  • Scholar: Cheney confessed to war crime

    David Edwards and Muriel Kane
    Raw Story
    Wednesday, December 17, 2008

Constitutional law professor Jonathan Turley believes that not only did Vice President Dick Cheney “unambiguously” confess to a war crime during an ABC interview on Monday, but the US’ future as a nation may depend on taking action.

Asked by MSNBC’s Keith Olbermann whether Cheney had just confessed to a war crime on national television, Turley at first replied wryly, “It’s an interesting question, isn’t it? … If someone commits a crime and everyone’s around to see it and does nothing, is it still a crime?”

“It most certainly is a crime to participate, to create, to in many ways monitor a torture program,” he added. “What [Cheney] is describing is most certainly and unambiguously a war crime.”

During Monday’s interview, Cheney was asked, “Did you authorize the tactics that were used against Khalid Sheikh Mohamed?” and replied, “I was aware of the program, certainly, and involved in helping get the process cleared.”

“What happens if the next administration does not press this?” Olbermann asked. “Do we let the International Court at the Hague come in and take over all our responsibilities for policing our own act here?”

“That’s what worries me the most,” Turley replied, “is that you can’t talk about change without having some moral component to it. It’s not just about creating jobs or lowering the price of gasoline.”

“What occurred in the last eight years was an assault on who we are,” Turley said. “I think that President-elect Obama’s going to have to decide whether he wants power without principle or whether he wants to start with a true change, to say that no matter where an investigation will take us, if there are crimes to be found they will be prosecuted.”

“It will ultimately depend on citizens, and whether they will remain silent in the face of a crime that’s been committed in plain view,” Turley concluded. “It is equally immoral to stand silent in the face of a war crime and do nothing, and that is what the citizens are doing. There’s this gigantic yawn.”

    1. Phillip Sigeweald Says:

A big yawn indeed – I seriously fear for our country. Karma is law, not merely a principle in much the same way as “for every action, there is an equal and opposite reaction”. This nation’s attitudes condemn us to our just desserts and I predict it will not be long in coming. Perhaps the Greater Depression underway will be deemed sufficient punishment – but I doubt it. For every innocent murdered in Afghnistan or Iraq or Pakistan, not to mention our knee-jerk support of Israeli slaughter of Palestinians, there are multitudes of enemies created. Some of them will have vengeance if it takes them their lifetime. As indignant as I’ve been, I’m afraid I will judged along with the yawners as I haven’t marched on D.C. or taken any actions we should have erenow if we truly possessed a modicum of morality or sense of justice.

    2. AG Says:

well we all know nothing is going to happen

who’s going to prosecute him they’re all in bed together, whoever prosecuted him would be brought down as well, who’s going to ruin their career ? corruption runs deep

    3. william b travis Says:

if they are found they will be prosecuted where ever it takes us
unless of course the crimes were commited by democrats
then they will be swept under the rug
like bill clintons war crimes against the serbian people
or janet renos murders at waco
or our new attn general eric holders release of murdering puerto rican terrorist
      while asst to killer reno
clinton bombed serbian hospitals, bridges and other non military targets
our spineless media did not show even one picture of the bombings
that killed over 500 innocent serb civilians
how is it no one has prosecuted clinton, reno and holder

    4. dudeman Says:

      lock him up

    5. WakeUp Says:

I don’t think the problem is the will of the American people (a few vocal and prominent patriots, at least), but rather the unwillingness of the courts to hear these cases. These sinister politicians are a protected class – protected by the sinister appointed judges. Just look at the Supreme Court regarding Obama’s birth certificate and now the Illinois courts refusing to hear the case against their corrupt governor (small “g” intentional).

    6. maninwarren Says:

“… to say that no matter where an investigation will take us, if there are crimes to be found they will be prosecuted.”

      Gee, there’s a thought…

Of Course they Should All be Indicted for War Crimes, high Treason, Arsony and Murder!!! It is the Bush/Chenney Family who is Most Responsible for turning Modern America into the Neocon Scam it is: The President of the Cia has been responsible for the Assasination of John F. Kennedy, Martin Luther King and John Lennon!!! Hell they Blew up the Twin towers to Continue there War!! What is Needed is Brute Truth!!! Yell it in the Streets!!! Or More importantly, Never give up on telling the Truth!!!! The Karma of the Afterlife will Take care of the Scum of the Earth,… They Have Commited a Genocide on the Iraqui People Since 1991!!!
Millions of People Have Been Slaughtered by there Commands!!!! Though Change Your Life for Truth and You can Clean Your Personal Karma!!! The Only Way to Free yourself From their Contamination is To Tell the Truth!!! Better yet, Live the Truth!!!! Quit Your Jobs and Organize!!! Quit the University and Organize Protests on the Streets!!!! The United States has been Killed, May a New Baby Be Born,.. Though this time,.. By the People, For the People,… For TRUTH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    9. Stephen R Hannon Says:

Clinton may or may not have been guilty of any war crimes, but once he realized that he had made a mistake going into Somalia, he pulled out all of our troops.

