Death Of Free Speech: Ireland Makes Blasphemy Illegal

Irish atheists are horrified by new legislation making blasphemy illegal, and punishable by a 25,000-Euro fine. Christians of all stripes should be, too.
As part of a revision to defamation legislation, the Dail (Irish Parliament) passed legislation creating a new crime of blasphemy. This attack on free speech, debated for several months in Europe, has gone largely unnoticed in the American press.
The text of the legislation is provided at the end of this post.
How does this impact free speech? Just don’t be rude.
- Atheists can be prosecuted for saying that God is imaginary. That causes outrage.
- Pagans can be prosecuted for saying they left Christianity because God is violent and bloodthirsty, promotes genocide, and permits slavery.
- Christians can be prosecuted for saying that Allah is a moon god, or for drawing a picture of Mohammed, or for saying that Islam is a violent religion which breeds terrorists.
- Jews can be prosecuted for saying Jesus isn’t the Messiah.
Is it really THAT big a deal?
Ireland’s Blasphemy Bill not only criminalizes free speech, it also gives the police the authority to confiscate anything deemed “blasphemous”. They may enter and search any premises, with force if needed, upon “reasonable suspicion” that such materials are present.

Satirizing religion in any way, shape, or form, if it “causes outrage”, is now a prosecutable offense in Ireland. Saying anything negative about a religion, if it “causes outrage”, can now be prosecuted as a crime. Just like in Muslim countries.

The text of the legislation:
36. Publication or utterance of blasphemous matter.
(1) A person who publishes or utters blasphemous matter shall be guilty of an offence and shall be liable upon conviction on indictment to a fine not exceeding €100,000. [Amended to €25,000]
(2) For the purposes of this section, a person publishes or utters blasphemous matter if (a) he or she publishes or utters matter that is grossly abusive or insulting in relation to matters held sacred by any religion, thereby causing outrage among a substantial number of the adherents of that religion, and (b) he or she intends, by the publication or utterance of the matter concerned, to cause such outrage.
(3) It shall be a defence to proceedings for an offence under this section for the defendant to prove that a reasonable person would find genuine literary, artistic, political, scientific, or academic value in the matter to which the offence relates.
37. Seizure of copies of blasphemous statements.
(1) Where a person is convicted of an offence under section 36, the court may issue a warrant (a) authorising any member of the Garda Siochana to enter (if necessary by the use of reasonable force) at all reasonable times any premises (including a dwelling) at which he or she has reasonable grounds for believing that copies of the statement to which the offence related are to be found, and to search those premises and seize and remove all copies of the statement found therein, (b) directing the seizure and removal by any member of the Garda Siochana of all copies of the statement to which the offence related that are in the possession of any person, © specifying the manner in which copies so seized and removed shall be detained and stored by the Garda Siochana.
(2) A member of the Garda Siochana may (a) enter and search any premises, (b) seize, remove and detain any copy of a statement to which an offence under section 36 relates found therein or in the possession of any person, in accordance with a warrant under subsection (1).
(3) Upon final judgment being given in proceedings for an offence under section 36, anything seized and removed under subsection (2) shall be disposed of in accordance with such directions as the court may give upon an application by a member of the Garda Siochana in that behalf.

Under the new legislation I say the authorities and government officials need to be arrested! This new legislation is ,in itself, blasphemous! It causes outrage more than any insult to religion or ethnicity. This is obviously punishment for rejection to the Lisbon treaty and a test of loyalty by the citizens. Ireland! Fight back! Religion like politics and nationality separates people into groups. However we all belong to the human race which makes us equal when we are born. It is blasphemy to be idolized or considered deity being a mere mortal which the Pope himself is guilty of as he sits on his gold throne preaching to the poor. There’s a difference between people fighting your BULLSHIT being in public schools and in government buildings and people fighting your ability to speak or hold opinions. A school is not a church. A courthouse is not a church. You don’t have “the right” to spread the word of “god” through a secular establishment. I’m non-religious and find religion in general offensive because of the fact that without religion we’d be a more advanced, more civil society (although I’m sure you believe that morals ONLY come with subservience to your imaginary friend). If I had to bow my head and be silent in school when I was young so someone could pray I’d have spent every minute of free time I had fighting to put a stop to it. Pray on the bus, pray in your head, just don’t spout what to me amounts to hate speech in a secular environment and expect everyone to tolerate your shit.

