment. I use cash, do not collect any welfare/food stamps/HUD/SS/SSI/Medicaid or collect any state or federal handouts/grants. Yet I along with many like me have to pay back a trillion $ debt I had nothing to do with, and didn’t even get a vote. That’s like my neighbor getting a loan the whole town has to help pay back. After a deal like that it seems conscientously a piece of cake to take control of the internet. They take our money, our freedoms, our privacy, our voices, our land, kill our sons overseas, poison our children with Pharma, poison our water the list goes on and on and now they want to steal OUR internet like they already own it? The internet is world wide and if USA controls it That speaks volumes about the NWO coming upon us. They think they own everything well they don’t own me and NEVER will. And they will have to bust half the population for hurting feelings on the internet. They can’t take back what we already know or they would do that too. rEVOLution is inevitable.

People , people please think – there are limited number of bad guys trying to do bad things, while there are by far more number of good guys trying to do the right thing. The only missing link is the lack of coordination among the good guys. Let all the Good Guys unite and use the Internet thousand times more effectively than the bad guys can spy in it and come a time they will simply be too exhausted and stop their evil game once and for all. So please extend the use of cyber media by a zillion times more than the present useage and that is the best way out of the situation left behind by Bush & Co.

I am getting the idea the Constitution applies to citizens of the United States, when it was a country but now it is a dummy corporation and enforcement branch of the banking cartel that literally owns us through a system of pledging and registry as detailed in Maritime law. We are now persons, property and employees of USA Inc. that is the enforcement branch of the the Banksters. So the Constitution does not apply to us because our registration as “persons” or corporate chattel as detailed by Edward House via Woodrow Wilson. In short we have given up our sovereignty unwittingly but voluntarily. So there is no violation of the constitution for spying on corporate property us. We are no longer citizens of a country but employees of USA Inc. a dummy corporation to benefit the banksters.

Presumably this means that there is a trail for anyone to follow of the states misconduct which will only serve to seal their eventual conviction.

For the state to benefit from the surveillance grid they have to hold the monopoly on ‘ability’ which they clearly do not.
There are very clever normal people that can use the self same surveillance grid to watch the watchers. The elite play a dangerous game as computers and computer systems have no loyalty and do not care who or what pushes their keys as long as the desired input is received, 1 or 0.
The interview with Mr. Russo was revealing in so far as the surveillance grid has an opt out for the elite and their cronies and for anyone with the right input.
The whole exercise is incredibly naive and in my opinion doomed!
Lets not forget basic principles for the surveillance grid to work effectively there has to be an input device such as a camera, hand scanner etc. Cameras and other physical equipment can be rendered inoperable easily. As for email interception use the postal snailmail service as the only way around that is to employ half the country to open the other halfs letters read and copy and scan to database.

In his pamphlet, ‘No Treason: The Constitution of No Authority,’ attorney (one of the few good ones) Lysander Spooner wrote in 1870:
“The constitution has no inherent authority or obligation. It has no authority or obligation at all, unless as a contract between man and man. And it does not so much as even purport to be a contract between persons now existing. It purports at most, to be only a contract between persons living eighty years ago… we know, historically, that only a small portion of the people then existing were consulted on the subject, or asked, or permitted to express either their consent or dissent in any formal manner. Those people, if any, who did give their consent formally, are all dead now… and the constitution, so far as it was their contract, died with them. They had no natural power or right to make it obligatory upon their children… they did not even attempt to bind them. That is to say, the instrument does not purport to be an agreement between anybody but “the people” then existing; nor does it… assert any right, power, or disposition, on their part, to bind anybody but themselves…
The constitution itself, then, being of no authority, on what authority does our government practically rest? On what ground can those who pretend to administer it, claim the right to seize men’s property, to restrain them in their natural liberty of action, industry and trade, and to kill all those who deny their authority to dispose of men’s properties, liberties and lives at their pleasure or discretion?”
When I first read Spooner’s pamphlet it was an assault on my whole knowledge structure. It triggered a process of questioning many concepts: “Constitution” (so-called) — what does this word represent in reality? If Spooner was right, then it represented but an empty fraud. It also meant that words did not necessarily correspond with reality. There were “fraud-words” which served only to mislead. And if there is no valid “constitution,” then what does the word “country” mean? What does it really represent? Similar questions followed about “government,” “state,” “king,” “law,” etc. In the Introduction by James J. Martin to Spooner’s “No Treason” I read:
“Since late Neolithic times, men in their political capacity, have lived almost exclusively by myths [more appropriate: "fraudulent fabrications" or "murderous misrepresentations!"] And these political myths have continued to evolve, proliferate, and grow more complex and intricate, even though there has been a steady replacement of one by another over the centuries. A series of entirely theoretical constructs, sometimes mystical, usually deductive and speculative, they seek to explain the status and relationships in the community…
It is the assault upon the abstract and verbal underpinnings of this institution which draws blood, so to speak… those who attack the rationale of the game… are its most formidable adversaries.”
Spooner also attacked words and phrases like “the government,” “our country,” “the United States,” “member of congress,” “King,” “constitution of the United States,” “nations,” “the people,” “emperor,” “divine right,” “president,” “monarch,” “ambassador,” “national debt,” “senator,” “judge,” etc. He implied that these were all fraud-words to dupe the gullible. In a letter to Thomas F. Bayard, Spooner wrote:
“In practice, the constitution has been an utter fraud from the beginning. Professing to have been ‘ordained and established’ by we, the people of the United States, it has never been submitted to them, as individuals, for their voluntary acceptance… very few of them have ever read, or even seen it; or ever will read or see it. Of its legal meaning (if it can be said to have any) they really know nothing; and never did. Nor ever will know anything.”
Spooner indicated that the people who masqueraded as the so-called “government” could be more accurately described as FRAUDULENT IMPOSTERS OR A “SECRET BAND OF THIEVES, ROBBERS AND MURDERERS.”
The implications of the falsely-called “Constitution” being a fraud and a hoax are far-reaching and very difficult to confront by most:
1. In reality there never has been and there isn’t now a “country” or “nation” called the “United States of America.” (The fact that several hundred million people think of themselves as “Americans” constituting “the American nation” is at best a convenient, shared fiction, but doesn’t constitute reality.)
2. There never has been and there isn’t now a “government” of the “USA” — there have only been hucksters who masqueraded as “government” and suckers who believed them.
3. All the falsely-called “Presidents,” “Secretaries,” “Congressmen,” “Judges,” “Ambassadors,” etc. have been liars and impostors. (All these people have been — and are now — “ordinary naked humans” hallucinated by most as being exalted, when in reality they are mere liars and impostors.)
4. Spooner’s reasoning also applies to all the “American States” as well as all other pretended “countries” — all the “political systems” in the world are fraudulent hoaxes, all the “government officials” are liars and impostors — albeit unwitting.
5. In reality there never have been and there aren’t now any so-called “laws” in any of these pretended “countries.” (To regard some of the noises and scribbles that emanate from the mouths and pens of political impostors as “the law” is a stupefying and debilitating hallucination.)
6. In addition to what is now being done to expand freedom in the world, some radically different strategies need to be developed and implemented.