Moreover, Clinton didn’t lie to Congress to attack the Serbs either. He had the blessing of Congress from both parties who agreed that military action should be used.

Unlike the Bush criminals who lied to Congress based on false intelligence that they knew was false, but lied anyway to get their war. Another problem was that the Supreme Court stopped the recount of votes in Florida, and appointed Bush as president. I can’t remember any other time in history when this was done. And the Supreme Court said they had the authority to stop the vote count. I disagree with the Court. Under The Voting Rights Act they did not have the right to stop the recount. As we all know now the fix to get Bush in the WH was already in, and didn’t matter that Al Gore killed him with the popular vote. For that reason the Electoral College should be done away with, and let the popular vote elect our presidents, and not the Electorates. This is not 1782, it is the 21st Century, and we are well educated enough not to need Electorates vote for whom the president is going to be.

Clinton may have been guilty of many things, but not to the extent that the Bush administration has. Clinton never suspended habeas corpus, nor invoked the Posse Comitatus so he could declare Martial Law whenever he felt the need to do so. Thankfully he didn’t. Clinton did not have the Military Commission Act make a rule change to give preemptive pardons for any war crimes committed, but John Warner did. He made almost impossible to have Bush and his thugs tried for war crimes. And now Bush was preemptive immunity from prosecution for any crimes his Cabinet committed under Bush’s direction.

So one can slam the Democrats as much as they like, but it doesn’t matter now. The Republicans have done far worse than Clinton ever thought of doing.

One of the first things George H W Bush said, “let’s forgive the Nazis for their crimes. The Nazis murdered ten of millions of people, and the reason he asked that we forgive the Nazis is because he is one. His father Prescott S Bush was a Nazi financial supporter. His assets were seized by the federal government under Doing Business With The Enemies Act, but they were smart enough to cover their tracks so no other charges could be filed against them. There are good and bad in both parties, but most of the corruption is within the Republican Party, and no one will ever see one second behind bars as long as Bush has the authority to pardon or commute any sentences they may get for their crimes. The Bush administration has been the most corrupt administration in our history.

The second 9/11 attack was on our economy. And that was more devastating than the 9/11 attack of 2001. Rumors abounded that there was going to be another terrorist attack, but no one ever dreamed, other than the perpetrators, that our financial system was going to be attacked. And it was done without a blink of an eye. Wall Street, the Federal Reserve and certain Investment Companies were in on crashing our financial system and then had the taxpayers pay for the $700 billion bailout. The Democrats had nothing to do with the bailout. But the Republicans were all for it. As long has it didn’t come out of their pockets. Sure they’re now making it difficult for the auto industry to get any bailout money, but they never blinked to bailout AIG, Fannie Mae, and Freddie Mac. But they’re pitching a bitch with regard to auto bailout. For the first time during Bush’s term in office he is supporting a bailout for the auto industry. They don’t deserve it, and I doubt the taxpayers can take anymore of what is going on. So go ahead and slam the Democrats, because we know it was a right wing nut job who complained about the Dems and Clinton…

    10. d vago Says:

BAD ON YOU TURLEY! How dare you use a blanket statement that citizens are doing nothing, as if none of us care. There are a lot of concerned citizens in this country that care and are doing things – such as protesting, voting, petitioning the government, forming support groups. Why don’t you bother to outline what action citizens can take in this fight against corruption? You are a professor of law aren’t you? And what exactly are you doing personally about the crimes being committed against our constitution? Are you advocating we sit there and “yawn”? Either that or you are a hypocrite – we are “yawning” and you are doing what exactly? Just reporting the facts?! WATCHING SHOWS AND INTERVIEWS LIKE THIS ARE COUNTERPRODUCTIVE!! Citizens in the US are NOT yawing. We are out there getting involved, believe it!! Join the fight people!!!!!!!!!!!!!!!

    11. SmartHippie Says:

Well if indeed out future of a nation depends on us taking action, we are right and truly fucked.