Anonymous, If I were a student in a school I would and could pray anytime I felt like it, and if you sat beside me I would pray out loud. You would not stop me. You are offended. When did that become so important? Everyone’s offended.Tough! You offend me! I have bent over backwards for years for people like you because ,Oh you get so offended. No it just so happens that you and apparently a lot of teachers and principals don’t know about the constitution. Did you take civics? Teachers have singled out and embarrassed children for a story they have written about Christ or a picture they have drawn in art class etc. The first amendment states,
“Congress shall make no law respecting an establishment of religion, or PROHIBITING THE FREE EXERCISE THEREOF; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
That means children can assemble before the flag pole. They can say a prayer in a school and they can say a prayer before a football game. That means if the FHA can meet after hours at the school then a Bible study can meet there too because they can’t be singled out for their religious beliefs.
Any parent thta has this happen to their child at a park, school then they should call the ACLJ. Their website is ACLJ.org. Any park.library etc has to allow Bible study if they allow other groups to meet on their property.
So Coward next time why don’t you know the law before you spout off and think you do know the law.

Karen, we are still supposed to do what’s right regardless if it’s appreciated. I know it often seems unfair. But, there will be justice. You know there will be a day of reckoning. I’m not saying defending blasphemy is a great thing. But anyone can call anything blasphemy. So it is right to defend free speech, even speech we despise. God gave us free will. This law applies to Christians. Protestants can be prosecuted for claiming the Vatican is corrupt and has no divine authority. Catholics can be prosecuted for damning the souls of Protestants because they refuse the authority of the Vatican. Either scenario can (and has) caused outrage in Ireland.
Those who believe blasphemy (whatever that means) should be a punishable offense are not allowed in my foxhole or safehouse. Christians are only a plurality in this movement, not a majority. Any law of this sort, if applied to the United States, would be a direct and explicit violation of the 1st amendment. If that’s divisive, frankly my dear, I don’t give a damn.

My beliefs should be restricted by speech but your beliefs shouldn’t According to you free speech is conditional depending on a person’s belief. You think you should be able to express your opinion and force your opinion on me but you don’t think I should be able to do the same. Karen – we are not stopping your prayer. We are not asking you to renounce your God. What we are expecting is that public places be for EVERYONE – I’m not Christian, so going into a school that is supposed to be for everyone and seeing nothing but the Ten Commandments leads me to think that this school is Christian, not secular. I have nothing against Christian schools. If you want religious teachings in school, send your child to a religious institution. I don’t. I don’t want to see ANY religious affiliations in a courtroom, or politics in all honesty, because it makes it easier for people of differing religions feel discriminated against.
I am Wiccan. I respect your religious choice. All I ask is that you do the same for me. You don’t have to agree with me. I’m not asking you to. I’m asking you to be Christ-like rather than just Christian.
This law prohibits ANYONE from saying ANYTHING that ANYONE ELSE deems blasphemous. You could be prosecuted for saying that my Gods don’t exist, even though that’s what you honestly believe. I could be prosecuted for saying that I think the Bible is a fallacy. Both of us are merely speaking what we believe to be true, but we could still be jailed for it. This law is definitely wrong, and something that we ALL can get behind – regardless of religion. Christ stood up for those people who he knew were against him. I hope that his followers follow his example rather than saying “if you won’t help me I won’t help you.”

I sincerely hope enough people in Ireland are outraged at this and are doing something about it. If this specific law were enacted in the US it would certainly be the tipping point for me and many many others. Religion in general is responsible for more death than any other source throughout history and religion certainly does not need the protection of any government

Religion does account for some death, yes, but not nearly as much as is attributed to it. For example, there are satanic sacrifices where people die as a direct result of religion. But then there are the usual murders, for money and power, which the perpetrators claim religious inspiration for. Lets set it straight. Christians do not murder. Christ did not murder, and anyone following him does not murder. Anyone who murders is not following Christ, and is therefore not a Christian, even if they claim to be. I cant speak for Islam or other typically attacked religions as respecting death toll, but by and large, murder is for two reasons. Money. Power.

