(NaturalNews) A California appeals court has ruled that homeschooling of children is illegal unless their parents have teaching credentials from the state.
“California is now on the path to being the only state to deny the vast majority of homeschooling parents their fundamental right to teach their own children at home,” said Michael Smith, president of the Home School Legal Defense Association.
The court overturned a lower court’s finding that homeschooling did not constitute a violation of child welfare laws.

“California courts have held that … parents do not have a constitutional right to homeschool their children,” Justice H. Walter Croskey said.
The decision stunned parents of the state’s roughly 166,000 homeschooled children. While the court claimed that it was merely clarifying an existing law and not making a new one, the decision leaves the parents of homeschooled children at risk of arrest and criminal prosecution.
“At first, there was a sense of, ‘No way,’ ” homeschool parent Loren Mavromati said. “Then there was a little bit of fear. I think it has moved now into indignation.”
Parents’ reasons for homeschooling their children range from religious beliefs to dissatisfaction with the education received at public or private schools. But according to the court, all California children between the ages of 6 and 18 must attend either a full-time public or private school or be taught by a tutor credentialed for their specific grade level.
“A primary purpose of the educational system is to train school children in good citizenship, patriotism and loyalty to the state and the nation,” Croskey wrote.
California’s largest teachers union welcomed the decision as did the Children’s Law Center of Los Angeles.
According to the law center’s executive director, Leslie Heimov, children should not be educated at home, because they need to be “in a place daily where they would be observed by people who had a duty to ensure their ongoing safety.”

It is my responsibility to teach my children right from wrong not the state.
If I do not teach them, the state fines me as a parent.
Most public schools are just day care centers so both parents can go to work.

Croskey’s statement that the primary purpose for the “system” is to train school children in good citizenship, patriotism and loyalty to the state and the nation is one of the scariest statements I have read to date!! The educational system was established to train our children how to read, write and do arithmetic, not have fascist propaganda pumped into their young brains!!! The Russian’s and Nazi’s employed this very method to produce a brainwashed citizenry, to take away all authority of the parents and is a BLATANT method of mind control and propaganda. This is NOT a communist nation YET! The outrage I feel right now is beyond comprehension! WE MUST STAND UP AGAINST THIS TYRANNY!! Our children are NOT the property of the state! This is about the money. Every child that is not in school, the state does not receive badly needed money for the school system. 166,000 more children in school would add to California’s wallet. Not much but it all helps. These laws are created to take your rights away to teach your own children for the money.

Actually it is a SAVINGS to the state, because people who home school their kids still pay the same taxes as everyone else. Hell, I just had my first kid (at age 38) but I had to pay school taxes (’Mello Roos’) for schools even tho I didn’t have any just because I owned a home. Now that I have a child I pay LESS taxes. Talk about an upside down system!

Is the right to school children given to the State by the U.S. or California Constitutions? And if not, how did “it” get it? If it did not, it’s retained by the people, how can a court justify such a ruling?

CPS stole my daughter’s son and adopted him to some yuppie couple because they did not like the father of the baby, who does not live with my daughter, has not lived with her, and only visited her. The judge and one of the attornies is dead, and I think the whole damn county (ELDORADO) is being run on the judicial and legal system. They are also making her pay for child support. I hope those on the county side lose their jobs, or for that matter, I think they should be doing time in prison!

Can California afford to educate another 166,000 + students? Talk about people control, the remarks by the judge and the law system border on what I would think would come out of a communist dictator’s mouth. I think California law should be challenged at this point and the judge by “de-throned” I would bet we haven’t heard the end of this, and I think that Scharznegger should be tossed too.

What everyone fails to realize is that parents are really guardians of their “State” owned children. The ownership of children passes to the government when they sign the birth certificate and social security paperwork.

Well, if California does it. Won’t be long and the rest of USA will follow.Words my father taught me at home. I see the only negative in it is the fact they have lower social skills. Though I gained most of mine during college. So, I dont know. I struggled in college after attending public school and so did my sister that sells real estate now full-time. She still makes money in this market. Anyways, I remember being in public school and how teachers say we had no freedom as students. Interesting… Actually, it’s a lie to control the students. Though I do support the voucher system but I didnt leave my high school because I was involved in school activities that I did not want to change. Otherwise, I would have packed up. Now that school is have 800k short fall so it might be absorbed in bigger city school system. Which has even more problems. Well, I guess the 20K jobs will always have people fighting for them since we will be uneducated more and more every year.

