S.787 Clean Water Restoration Act (CWRA)
Hope many of you had a chance to watch democracy in action. In a mere one hour and seventeen minutes the EPW sailed through the CWRA S.787 (actually a slightly modified alternative amendment worked out yesterday by Baucus-Klobuchar-Boxer.) The Baucus “compromise” was largely window dressing, maintaining the existing CWA exemptions for some agricultural activities in the new CWRA. This was to lure farmers into supporting the CWRA. At best it might have gained them one farm organization.
S. 787 as amended passed and was reported favorably to the Senate. The vote was 12-7 on straight party lines.
Senators Inhofe, Vitter and Barrasso were heroic in their efforts to defend private property rights and states’ water rights and prevent most of the American land and water from effectively being Federalized/nationalized.
Inhofe made an excellent opening statement and subsequent comments. Said the bill was not fixable, but that there was no way to stop it in committee. He vowed a very robust effort to defeat it on the floor. Said it is a dagger aimed right at the heart of rural America.
Vitter noted this bill is a radical change in the CWA moving from regulation of navigable waters to regulation of all waters of the US. He submitted two amendments.
One to allow the president to override the CWRA in the case of natural disasters such as hurricanes, so that recovery efforts would not be delayed or halted. Boxer said public health would be compromised if exemptions were provided. Carper said Vitter’s amendment would undermine the intent of the bill.
Boxer and Carper argued they weren’t expanding any government authority — simply returning to the authority of the CWA prior to the SWANCC and Rapanos decisions, i.e., restoring the authority of the CWA. (Boxer repeated that theme over and over.)
Vitter responded that it restores nothing that was ever in the CWA — instead it returns to the vastly expansive definition of navigable which federal bureaucrats had achieved in order to usurp powers not grated to the Federal government (such as the migratory bird rule, the “glancing goose test”), which was why the Supreme Court had to step in and point out that navigable meant navigable.
It was defeated on a voice vote.
Vitter offered another amendment to include language that the use of mosquito control pesticides would never be required to obtain permits under the CWRA. Worried about this preventing control of diseases such as West Nile. Said FIFRA already adequately regulates their use. There have been movements to require such permits and there are currently cases in court. Boxer responded that Obama has issued a two-year stay or moratorium on such regulations — so nothing to worry about. Vitter insisted that it was necessary to resolve the uncertainty and a temporary stay was insufficient.
Defeated on a voice vote and a roll call vote.
Barrasso then offered a series of amendments, basically aimed at restricting the vast new “wetlands” listed as waters of the US.
First was to prohibit the Federal government from taking all streams and intermittent streams within a state. Said there was no authority for the US to seize jurisdiction over state streams. “No one in WDC has the right to seize and control our streams.” And they were already adequately protected under state laws. And that streams that only flowed when storm water runoff filled them would be placed under control of Washington. Defeated on voice vote.
Next amendment to prevent Federal government from taking all mudflats in the 50 states. Boxer objected to saying the environmentalists were special interest groups, they were just trying to protect our beautiful places. Defeated on voice vote and on a roll call vote by 13-6. I believe it was Voinovich who crossed. (It was difficult to hear the clerk announce the roll call vote and the votes themselves.)
Next amendment to prevent US takeover of all prairie potholes in the states, with vast numbers being on private farmland and ranchland. Voice vote sounded close so Boxer asked for a roll call vote. 13-6 against.
Next Barrasso amendment to prohibit Federal takeover of all wet meadows. Defeated on voice vote.
Next amendment to prevent EPA takeover of all natural ponds. It nationalizes all natural ponds on private lands. Defeated by voice vote.
Boxer asked Barrasso if he had any more amendments. He responded yes. She replied “Boy you are a glutton for punishment.” (So much for respect for property rights and the Fifth Amendment.)
Next amendment. To protect and exempt agriculture under the CWRA. Boxer said this would create an enormous loophole for pollution by famers. Defeated on voice vote.
Next amendment prohibits controls on animal farming: cattle, sheep, goats, fish, crawfish, etc. Defeated on voice vote.
Last Barrasso amendment required that specific language be inserted in the bill to clearly exempt ground water from the regulatory authority of the CWRA. Said while the findings suggest that ground water is not included, that was insufficient. Need unambiguous language. Boxer replied that doing so would weaken the bill! Defeated on voice vote and then on a roll call vote. Inhofe then asked that his name also be attached to all of the amendments.
Then Boxer called for the vote on S.787 as amended and it very quickly passed 12-7.
Now we wait to see what happens in the Senate and what Rep. Oberstar does in the House.
Senator Inhofe said in committee that there is no chance of the CWRA passing on the Senate floor. And in a post-mark-up press release reiterated that “The CWRA faces certain demise if it ever reaches the Senate floor.”
Also Senator Crapo placed a hold on the bill.
Let’s hope that Senator Inhofe’s optimism is well founded.
Meanwhile it is important that anyone who has examples of CWA horror stories of landowners — or any projects — tied up in years of costly red tape and permits, staggering court costs, and fines or imprisonment for carrying out legitimate activities on private land — please submit them to us. Especially if you have documentation such as newspaper stories.
The supporters of the CWRA are arguing that it is simply an attempt to return to the innocuous CWA pre-SWANCC, when the law did nothing but make our waters safe for drinking, swimming and fishing.
We need additional stories similar to those of the imprisonment of Ocie Mills and his son in FL for 21 months; John Pozsgai in PA for 18 months as part of a three-year sentence; Bill Ellen in MD for 6 months; etc., to demonstrate the vast overreach of the CWA and precisely why the Supreme Court had to step in.
And that returning to those unlimited powers — and in fact giving the Feds ever broader authority to regulate anything and everything would be a disaster.
Remember the case of the Gaston Roberge and his wife in Maine. They had owned a 2.8 acre commercial lot in the town of Old Orchard Beach for 20 years. Purchased originally to pay for their retirement.
In the mid-1970s they had allowed the town to deposit excavated dirt from a sewer line project on one half acre. When they attempted to sell the lot in 1986 the Corps told them it was a wetlands and they had violated the CWA by illegally dumping fill on it and were order to remove it.
They spent 8 years fighting through the green tape and with mounting frustration and costs finally went to court. In the discovery process they located an internal Corps memo recommending “Roberge would be a good one to squash and set an example” — in order to create a climate of fear among landowners and developers. Subsequently the Corps dropped the charges and paid some compensation to Roberge — but nowhere near enough to make him whole.
That attitude of the Federal bureaucrats of squashing people to set an example demonstrates the CWA had long ago been converted from water protection to an exercise in naked political power.