I can see the point of this bill was to promote a culture where assaulting another verbally or physically because of their religion would not be tolerated and I understand that this is at least a halfway decent intention, but that’s not the government’s job here or anywhere. If Ireland bans blasphemy, good for Ireland! Blasphemy, which is against God’s law, should be against civil law. Most people have been total deceived by Liberalism, which claims for man absolute freedom – even “freedom” to violate God’s law. This so-called “freedom” is in reality, license.
Liberalism of the past is the cause of our present evils. Liberals sought to be “free” from God’s law. Therefore, under many specious arguments such as the promotion of false “rights”, the Liberal managed to detach human law from its foundation – namely, God’s law. Rather than law being based on God’s will, it was to be based on “the will of the people”. Therefore, as a punishment for this evil, God will allow man – who did not want to be ruled by His eternal naw – to be ruled by a tyranical state.
We can either be ruled by the law of a God who wills only what is best for us, or by an Atheistis government who wills our damnation. The Liberals managed to loose from the former, and we are now about to be subject to the later.
The only hope is to turn back to God. And if society refuses to do so (which is almost certain), at least let us to so individually so that our eternity will not reflect what our society is about to undergo.
God help us all, especially the poor Athiests who have been led astray by these evil men.

If God exists, there can only be ONE otherwise it is an oxymoron, and there are plenty of those around us believers. This is completely ludicrous! I am a free-thinking, religious citizen of the U.S. who strongly believes in the separation of church and state. The constitution allows all people to assemble freely and to practice or abstain from any religion of his/her choice. Religion does not belong in the political arena. Although I agree that we humans need to be more tolerant of other systems of belief, criminalizing free thought is a huge mistake. The government is stripping away our freedoms slowly and insidiously.

if you really believe “in the separation of church and state,” may Yah help you. There is no such thing, never has been, and never will be. Just because some piece of paper called the Constitution (more accurately, it was the Bill of Rights) claims seperation, that don’t make it reality. Morover, if you believe in seperation along with the belief religion does not belong in the political arena, you are about as close to the point of no return as you can get. Religion is one of the most effective, if not the most effective tool of political control. Historically speaking, religion is to politics (and vice versa) what wet is to water.

Here in Canada, if you say anything that angers gays and lesbians you can be fined and/or thrown in prison for two years. If gay people want to tell you’re children anal sex is healthy and normal, then you have to let them. If Lesbians want to preach in churches that dildo’s are not sinful, just make sure one keeps them clean then you can’t argue or disagree publicly. Many preachers have already been fined for speaking out on same-sex marriages.
The day is coming when gays will have anti-homosexual-people thrown into prisons.
Since prisons are filled with gays, who will find out the person was put into jail for not agreeing with that particular lifestyle, will no doubt end up beaten up, or even raped.
Not to mention the hundreds of thousands of dollars it will coast tax-payers to keep anti-gay Canadians in jail. It will end up backfiring on the gay communites, and people will begin targeting them and the places they frequent.

I think it is a good idea. There is nothing wrong in having an intellectual discussion or criticism of religions. But what many atheists do is ridiculing, deliberately discrediting, mud slinging, using pornography description to mock religious sentiments, to attack religion wantonly and use all sorts of filth and dirt.
If we want to co-exist in a multi-cultural society it is better to have mutual respect and understanding between religions, we have to follow the policy of absolute tolerance and zero intervention in the belief systems of old and traditional religions like Hinduism, Judaism, Jainism, Buddhism, Zoroastrianism, Christianity, and Islam.
As I said highly intellectual discussion at the academic level is okay, for instance A Christian can question the Islam based hereditary laws, or why Islam allows more than one wife under extra-ordinary circumstances etc, etc.
I am a Muslim. Mr Salman Rushdie says he was born to Muslim parents.
A religion is an association, Salman Rushdie has the freedom to be a member of the Assn. of Islam or quit, no one objects to that.
But his writing a beautiful poem graphically describing the birth organ of his own mother and taking the poem to be read to a University audience is ludicrous and lunatical. Imagine if his description was that of my mother, that is the sort of insult and shame that I got from his writings. What is the real motive for this sort of literature?
There is no absolute freedom without restrictions and there is no absolute independence without responsibilities and regulations.

