PELOSI: Buy a $15,000 Policy or Go to Jail

Today, Ranking Member of the House Ways and Means Committee Dave Camp (R-MI) released a letter from the non-partisan Joint Committee on Taxation (JCT) confirming that the failure to comply with the individual mandate to buy health insurance contained in the Pelosi health care bill (H.R. 3962, as amended) could land people in jail. The JCT letter makes clear that Americans who do not maintain “acceptable health insurance coverage” and who choose not to pay the bill’s new individual mandate tax (generally 2.5% of income), are subject to numerous civil and criminal penalties, including criminal fines of up to $250,000 and imprisonment of up to five years.
In response to the JCT letter, Camp said: “This is the ultimate example of the Democrats’ command-and-control style of governing – buy what we tell you or go to jail. It is outrageous and it should be stopped immediately.”
Key excerpts from the JCT letter appear below:
“H.R. 3962 provides that an individual (or a husband and wife in the case of a joint return) who does not, at any time during the taxable year, maintain acceptable health insurance coverage for himself or herself and each of his or her qualifying children is subject to an additional tax.” [page 1]

“If the government determines that the taxpayer’s unpaid tax liability results from willful behavior, the following penalties could apply…” [page 2]

“Criminal penalties
Prosecution is authorized under the Code for a variety of offenses. Depending on the level of the noncompliance, the following penalties could apply to an individual:
• Section 7203 – misdemeanor willful failure to pay is punishable by a fine of up to $25,000 and/or imprisonment of up to one year.
• Section 7201 – felony willful evasion is punishable by a fine of up to $250,000 and/or imprisonment of up to five years.” [page 3]
When confronted with this same issue during its consideration of a similar individual mandate tax, the Senate Finance Committee worked on a bipartisan basis to include language in its bill that shielded Americans from civil and criminal penalties. The Pelosi bill, however, contains no similar language protecting American citizens from civil and criminal tax penalties that could include a $250,000 fine and five years in jail.
“The Senate Finance Committee had the good sense to eliminate the extreme penalty of incarceration. Speaker Pelosi’s decision to leave in the jail time provision is a threat to every family who cannot afford the $15,000 premium her plan creates. Fortunately, Republicans have an alternative that will lower health insurance costs without raising taxes or cutting Medicare,” said Camp.
According to the Congressional Budget Office the lowest cost family non-group plan under the Speaker’s bill would cost $15,000 in 2016.

Great post. I’m always educating people on the power of the jury. Jury nullification is what’s all about and not even a judge can override it.
A perfect example is of a man who was accused of stealing a horse and when the jury deliberated they came back and said the man was NOT GUILTY if he returns the horse.
The judge not happy sent the jury back to deliberate until they came out with a proper verdict. They came back and said. Ok we find the defendant NOT GUILTY and he can keep the horse.
This is the power of the jury.

It’s not unconstitutional. Congress always has had the authority to legislate exclusively for their territory (DC).

That figure would be in 2016 after considerable inflation. It is also for an entire family (not sure if they mean 4 people, maybe 6?). It would also be the highest estimated cost of the required plan, some locations (NY city, for example) will have higher rates than others. So something like $2500 per person annually in the most expensive location.
Still, even if it was only $1. That is an overstepping of congress. They have no right to force any of us to buy services.

Basic insurance for 1 person is not $2500 per year. In Texas for a healthy male for basic insurance is $400 per month. I know because I just shopped for it.
The bill says you have to get insurance for everyone in the family. I challenge anyone to find even basic health insurance for less than $1000 per month for a family of 4 anywhere in the country.
Health insurance is becoming the largest expense in most families in Amerika and we have one of the worse health care in the western world. Another success of private enterprise. LOL

The health care insurance rate they propose is 2.5% of earnings. Minim wage jobs range between $5.15 (Wyoming) and $8.40 (Oregon). Assuming a 40-hour week for 52 weeks/year, that is only $10712 to $17472 salary, with That would mean that medical insurance would range from $260/year to $436.8/year or $20 to $36 each month.
That would just about cover a six monthly dental clean checkup.

That 2.5% is the fine and not health insurance from the government. You pay a 2.5% fine for not purchasing your own insurance and going without health insurance. You end up paying $36 month for absolutely nothing in return. Just be sure you take as many of them out as you can before you go. Healthcare sucks in jail too, but you’ll only have to slave 8 hours a day in the kitchen or laundry to get your clothes, bed, cable, food, water, weight room, dental and medical care. You can also use the state’s resources to sue everyone in the system that you feel has wronged you. True you won’t win, but it keeps the fees adding up. At least you won’t be paying all of your own taxes to treat and coddle illegals, send them to college free, and still live like a poor rat slave without a bed because you live in a tent.