Sorry, I know this is a re-post, but…
Door-Hangers! If the pizza guy, and the mexican restaraunt, and the chinese buffet place can hang their menus, then so can we! Please, lets get some of our graphic-design artists out there to come up with some really cool, informative door hangars about the take-over of our country by the private bank known as FEDERAL RESERVE. I know, personally, I look through all those menus, so who is to say this could not work? Hell, I would walk my town post-to-post and hang these suckers on every doorstep for free if I had some.
Why do I not take the initiative myself? I am sure that will be someone’s rebuttle. I AM! I will work on designs MYSELF, but as I stated before, lets take advantage of the collective knowledge we possess within our cause and get some actual graphic designers to come up with GREAT looking ones.
Hey, at least I am trying to push passed this debate about whether all of this is real or not. The consensus is in, IT IS REAL, so instead of arguing the same points over and over amongst ourselves about the validity of our position, lets start focussing our attention on actual ways to combat this info war!

I usually respect this website for its ability to highlight news items that are generally swept under the rug by larger media establishments. Even though I do not always agree with the political bias found here, I appreciate the raw news coverage.
That being said, this story is horrible. Wetlands protection is a GOOD thing, and the point is not to disenfranchise small landowners. One would not know it from reading the script, but the primary victims of this legislation will be corporate agribusiness and industrial entities, NOT small landowners. In addition, I would support it even if every victim was a small landowner because wetlands protection is an issue of national economic security.
Wetlands provide essential water purficiation services free of charge. They remove chemical, particulate, and heavy metal pollution from water, while also providing prime habitat for many species of animals, especially birds (yes, even migratory birds, the “glancing geese”). Thus a protected wetland provides both a source of clean drinking water and a potentially profitable tourist and hunting attraction.
The cost of replacing the water purification service of a wetland with man-made systems runs from the millions to the billions, depending on the size of the project. New York City recently purchased millions of acres of upstate land in relevant river basins and protected it at a cost of billions of dollars, because that was deemed cheaper than building a water purification plant.
If every asshole with a praire pothole could be trusted to keep his cows out of it or to build a levy to keep fertilizers/pesticides/herbicides out of it, there would be no need for Federal or even State regulation. Because of the diffuse and cumulative effect of wetlands pollution, however, that asshole figures, “well, it won’t hurt anything if I just dredge and fill this little part over here…” When everyone fills their praire pothole and all of a sudden there is no clean drinking water, guess who foots the bill for a new purification plant? That’s right, us, and the Gov’t gets another excuse to flouridate more drinking water.
Stop bitching about wetlands protection, it’s actually beneficial to you… And me… And everyone.

