It is yet another example of the federal government running roughshod over the states.
Last month, the state of Tennessee’s General Assembly passed House Bill 1796, the “Tennessee Firearms Freedom Act,” which states that any firearms or ammunition manufactured within the state and legally owned and kept within the state by citizens are “not subject to federal law or federal regulation, including registration” due to provisions in the Second, Ninth, and Tenth Amendments to the United States Constitution.
But according to Assistant Director Carson W. Carroll of the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the U.S. Constitution is little more than a g.d. piece of paper, as George W. Bush so infamously deemed it during his reign as the decider-in-chief.
On July 16, Carroll dispatched his agency’s official response to the law passed in Tennessee — the BATFE asserts that “Federal law supersedes the Act, and all provisions of the Gun Control Act and the National Firearms Act, and their corresponding regulations, continue to apply.”
It will be interesting to see how Tennessee reacts to this official proclamation.

Tennessee should kick out the ATF agents in their state. As Mike Rivero says, the way to take down a dictator is to make him start acting like one. The feds certainly are acting like dictators.

Admendments “adjust” the Constitution and the Bill of Rights, thats why we have them. I’m almost shocked yet still unsurprised on the knowledge of Prison Planet viewers.

Could you point out which Constitutional amendment granted the federal government the authority to control guns? (Or for that matter run a health care system or a pollution-tax system?) I don’t remember that being in there.
Most likely you’re thinking not of any actual part of the Constitution, but the way in which the Supreme Court in collusion with FDR radically re-interpreted it without amendment.

Former US Marine, obviously I didn’t write this as I can spell my own name correctly. I did see that video and enjoyed it. Not a physics major, but the modeling helped along with all of the commentary. I especially enjoyed the narrative involving the actual designers who stated the buildings were designed to withstand an airplane striking the buildings at 600 mph. Airplanes of that size as well. I enjoyed those specifically because the last time that reconfag was here he provided some links to sites which I wasted my time studying. At one of those, the writer wrote the buildings were only designed to withstand impacts from planes traveling at landing speeds. Something that was totally false, as was most of the site’s information. However, related is that the experienced pilots were unable to hit the building during simulations unless they were at landing speeds. Yet, these hijackers weren’t even trusted with Cessnas. Thanks for the link. And as to the douchebag impersonating me; at least learn how to spell correctly. We have already established you are spineless and without your very own pair of balls, but to be so lazy as to be unwilling to exercize the effort to capitalize names is pathetic, as well as so stupid you can’t even spell names you are copying. I thought it was interesting too except when I said that the 4th plane might have been headed for the Capitol (just SUGGESTED mind you) I got the very rude response you see on the page. I withdrew the comment and really don’t know what this jerk’s problem was. I thought I was on his side. Yes we here in Mt. recently passed a similar law, the governor signed it . The next step will be for someone to actually man. a firearm as the feds are not happy with this develoment . Using the commerce clause against them pissed them off . I am delighted

The supreme court has ruled that the states have a right to ban guns. If a state can ban guns, it can also guarantee ownership of guns. Of course, “F” troop makes up their own laws as needed anyway.

I can’t remember, but does anyone know if Tennesee passed their 10th ammendment resolution? I got kicked out of the group after I mentioned if we weren’t successful in peaceful efforts to stop the federal encroachment we would be looking at war. I never advocated it, but instead called the threat of it a great motivator to those seeking peaceful resolution. However, that was called advocating and I was censored after a public make-me-look-good-and-not-a-tyrant comment by the dictator moderator who chastised me for advocating war and to not make any more advocations. Something that would have been impossible anyway since he blocked all comments from me. What a douche.

Unless it is specifically authorized by the Constitution the Federal Government does not have the right to supersede state law. As usual the Feral Government has it ass-backwards.
BATFE agents violating the law will be criminals and the people have the right to defend themselves against criminal, trespass or assault.

