Libertarian Talk Radio Activist Jailed For 100 Days For Having A Couch In His Yard
Judge uses host as an example of what happens when you defy the state

A Libertarian radio host and political activist has been sentenced to 100 days in prison for refusing to remove a couch from his back yard.
Furthermore, the trial was held behind closed doors after the judge ordered proceedings moved to a private room away from spectators. The reason? The defendant took a full six seconds to sit down.
Ian “Freeman” Bernard, presenter of the nationally syndicated libertarian show Free Talk Live, was taken into custody and received a thirty day jail term for contempt of court last Friday.
When details of the closed hearing later emerged, Freeman had received another two thirty day sentences and a further ten day term for refusing to pay a fine and remove the couch in his yard.
In the video below, note how Freeman begins to sit down along with everyone else in the room, but as the judge calls his name he pauses and seems confused about whether he is supposed to stand to attention or sit down.

The original charge came about earlier this year when a housing inspector visited Freeman’s property in Keene, New Hampshire, following up a complaint, and cited him for having a couch in the yard.
Freeman managed to capture the incident on camera:
Freeman questioned the charge and agreed to remove the offending piece of furniture as long as he could speak with the person that made the complaint. This request was refused and the matter went to trial.
The Lew Rockwell Blog notes that the trial was used as a showpiece to send a message to activists like Freeman and his supporters.
There is a backstory to all of this. The local despots have been keeping a close eye on the activists, no doubt reading the web forums and keeping informed of their plans for peaceful noncompliance and civil disobedience. Thus, this entire court appearance was planned and executed swiftly.
Local activists did recently make some headway into getting the court to allow the panning of video cameras in the court. As a listener of the show, I believe that another reason why Bernard was moved to an alternate courtroom was to prevent video of this from getting out.
Also note that in the video, when the courtroom is ordered to all rise, the bailiff takes a long look at everyone else to make sure they are complying with the order. This is because everyone in attendance was threatened with arrest beforehand should they defy the judge as a form of protest.
The Free Keene blog, which bills itself as an outlet for “liberty minded activists”, has more on this.
“It was oppressive,” said Dale Everett, 40, of Keene. “They had a notice posted obviously targeting us, liberty activists, saying that anyone who didn’t stand for the judge would be ’subject to sanction.’ So I left. I wasn’t prepared to get arrested today.”
Another resident commented that the courtroom at Freeman’s trial was crammed with police “to try and outnumber the liberty activists.”
Freeman has clearly been used as an example of the treatment you should expect should you stand up for your own personal liberty and attempt to publicly expose any possible violations made upon it by state authorities.
Freeman’s show runs on 43 states across the country and will continue to air while he serves jail time.

Which leaves the question, what state is the couch in that the thing would be labeled as garbage? Did they contact this person once for remedying the situation before going to actual court? If the ticket is the first remedying or announcement to the property owner, then in all likelihood it is an over reaction. Whoever the judge is think’s he can be a dick after he tells soandso in the video to sit angrily, especially after both have just wasted the court and the people’s time. As soandso tries to clarify the statement as his name is read, he comes to attention and is promptly treated as a non-citizen by the judge who is the servant of the citizenry, not vice versa. I would file a motion with the state board to have this judge brought up on charges.

It’s also sad to see what has become of American law enforcement. The whole notion of “public servant” has entirely evaporated, and what is left in the pot needs to be thrown out. That kangaroo court clip is frightening, alarming and maddening. The only real man in the room is the one in handcuffs, as he is the only one who even attempted to stand up for himself. Those silly court cops are pathetic and despicable. By commission of their own acts, the time in the sun for their silly little club will be short.

Humiliation is a key method used by the demons. Target the outspoken individuals. Demand that the person is constantly forced to humble him/herself over completely trivial issues. Wait for the person to crack, strike out, or paint him/herself into a corner over a fight that no-one else will understand or care about.
Those that are not taken out by this method, know the tricks of the state, and how to bend with the wind. However, their very ‘flexibility’ is then used by the agents of the state to point out their ‘hypocrisy’ to their followers.
It gets worse. The state uses long-term ‘deep’ agents within the anti-state communities as ‘false’ martyrs- individuals that will serve minor prison time over some act of protest, in order to gain command and control positions within the movement.
Mr. Bernard felt (rightlty but foolishly) that he was drawing a line in the sand, because otherwise his enemies would never stop with this type of petty persecution. However, if you gain no effective local support, they will always be able to cut the legs from under you. This isn’t just a battle to fight, but it must be a battle to win. If principles of justice WERE being upheld, there’d be no need to fight anyway. And if these principles are not being upheld, when they get to drag you to their battlefield (the courts), their advantage is almost unbeatable.
BTW, the zionist creation of highly localised rules of behaviour (allowing your own choices to be put under the microscope by your neighbours) is a very clever perversion of the concept of ‘democracy’. I have never understood why the ‘land of the free’ has always also seemed to be ‘the land of mob rule’. ‘Community standard’ ALWAYS ALWAYS ALWAYS means living under the jack-boot of the ‘alphas’ that control that community, be those ‘alphas’ the leaders of the local religious organisation, mobsters, or some political or social movement. In truth you either have ‘live and let live’ or you have hell.