Like the patriot act had NOTHING to do with patriotism, this bill is like saying the vitamin C is good for you, and ignoring the pill was also laced with arsenic. So YAY wetlands proection, BOOO the fact that the bill intorduces communist control over them and YOU will never actually benefit from better protected wetlands. open and asleep, it totally depends on what is sedignated as a wetland. For insrance defining a “stream” in Wa state, depends on if it flows all year or seasonally according to the daily rains. This determines how logging operates. However in liberal idiots king county such an area that holds rainwater overnite can be considered a wetlands. Then it can be completely controlled by the wackoes in command. Propery rights zero, game over, next victim…
Wetlands protection is a nice phrase on the face of it. That people form their opinions and take positions at that point is something “they” depend on. They have you signing on to their whole agenda simply on the strength of a miscommunication engendered by the “uncontested territory” implied in the words. Human rights, sanctity of life are two more terms that mean something we all like and can front for …..fill in the attrocity.
Never ceede to anyone on the mere use of a nice glowing warm fuzzy. Ask thenm for the details. Ever notice how we get presented with bills like “to end homelessness” or “to protect children” or to “make the world safe for democracy” or” to ” save jobs/crreate jobs…” etcetcetc? But they don’t say what the bill is gonna do. They just say what they want you to think that doing is gonna accomplish. I can set out in a paper boat with the goal of crossing the Atlantic ocean. You might think how nice and help me gather food cash for the venture. You might be appalled on learning about the nature of the vessel to “accomplish” the ends. If you send me the cash before knowing, ….sucker….

Honestly I think this is just another day in D.C. Stuff like this happens all the time. There never was a shortage of bad bills out there.
The only difference is that a few are getting by, which is inevitable due to the way money sloshes around, and in the globalist/Bilderberg America-last attitude that is now the norm under the guise of “political correctness.”

What about “conservation easements” – there was a podcast by a lawyer about those. Farmers would sell off their land and lease it back, then find that rules such as “no further property development is permitted” would stop them from building barns or repairing boathouses.

Having worked long and hard to advocate passage of CWRA it always blows me away when individuals choose power over common sense.
At the time the Clean Water Act was passed, it was clear that waterways and their sources were vitally important to the public health of our nation, and to the economic (and otherwise) sustainability of our country’s growth.
Look behind the curtain for a moment: Bush’s EPA internally re-defined what the Army Corps of Engineers should consider an “American Waterway”: effectively removing protections from vast quantities of the very streams that feed our drinking water sources. There wasn’t much of a problem with definitions from 1972 until that time, just a lack of will to enforce the law.
CWRA doesn’t change the scope of the Clean Water Act, it restores the Act from the Bush Era damage that was done, and hopefully will put our fine country on track to having more than a 5o-Something % fish-able, drinkable and swim-able amount of waterways to use (including those silly intermittent and seasonal waterways that recharge our aquifers and naturally filter our drinking water, saving us all money in the process). Sheesh.

Of course bills are misrepresented, starting with their naming (Patriot Act). This is old news. I have not read the proposed bill. My job, unfortunately, eats up most of the time I would otherwise spend reading proposed legistation
. If you have read the bill and rendered a legal opinion as to its potential interpretation, then please excuse my ignorance. Otherwise, kindly limit your claims to those based in fact, and not mere speculation.
Property rights are essential to our paradigm of a free society, but so also is the elimination of externalization of costs. No one wants to pay for someone else’s fuck-up. Wetlands protection is essentially one huge elimination of externalities.
Say that company X operates a logging firm, to work from your example. That logging firm creates soil erosion and thus particulate pollution of a local stream. If the company fails to either prevent the pollution or remediate the pollution, it has externalized a cost which it would otherwise have to pay. The cost of prevention/remediation then becomes a public cost, because the stream is public property.
This is true of any body of water, regardless of whether it sits on public or private property, because water is a commodity and not a product. Therefore, even though a body of water may sit on private property, it remains a public resource, and must be treated accordingly. Water that is contaminated on private property remains contaminated when it flows off of that private property, and therefore those who pollute water must be held accountable for their actions if we all want to avoid being held accountable instead.
Just because the Federal Gov’t is doing it doesn’t make it automatically bad. Sure, they do plenty of fucked up things, but it would be as dangerous to automatically assume every Federal action is bad as it would be dangerous to automatically assume that every Federal action is good.
Everyone benefits from wetlands protection, with the possible exception of those who would directly profit from wetlands destruction or pollution (and one could make the argument that even they benefit in the long run).

RE: externalities – you are exactly correct about that issue…unfortunately, instead of addressing the issue of “you pollute our air/water/land, you compensate the public” with a fine/fee scalpel, the Fed is taking a sledgehammer to the issue…by reducing private property rights.

I see people putting their property up for sale, either because they need to make the money to help save their home, or they are about to lose it to foreclosure. I see ton’s of acreage out in the country for sale. When it is foreclosed, the bank gets all that property and then does the government have the opportunity to take it? I keep wondering if the government is getting property because of all the foreclosure’s.