The bill that was passed by Tennessee would not require an FFL anymore, sounds like the BATfaggets are butt sore and think they are the Supreme Court. This is also a way to stomp on the Federal Reserve. If the states opened their own treasury and used silver backed currency or maybe paper would work who knows; it could get the Fed dead. There is one Federal Reserve for 50 states, how bout 50 treasuries raising the middle finger flag. That is my 2 cents.

When–not if–contentious issues reach a tipping point expect the federal government to get VERY tough, going so far, without a hint of irony, to declare a state government’s invocation of reserved powers under article 10 of the federal bill of rights as well as the relevant state constitution itself to be prima facie sedition & insurrection if not domestic terror; in other words, presuming to thwart, frustrate or stymie the federal government in any way, no matter how the federal action at issue de-grades the people of a state whose government strives to shield them from the federal outrage, will itself be deemed a high offence & citation of reserved powers, regardless their integral role in original federalism, will be exploited by regime validators to prove defendants’ criminality given the imperativeness of the federal mission against all objections, even the strong legal precedence for reserved powers.
This follows the logic of der vaterland security ministry in the incumbent administration: respectable individual citizens against whom there is no basis of rational articulable suspicion are presumed domestic terrorists because their populism, arch conservatism, libertarianism, whig liberalism, ideologic versus partizan republicanism, serious commitment to the principles of the American revolution or SOME thing constrains them to press their constitutional rights in the face of national dis-integration caused by the same federal government with a corrupt interest in pursuing policies rightly denied it per straight-forward constitutionalism. When the very act of citing, invoking or pressing civil rights against official mis-behavior is officially condemned as incipient domestic terror or definitely indicating a tendency thereto, we are intitled to assume government is heavily larded with traitors who either think we have no actual rights or who think themselves impelled to violate our ancient rights.
It is unsurprizing what an employe of the federal bureau of alcohol, tobacco, firearms & explosives thinks of the attempt of the state government of Tennessee to ensure the rights of Tennessean gun owners per the state constitution. What will be surprizing is the eventual inevitable admission by top federal figures, given their self righteousness’ plain depth & dogmatism, of their wrongness in betraying the republic–when at long last they face the stark consequences thereof! The ultimate resolution is unlikely to be pacific.

Once the feds begin receiving on the job permanent disabilites from the gun shot wounds they will most likely receive it will take a while to replace these retarded feds with more retarded fed. I think as our Depresion deepens we will see more and more state’s exerting their soveriegn rights as described in the 10th Amendment to the Constituition of the United States of America. And when the Fed’s begin to encroach on these tenth amendment rights, you will see states begin to consider their own destiny…State’s rights will be the backbone of this revolution, mark my words!

There are actually two rights granted by the 2nd Amendment. The right to keep firearms, that is the right to possess them in your home, or on your person, and the right to bare them, that is, the right to bring them forth from concealment on your person or on your body.
Any business that mandates you leave your gun before entering its property is demanding that you surrender your right to keep and bare arms.
Have you ever tried to enter a Federal building with a gun?
How about a bank?
Are they violating your 2nd Amendment rights? Of course they are!
They always say something like, “Its to protect the customers and others from the criminal element which may also try to enter the premises with guns.”
Which my reply is, “The customers and others would be more protected from the criminal element which they are so afraid of if they too were allowed guns on the premisis.”
Think of it this way, If your a criminal would you rather break into someone’s home whom you KNOW did not have any guns, or would you rather break into someone’s home whom YOU KNOW has many, many guns.