They won;t find it easy to climb over my fence. They can try if they want to, but I would suggest wearing a 2 inch thick pair of gloves, and that probably wouldn’t even protect their hands. As far as climbing over…they would need a ladder to reach the top. There is a tiny door, like a window, which we can open and look out of to see who is there. And that serves only until I install my security camaras. It looks like something from the 1800’s, probably. The gate is gigantic, and has a steel bar which slides into a lock, on the inside of the gate, none on the outside. In addition, I have 4 watchdogs. One of them looks like it eats people for breakfast. They wont be able to see them, they will just hear them. I have a helper/security guard living on premises, who is armed at all times. Usually he doesn’t even need weapons. In the house, there are also weapons. Now I have to put up my signs.
I dont like to be surprised by unwanted guests.

this cant be real, it cant it cant!!! ive paid for all of my familys health care, and in the last 16 years ive paid less than $8000 no insurance. so where can i find an insurance plan for a family of 4 for under $500 a year? nowhere, and i dont want one. the best i found was $4500 a year. thats $72.000 16 years, thats 9 times the cost i had to pay, equivalant to half of a home.

We already have wage garnishments. The company garnishes your wages and pays the IRS directly the income taxes as well as SS and medicare tax for you.

Art I, Sect 8, clause says: “To regulate commerce with foreign nations, and among the several states…” Commerce is “Trading or buying and selling of goods.” To regulate means: “To adjust or direct by means of rules and regulations; to put in good order.” That authority was placed in the Constitution to allow Congress to act as an umpire between the states a they were all creating tariffs between each other that was inhibiting the free flow of trade. The ability to regulate commerce among (between) the states in no way authorizes the vast majority of regulation that the federal government has unconstitutionally usurped – especially that of taking over our health care. Anyone elected representative voting outside of their Constitutional authority, and in violation of their sworn oath before God, should be replaced at the next election!

Promote and mandate are words with entirely different meanings. There are many things that the government OFFERS, such as medicad. These programs are offered to promote the general welfare and are not forced upon the people, enrollment is optional. Other programs are MANDATED, like Social Security. Payments into this dying program are forcibly removed from my paycheck by my employer. If I die before age 65, then all the money that I have paid in is lost. If S.S. goes belly up have again lost out, I have no choice in the matter. Was the Preamble to the Constitution used to justify Social Security?
Pelosi knows that this is a conplete power grab and she feels like the LOBBYISTS have been paid enough to pay her the FEE needed to SELL-Out the American People.

The point I shoulda made clearer which regards this article is- Since this Obama/Pelosi Care bill would make you pay for insurance (no one, at least not a sovereign, can be made to contract into anything against their will) and bases it on your “income” (’income’ as defined by IRS Code is really only CORPORATE profit), then the reason you sheeple will have to go along with the healthcare law is cuz you ‘re already suckered into the corporate personhood status in the first place as well as the notion that your pay from your job can be taxed ! (wages=property which can’t lawfully be taxed from a sovereign individual/non-corporate personhood)

And that’s why the pittance that you earn is taxed to the bloody hilt, with road taxes, taxes on land and property, taxes on the things that you buy! It’s not to help run the government, the fact that the US is in hock to China proves this, but it is to limit your aspirations so that you cannot use that which you earn to better the position of you or your family. THE ELITE HATE COMPETITION. And that is why this bill will pass, its just another way for them to hold you by the balls.

So, will Pelosi and Obama provide jobs for people who lost their jobs, homes and sanity and loveones due to the mistakes of the government Fannie Mae, Countrywide, Angelo Mozilo, LENDERS, bANK OF aMERICA, cHASEand others including consumers that cause this recession? How about people like ME who has medical insurance AND FAITHFULLY PAYING MY MONTHLY PREMIUMS OF $292.50 SINCE 2005 TO Kaiser Permanente but Kaiser Permanente cancelled my coverage due to cataracts on both eyes, can hardly see now with cloudy and blurry vision, due to asthma, GERD, Osteoporosis. Will they sell the insurance to me or they will also denied me coverage like KAISER PERMANTE DID TO ME. I can no longer afford to pay anyway because my 2002 car broke down so instead of having it repair I bought a new car, so now I don’t have money to pay even if they offer me to pay that amount.