Homeschoolers don’t have “lower social skills.” In fact, their social development is superior to their public schooled counterparts. The reason is as follows…In public (or private) school children are segregated based on age and only develop comfort in relating to people of an identical age group. If you think back I’m sure that you’ll remember how “different” kids only a few grades up or down seemed.
Homeschooled kids, despite what is commonly believed, have a very large social network that includes all ages and thus; they are as comfortable watching over very young children as they are with kids their own age as they are carrying on a conversation with an adult

Justice Croskey is incorrect, the parents in California DO have a right to homeschool their children, they are just going to have to use diploma’d, credentialled teachers to do it. That way the students won’t be brainwashed with cretinism, that the earth is 12,000 years old, that there is only one true religeon, etc. They might be able to compete intellectually in the world instead of becoming chattle.

Well I think California missed the mark in their decision. Many people choose homeschooling because of the poor standards and busy work at public schools and because they can’t afford to send their children to private schools. Personally I think that many private schools are just as bad. This decision is completely stupid, because many private schools allow people without the teacher certification to teach.
I find it insulting that the court in California has declared that when I am done getting my M.A. that I still can’t teach my children. Even though research shows that Teachers (B.S.E., M.S.E. & Ph.D E’s) are the worst as far as picking up the non-verbal messages from children; heck I spent a good deal of study on this very fact.
Personally I plan on home schooling any children of mine for three reasons. 1.) I was placed in a learning disabled class at an early age and kept there until a temporary teacher came in and demanded I be re-tested and placed in a regular class. I was doing work that was more advanced than the regular class, and the school was keeping me there for the money. 2.) There is too much emphasis on “feel good” education, and busy work; not enough on fundamentals. 3.) Because I can give my own children a more well rounded education than the public school system can. I can talor their education to things that interest them, while at the same time keeping to the standards.
In 4th grade I didn’t care about the childrens books my class was reading, but I enjoyed reading random entries in my encyclopedia Brittanica, reading my collection of Time Life books; and reading my mother’s old college Physics textbook. I’m not even saying I was smart, because I personally consider myself average; I am just saying that the public school system failed me by keeping me in a learning disabled class for so long just because the fat check from the government was so tempting to them.

Not surprising that the state would want to force people to be “loyal” to it, and to do so starting from a very early age. Also, the consitution is to there to restrict the government, not grant privileges to the people. All forms of actions not specifically granted to the government are therefore prohibited to the government. I don’t know of any part of the constitution that gives the government control over what can and cannot be taught to children.

California schools are rated 49th place in the nation last I heard… which may be one of the reasons why people homeschool there! Having lived there, the schools do suck. I hope the homeschoolers out there put up a huge fight!

After getting some info from a friend, I looked into this further, and this article is erroneous. A amended judgment was entered in August, which reverses the ban on uncredentialed homeschooling. It can be found at:

IMO, this is a very weak decision, which specifically argues the State’s obligation to provide for the safety of children, an obligation which is, of course, overlooked whenever convenient, but which provides justifications for advancing the “State’s” agendas of control.

There is absolutely nothing in these reasons that even infer a typical education as defined by the majority of Americans. Rather, these reasons adamantly DENY education and instead promote an idealogy system where the “state” IS and ALWAYS WILL BE the ultimate power WITHOUT QUESTION.

As for people who have a “DUTY to ensure it”, its not my duty, its our desire to ensure our childs safety, more than willing to die for them….not sure when I have seen a teacher with that kind of commitment to a student…

This is obviously an attempt to obtain loyalty of the children to the Nation instead of their family unit. There is no better time then right now for the Parents of the State of California to Stand up against this injustice. If that means Going against the LAW then so be it. You have a right to raise your children and teach them how you see fit. Not the other way around. They are not your masters. Make a movement, Organize all the known home schooled parents and March right down in there faces till the realize that some of us “sheeple” actually do think for ourselves and will make a stand for what is right.

Homeschooling in California is NOT illegal. Homeschooling in California WITHOUT A LICENSE TO DO SO is illegal…as it should be. There are plenty of stupid children who grow up to be stupid adults and, if allowed to homeschool their own children, would just continue the cycle of stupidity. Then, at some future point, the world is too stupid and there aren’t enough doctors, etc. People are ok with teachers needing a degree to teach, but not parents?