CAN’T BE REPEALED (GUN CONTROL FORBIDDEN) – Protection Against Tyrannical Government

The Dick Act of 1902 also known as the Efficiency of Militia Bill H.R. 11654, of June 28, 1902 invalidates all so-called gun-control laws. It also divides the militia into three distinct and separate entities.
** SPREAD THIS TO EVERYONE **
The three classes H.R. 11654 provides for are the organized militia, henceforth known as the National Guard of the State, Territory and District of Columbia, the unorganized militia and the regular army. The militia encompasses every able-bodied male between the ages of 18 and 45. All members of the unorganized militia have the absolute personal right and 2nd Amendment right to keep and bear arms of any type, and as many as they can afford to buy.
The Dick Act of 1902 cannot be repealed; to do so would violate bills of attainder and ex post facto laws which would be yet another gross violation of the U.S. Constitution and the Bill of Rights. The President of the United States has zero authority without violating the Constitution to call the National Guard to serve outside of their State borders.
The National Guard Militia can only be required by the National Government for limited purposes specified in the Constitution (to uphold the laws of the Union; to suppress insurrection and repel invasion). These are the only purposes for which the General Government can call upon the National Guard.

I hope Tennessee has the courage to stand on their own two feet and tell the Feds to shove it where the sun don’t shine. Federal Law DOES NOT supersede State Law in ANYTHING, PERIOD!
The Federal Government has ZERO Jurisdiction in the affect of Law in individual Nation States but unfortunately most states now believe the Feds are in control, NOT!
This kind of crap is headed our direction soon because they incrementally squeeze this shit into one State and then claim they have the power to do this in ALL STATES.

I live in TN, and quite frankly, I don’t care what the Feds OR the state have to say on the matter. Their opinion is only of passing interest to me, in that it makes it simpler to know who to aim for.

Apparently the ATF doesn’t understand that the federal law can’t supercede the Constitution, which prohibits the federal government from regulating intrastate commerce.

Good for you Tenn. Montana passed a similar law too. It’s catching on because gun owners are sick and tired of this federal bullshit. Where the hell is the NRA? Why are they so quiet? They used to speak up all the time, then Charlton Heston died and I don’t know what the heck happened to them. They were probably “infiltrated” by government schills.

I sent the” Dick Act” to my senator for his opinion no response If you are in Tenn see if you can get an attorney to research this Act, lets get the facts I will do the same. Foreign troops are going to be in the cities on the FEMA exercises that start July 27.

If that is not proof of treason, I don’t know what is! The punishment for treason is death. Taking away the family setting so they can take our kids and brainwash them, and now- begin the the big plans to make all citizens slaves of their laws and control.
They don’t care if they admit it anymore- they say it out loud knowing we will do nothing. They fear no one with the standing armies and weapons they have. They make war without declaring war, they infiltrate countries with no concern who’s lives are in the way, they take what they want and to the limit. The vote, the phone calls, the letters, the demands are moot. We have no say, we are nothing- they know and if we don’t see it by now- we are fools and cowards to stand by and decide to live as slaves instead of free.
The fox in the woods that struggle each day to find food, hunt, and be hunted, not knowing what each day will bring is more free than any of us who seek safety and hand our lives over to others or the government!!!!

I agree. Actually, alot of people have, spanning several decades, if not millenia. The real hurdle has ALWAYS been convincing those most enslaved by the system to pull the plug and just get the hell out of it, the pigs (cops) who do the dirty work of the law society, the brainwashed dead-end jobbers, etc., but you can see how successful that’s been. They’re afraid the unknown, because fear controls their actions.
Of course, there’s also the problem of the new system which will innevitably rise in its place and could potentially make our current Federal Government look like a trip to Disneyland, but I say bring it on, because after that one’s faded away, things would probably tilt more toward at least SOME balance again (although I’d probably be dead long before that happens).

Well to THEM…the Constitution IS just a ”piece of paper”, because they are TRAITORS WITH PLANS! And that Constituton stands against everything they believe in. Had our forefathers intended the constitution to BE ” just a piece of paper”, anything would have done, as long as it was written on paper. And when we discovered that we had a president, who believed it was ”just a piece of paper”, we should have tar and feathered him, and run him out of town! You’ll never get a response from any politician in TN. I think chickenshit is the correct description. Theyall have their own agenda, which doesn’t include you meddling in their corruption. The governors’ office is run by the Mrs. who only allows phil to wear his balls on certain occasions. I have gotten some response from ST. Reps., but virtually none from the “District of Criminals”.