Sumner’s political insights can be found throughout his histories and biographies, but his most explicit political works are What Social Classes Owe to Each Other and some essays. Considering them together, it is possible to reconstruct Sumner’s political thought. This reconstruction reveals that Sumner was a first-rate diagnostician of the vices and flaws endemic to modern democracy, and that he saw with remarkable prevision how it would develop into the twentieth century.
Sumner’s critique of democracy can be summarized as follows:

Modern, industrialized, western nation-states were too geographically extensive, populous, and diverse to be truly democratic in anything but name.
* The great mass of the population in “Europe” or “America” was incapable of self-government.

Although Sumner never specified his ideal form of government, he was certainly no monarchist. He seemed to favor some sort of representative government with limited suffrage and limited government power.

Just my 2c, and it might sound simplistic, but I would just repeat the idea to try to become the change you wish to see.
The Orwellian Beast System in one form or another has been around for thousands of years. Social darwinism, in which a ruthless and corrupt few work tirelessly to enslave the masses and use them for their own pleasure like cattle is likely not going away any time soon.
While it’s great and necessary in a free society to keep each other informed (as obviously State run media works in the opposite direction) the most fruit IMo can be achieved working daily and tirelessly to create unions and partnerships within one’s own immediate environment and circle of influence that don’t rely on the Beast System.
If one doesn’t want to simply be a microchipped herd animal in a pen raised for amusement and eventual slaughter then one has to find a viable alternative.
Many are simply trapped one foot still in the Matrix and one foot out.

It’s a concerted effort to make the constitution no longer applicable by putting all the scary orwellian stuff under the heading of National Security, which the president is said to have exclusive and unreviewable control over.
You get rights if you rape a baby, but not if you annoy the powers that be. Hardly seems fair.
People seem to be preoccupied with building some sort of bottom up intellectual foundation for the political system. It may have started as a genuine good faith effort to build a government guided by what the founders considered good values, but somewhere along the line it turned into an ideology. Something to help those subjected to its whims rationalize their servitude and therefore hate themselves a little less for it.
Admiralty and Common law arguments? The government pays very little heed to the laws that it universally acknowledges. The only place you will find that Admiralty and Common law stuff discussed is on sites like this. While you people may well be absolutely right about this stuff, it doesn’t matter one bit because your arguments will be laughed out of court should you ever be foolish enough to use them. Sorry to say it, but wake up. You are only hurting yourselves.

On the surface, the recent attention to cybersecurity sounds laudable.
However, I believe it is in part meant to pave the way for passage of S.773 ( http://tinyurl.com/d8o345 ) which will allow President and Secretary of Commerce to define and re-define the “critical cyber infrastructure” and “have access to all relevant data concerning such networks without regard to any provision of law, regulation, rule, or policy restricting such access.” (Sec 14. Public-Private Clearinghouse).
Invasion of privacy.
If U.S. citizens value corporate or personal privacy, they should write your congress-person(s) and demand this bill be defeated and recognize the risks of the allure of the “cybersecurity” rhetoric.

The real constitutional crisis is that of Obama’s long-form birth certificate.
There is a very real possibility that any bill he signs is not a legally binding law. He may not be constitutionally eligible to do so.
Why would any nation want to enter into an agreement with him?
Why should any military directive be obeyed?
Why should any citizen be charged under any of his laws?
This is serious. Very very serious, yet the corporate controlled media is wearing shades on the issue.
The supreme court has proved it’s been corrupted. It refuses to hear the avalanche of cases on the matter. It claims no standing on the part of the complainants. What? No standing when every American could be affected by laws enacted by Obama’s authority. An authority he might not have.