I believe this to be some sort of show off, ment to to cause outrage amongst the public.
Unlike the other tyranical laws we’ve seen so far emerging in the western world, this one isn’t cleverly disguised as beeing something cute and for our own good.
Instead its right in our faces. They need to know if they have desensitized us enough, so they can start forcing in the really hardcore medieval authoritarian stuff.

So Ireland is now officially scared of books? It´d be really simple to calm down the phenomena behind these bum – laws: go directly to t he papers where the bum laws are written upon and tear those papers apart.
Then propose new law – anyone who signed to these bum laws giving bums permission to enter your home to remove your posessions , looses their citizenship and cannot leave Ireland.
The citizens can in turn do anything they want against the witch – hunters and the Inquisitors.

Jack it doesn´t do so ´potentially´but deliberately.
You can´t be a nation in a country and be run by a State.
But there´s nothing wrong with the idea of a kingdom or a
Community Council.
If you are lucky enough to have a Community Council you can do anything you want but if you´re not of any use to your community then the Community Council is entitled to make a decision on whether you are to be moved to another community where you must start all over.

Blasphemy of Religion was not made to protect Judeo-Christianity or Judaism. You will never see anyone who criticizes either faith arrested and taken to jail. The purpose of the law is to stop criticism of Islam and Muslims. The United Nations passed in Binding Resolution Blasphemy of Religion (read: Islam) in June 2009. Not one UN member with Veto used their Veto to stop this legislation. This is a test law to attempt to remove Constitutional Rights and Freedoms from the majority.
Canada has Human Rights Councils that have had some success with this ideology. While it was not Blasphemy of Religion it was not much different. Hate Speech and Hate Crime have been used by HRC tribunals even though they are Constitutionally unlawful. However, that does not stop them from trying individuals on the basis of Hate Crime or Hate Speech. What makes up Hate Crime and Hate Speech is actually quite laughable. If it was not for the fact that when taken to trial the costs are so exhorbitant that most cave in to the pressure. Some like Macleans Magazine, Mark Steyn and Ezra Levant have set precedents that the HRC’s power is not inclusive over the Constitution, but it cost them hundreds of thousands of dollars. The HRC’s still do not give up even though there are groups fighting to have the HRC’s section xiii removed from their mandate. The courts unwisely have set a precedent that the HRC’s have the power, but the courts do not have power under the Constitution to give the HRC power over the Constitution. Again, that does not mean that executive government bureauocracy is going to give up without a fight. And fight these ideas we must do or the executive government will impose restrictions on freedom of speech and expression. I do hope that I have cleared up the reason for imposing Blasphemy of Religion. It is the British people, not just the Irish, who should demand that British government use their Veto on UN Blasphemy of Religion.

Just maybe it’s time for a new revolution-LETS GO AFTER THE POLITICIANS- and force them to clean the streets,privys,latrines, failing to do so should result in public executions-hell if the French could do it to the royals-we should be able to get these bastards-while they sleep.

Im literally dumbstruck that i saw a comment from a christian saying that because non christians havnt stuck up for christians rights for free speech (i mean there is some truth in that people do step on the rights of christians, i mean pray in front of me and tell me what you think of me and my sinful life weve all got that right but it is not your right to teach my kids that what your saying is 100% fact in schools)…where was i, yeah just because you think people havnt stuck up for your rights to free speech dosnt mean you shouldnt stick up for theirs, thats literally using the logic that if someone comes into your house and steals your tv that you would be completly in the clear morally if you turned around and did the exact same back to them in retaliation
look where the “eye for an eye” attitude has got Ireland in the past