The decision ensures that the parents are competent enough to prepare their children for possible higher education. Would you want to drive on a road where drivers don’t have to demonstrate a minimal competency to operate a possibly deadly automobile? Would you mind your surgery being performed by an unlicensed physician? Why not?
THE BILL/DECISION DOES NOT (DOES NOT!!) PREVENT PARENTS FROM HOMESCHOOLING THEIR CHILDREN. NO NO NO!!! This is outdated and erroneous reporting! No dates provided, no indication as to which California court allegedly made this ruling, NOTHING to substantiate this!
Per the Home School Legal Defense Association, there is NO such new ruling, and homeschooling remains LEGAL in California.
I believe the Natural News reporter simply pulled up outdated information and printed this story without checking (or providing!) any facts. I find both the original reporter and Prison Plant irresponsible for spreading false information.
If, indeed, this is a NEW ruling? Provide the reference to back it up. Otherwise, a retraction is in order.

That’s what I’ve been saying since I was sixteen though with far less articulation. When subjects are broken apart and the reasons for the subject matter are not taught but simply the tools given and various applications suggested an individual must somehow radically formulate the ability to move one contruct into another contruct and determine the applicable ability to process and use the abstract tool, such as various forms of mathmatics, to any application not presented to the person. When I was taught philosphy and understood where and why math came about about I was able to use the tool of math to describe various processes not taught to me orginally in math. The same goes for the general subject of science. Then when critical(which does not mean negative thinking towards a subject but to investigate the meaning of presented concepts), thinking occurs the indivdual will in fact learn, understand and comprehend what it is that is being presented to them.
This tends to occur outside of the educational system(for the most part), and occurs by individual exploration and self-taught people.
If you want to truly free your mind read critically as much as you can. Read books that challenge your ideals and beliefs. Become uncomfortable with what you are reading and if you don’t like it don’t dismiss the subject out of hand but find out what the subject is claiming and why that can not be.

You all think if something is outdated, who knows maybe it is. However this does not mean that they have tried are even trying now to control are children. I left this out from my last post. I didn’t write this, but it is relevant. and fairly close to my own thoughts. I don’t think he or she was referring to the 9/11 truthers, do you? Draw your own reality as you will, but don’t get lost in the rabbit hole, it’s very deep.
We are not really free, my friends, and as long as the ignorant masses are the majority, we will never be. When barely 50% of the people vote, and when 80% of those people vote based on “hot issues” that are entirely irrelevant to the true problems that plague the world (i.e. the religious affiliation of the candidate), who do you really think is in control? It is the people who own the propaganda machines such as News Corp who are in control, because they control your reality. They control your reality because you get your reality from their television programs, their music, their news. They brainwashed you to think that their fucking non-objectively based money system is the end all to existence and is the only system that can work. While I do sympathize with a parents’ right to raise their children as they wish, I do have to say that I agree with the court’s ruling in this instance. Even the best intentioned parent may miss the mark in the formal education of their kids. They don’t know what they don’t know and may omit crucial elementary skills necessary for a child’s preparation, if they so choose, for latter higher education. There’s one mother I know who home schools who is a functional illiterate – a case of the blind leading the blind.

He’s forced to be apathetic when he has to look away from kids being beat up, or when teachers are distracted by their cell phones and leave classrooms unattended. My son did college math in 7th grade, can public school compete with that? These comments normally come from people who are disassociated from the day to day. I however, am there EVERYDAY for my son!

“In a 3-0 decision the California Court of Appeal for the Second Appellate District reversed its earlier ruling which would have required homeschoolers to be certified teachers in order to homeschool in California. “This is a great victory for homeschool freedom,” said Michael Farris, one of the team of attorneys who argued the case before the court and Chairman of HSLDA.”

You’re right. This is an out of date story that some alternative newswire released again for some reason. The ruling being referred to was reversed in August thanks to the help of, among others, the HSLDA.
Alex, you’re news is very reliable but your staff needs to fact check this stuff before they post it. Leaving something like this up puts your credibility at risk. It should really be taken down.

Obviously this is designed to prevent critical thinkers. The system needs sheep, not intelligent, logical, concise thinkers.
In numbers, home schooled children are a minority among those being shuttled through elementary, middle and high schools. However, when the Home Schoolers are in competition with the products of public schools, they leave them in the dust. The headlines tell the story. Put them in a spelling or geography bee and the home schooled child usually takes top honors. It’s actually news when they do not!
Home schooled students in the US score 15 to 30 percentile points, on average, above their school peers whether the subject is reading, writing, mathematics, science or social studies. The mediocre science scores of public school students were front-page news in January 08. In May, the news that majority of US high school seniors had a practically no grasp of their nation’s history was also on the front pages. Historians and education professionals called the scores “abysmal.” Bad as the scores were, they have shown no improvement since 1994! But Tax revenue for schools has increased 72% since the 80’s.