Just my observant opinion, but I think the almighty sh*t is about to hit the fan at a state near you if this continues to rachet up like a game of chicken. It will be very interesting to see how hoards of feds will tell all these armed state citizens face to face that the Constitution is ‘merely a piece of paper and they must to turn in their weapons’ all the while staring down two 12 gauge barrels of whoopem. Some of those citizens may all of sudden be hard of hearing. And then you have kin which don’t cotton to their kin getting threatened either much less shot at by anybody for just owning a gun that their state said was ok to own but some fed said was not. Oh my. You can see the potential for some disagreements.
I hope these fed agents really believe what they’re doing is right if it gets down to that Boogiewoogie. If not and if there’s any doubt on their part, they will definitely find out they chose the wrong profession at the wrong time and the wrong place sooner or later. I would not want to be working for the BATF right now. Too risky. It would be safer fighting in Iraq or Afghanistan. At least there you wouldn’t be shooting at your own citizenry in the name of following orders. I hope they pay real well.

It is disgraceful to refer to the U.S. Constitution as a g. d. piece of paper. It is THE LAW of the land and should be valued as such. The state of Tennessee is clearly in the right and they should take the case to the U.S. Supreme Court. The United States is not a free for all. It is a nation of laws that are supposed to bring about an ordered society. But not of the NWO kind.

Remember, the Constitution mainly refers to “people”, not “citizens”. There is a difference.
People have all [natural] rights. Citizens have no rights. Citizens have only privileges. However, to keep the citizens clueless, the privileges are called “civil rights”.

Each state is actually a country. The Fed is nothing more than a corporation (i.e. a trust) complete with president, secretary, and treasurer, just like all other corporations. The Constitution prohibits the Feds from exercising jurisdiction in a state without the state legislature’s permission.

Washington DC is starting to find out how small it truly is when all the states start ignoring it. It will then become scared when it realizes it is surrounded by those same states it is pissing off. The reason it didn’t react to Montana was the fact it was so far away and is considered a “small” state. DC thought MT was an isolated incident. Tennessee has hit closer to home. TN demonstrated it is not an isolated incident. If it can’t intimidate TN, then it may lose the whole south. Go Vols! I loved it when you beat Miami in football and now I think I love you more. All those advising in DC about the country live in DC. DC is out of touch with our country and will remain so considering who is advising them.

The feds are in enough trouble with unexposed ‘books’ in the United States. Alot of stuff is coming out now. When you fight transparency something’s wrong. America is getting a whiff of nazism – and it didn’t take but an inch to connect interesting dots. WWII also had alot to do with population control (wars). 9/11 blew the lid off history. Whomever put together those blueprints became a toy in God’s hands. The point here is the NWO junkies have been attempting this for centuries. However, they moved in haste this time. The ‘appointed’ Hitler era wasn’t that long ago. All a big crap shoot. How frustrated the devil must be not knowing the Lord’s dates. Enormous amounts of money was stolen from the United States and its people. We all know that now. It’s going to come down to the States vs the crookedness of the feds and the underground working through them. As far as Tennessee is concerned (I lived there), they’ll use the response as paper to roll their tobacco in and smoke it with a beer. You’re not going to be able to strip a southern man of his southern dignity without a hellish fight. They learned alot from the civil war. To be honest with you, I wouldn’t be surprised if they’re already geared up. These are quite embittered people over what the feds once did by stealing their lands. The federal government and its horde of huge bureaucracies and bureaucrats is a far larger threat to our freedoms than all foreign threats combined.
Some of the far-seeing Founders wrote what We, the People must do to prevent tyranny but, the feds out of fear enacted statutes to defend the elite’s status quo.
And that is what the federal government has become, owned and operated by an elite class that is also engaged in open class warfare against the non-elite 95 percent or more of American citizens.