While our failed justice system was concentrating on one mans harmless couch in his OWN YARD, i wonder how many rapes robberies and murders (you know REAL crimes) were committed.

hmmm, I would love to know more on the panel and Judge. Is anyone posting who they are and what their record is as far as letting rape suspects go or other types of true scumbags? THis kid that got locked up looked like he froze out of fear from the mans voice more so than not obaying an order. I hope he has a good lawyer and takes this further.

Great news, Ian is now free! Seems like the government made the move seeing what kind of backlash they were getting. Hopefully this will spur other people to stand up against the system.
This event really shows the power of the Free State Project and standing up to tyranny in numbers. You can believe if the same thing happened back when Ian was in Florida, Ian he would still be sitting in a jail cell and nobody would know/care. I think this is a HUGE win for liberty and that it will encourage more people to sign up and move.

Try calling the cops when a real crime is committed (theft, assault, drug dealers in your neighborhood, etc).. and the pigs treat you like YOU’RE the criminal. I always tell people the last person I’ll ever call when a crime is committed is a cop. People screw us out of money all day long at work with bad checks and NOTHING happens to them! I think we’re all sick of the way our system DOESN’T work.

Sunday morning 6:00am Nov 16,2008 my neighbor’s dog was barking at someone
outside. I woke up to see what was all the excitement to see two men getting inside
my service van. I walked up to the two men and asked what the hell is going on.
It was two cops in the dark searching my service van for drugs with a drug sniffing dog,
and flashlights.
They said that they’re dog could smell drugs so they decided to search the van.
I have been clean and sober now for 18 years. They found nothing of course,
and left. Then I went back to bed and couldn’t go back to sleep.
I’m more afraid of the cops than I am the robbers.

I had a run-in with an inspector earlier this year….he had actually been called to our neighbor’s house by his former tenant because, frankly, that house was practically falling down (unrentable condition) and refused to give the renter his deposit back….yup, it was a revenge call.
We had some winter damage to one side of our house, and had already planned on fixing it as soon as it was warm enough for the paint to properly adhere (read the can…it can’t be done when its too cold, or raining, or icy). Even after explaining that to the idiot, we still got the official threat letter…DO IT OR GET FINED, AND DO IT IN OUR TIMELINE!!!!
The funny thing is, nearly all of my neighbors were as mad as we were that the city targeted us for a tiny amount of damage at the same time as the absentee crap lord. They knew we keep up on repairs better than anyone else on the block. Would the city care? I doubt it.

What Law? What Law in New Hampshire tells a person where on their own property they can have their furniture? What about in the garage? Attic?

You know, if they had no probable cause for being there doing the search you could probably sue them. Technically they shouldn’t have been on your property unless there was a complaint of some sort. So the real question is, why were they there with a dog in the first place?

I’m sure any inventive person can come up with less obvious ways of showing contempt for petty officials. Most hide their residences from public records. But, ALL of them love private parking spaces at the place of work. Locate that spot, identify the vehicle in it and follow them home some evening. Leave it up to you as to what should happen next.

Ian “Freeman” Bernard was released Monday morning after spending the weekend in jail. He has to keep himself out of trouble for he next 90 days or risk being incarcerated for the remainder of his sentence. As part of the agreement for the release, he is going to remove the couch.

I have an old red third – row seat from my since junked 79 suburban.

The legal system in America is completely corrupt and everyone knows it. DEA-FBI-ATF-DHLS-Sheriffs-Police Officers everyone knows. The best thing to do in these times is to keep your name out of their databases not volunteer in the form of a protest. Protests get very little accomplished because for the most part your preaching to the quire. The quire being everyone and anyone who knows or suspects that many of the laws are corrupt, unjust and unconstitutional. At the end of his weekend in jail. Ian temporarily gave up his right to having furniture on his lawn. I hope the free stater’s will turn NH around because NH’s Police are operating as a military force. Or as the Vermonters, Mainers, and Massholes say. I live in my state and shop in tax free NH. That’s about all NH is good for. NH has e a coast line thats like 30 miles or something ridiculously short. Their State Quarter Attraction (The Old Man On The Mountain) no longer exists.

Let us all take our couches down to the courthouse and have a sit in. When we are finished we can walk off and “donate” the couches to our respective counties. Thats probably all they wanted in this case anyway was to sieze a couch without paying for it.

I know this is off topic but to all complaining about flash ads – get up off your couch and install and use firefox + noscript to block the ads.
It’s simple and effective and very easy to use.
The first think you may want to do is block EVERYTHING from google !

It’s so fascist that people are expected to stand up when a judge enters the courtroom, address the official as “your honor,” not wear hats in court, etc. Who do they think they are, gods? And what kind of judicial system is it that needs to enforce such petty tyrannical rules and quash any perceived disrespect of its own seriousness or questioning of its legitimacy? Certainly not the kind of system that people living in a free country would have!
