Jury acquits cop in Yonkers body-slam case

WHITE PLAINS – A Yonkers cop accused of brutalizing a home health aide inside a city restaurant was acquitted this afternoon of violating the woman’s civil rights.

The jury of eight men and four women reached its verdict in the case of Wayne Simoes after just over five hours of deliberations in U.S. District Court in White Plains.

Simoes let out a gasp and began crying when the jury forewoman said ‘Not guilty’ to the single charge. There were audible gasps from several of the 35 Yonkers cops who were there supporting him, with some exclaiming ‘Amen’. Moments later in the hallway, they burst into applause when Simoes emerged from the courtroom holding hands with his wife.

Simoes, 39, was accused of body-slamming Irma Marquez, 44, to the floor of LaFonda Restaurant on March 3, 2007.

The case revolved around a surveillance video from the restaurant that appears to show the nine-year veteran of the Yonkers police department grab Marquez from behind, lift her up and slam her to the tile floor of the restaurant on Palisade Avenue.