If any of you Obama kool aid junkies think he will challenge Cheney or Bush you are sadly mistaken. The fascists in the Democratic party are no different than those in the Republican party. Same bosses, same goals, same criminal behavior.

There are rich elites, and there is everyone else.
They have us divided into false camps of D or R.
They get us to fight over abortion, gay marriage, stem cells and other primarily abstract issues. They work together on Wall street bailouts, wars of conquest, and the main business of our nation, billion dollar war toys.

They are sure as hell not about to impeach try or convict one of their own.
Cheney is no different than the Clintons, Obama, Pelosi or any of the Democratic party whores. He will not be impeached.
Most people here already know this, it is just the naive stupid kool aid drinkers who worship Obama that need to wake up.

    12. Larry Says:

I love Jonathan Turley—but my only problem with this segment is that he says “You can hear this gigantic yawn all across America”—but he doesnt say what we can do—–what the hell can we do as citizens? Tell me and Ill fucking DO IT.

    13. Patriot Says:

How much can people see with their eyes and still not realise he committed war crimes….

    14. Antifraud Says:

I agree with # 2, these A-holes never tell us what we can do to see the war criminals indicted. It is like we are all supposed to be or become criminal attorneys overnight, and file our own cases so they can be ignored by the courts. This attorney and all the a-hole attorneys in Washington have a duty to act on the evidence, but do nothing except blame the average American.

Unfortunately, we are more insulated from these criminals than the Iraqis, and have no system of even objecting because they don’t want to hear from us and the media are their punks. I give whores a higher rating at this point.

    15. truthmonster Says:

      HANG HIM.

    16. Gauran Says:

The greatest majority of Americans have been so dumbed down over the last fifty years or so it would not make a bit of defference if these criminals confessed to war crimes every day, they would still kiss their ass til their nose bleeds. These criminals have screwed this Republic to the wall and the people still say, give me more. If there ever were such a thing as a willingly ignorant mass of humanity, it seems to me you are observing it today.

      #13
Please listen to yourself. You’re sounding as though you are a little child in need of your parent to direct your paths. Bollox! YOU and YOU ALONE can muster up something TO DO about this attack on our way of life. Surely even you can do something BY YOURSELF without advice or direction from another.

See, that’s the problem with our sinking ship, er, country – everyone, and I mean EVERYONE is sittin back on their laurels waiting for the other person to start the actions needed to take back our country from the elite “bastions”!! Who will start it though? THAT IS THE QUESTION? They (TPTB) have already declared war on us with their attitude of “We’re the law, NOT YOU! – We can do what we want to.”

So, when do we respond in kind? THAT is the REAL question we need to be asking ourselves. No one I know will give up all they worked hard for to save this country. It comes at too high a cost for most family types. They KNOW they’re grabbing us by the “juevos” and squeezing but we decline to react with a normal response. We lay there and play dead.

We’re gonna GET what we’re asking for by our apathy and inaction. WORD!!!

    19. Springer Da Don Says:

the united states goverment are jus like the GLOBETROTTER’S, every 1 on the team gotta touch the ball (world) so if its democrat or republican, obama or bush, remember 1 thing they all play on the same team and follow the same rule’s

    20. anonymous mouthpiece Says:

      SORRY #13!

      I meant #12

    21. Aaron B Says:

The average American? How about the MEDIA? Besides Olbermann where are the calls for impeachment or indictments? The media has been the willing partner in all of these crimes and they are the ones controlling the perceptions of the so-called adverage Americans. People are too busy just trying to make ends meet to form any serious protest… not to mention it has been clearly advertised that the police can and will stop crowds with rubber bullets, tear gas, electric cattle prods (tasers), lasers, and god knows what else. It all starts and ends with the compliant media.

    22. Larry Says:

anon mouthpiece——-all you did was REPEAT what Turley said——tell me what I can do SPECIFICALLY and Ill do it!! You didnt say ONE thing that a citizen can do———you just keep repeating the same old “get up off your asses” line and fail to say WHAT WE ARE SUPPOSED TO DO. Im listening—–tell me!

    23. Larry Says:

Remember when Vincent Bugliosi’s book came out? The one called “The Prosecution of George W Bush for Murder”? That book said SPECIFICALLY of what could be DONE to the President and it was fucking BLACKED OUT by the media—even the LIBERAL media who hates Bush. Know why? Bugliosi said its because even the liberal left are afraid of the right wing in this country. Now here’s Turley saying that Cheney CONFESSED to a war crime (and I agree with him) and he doesnt say ONE thing we can do—not ONE. Its like these mother fuckers in the media just want the big headline that so and so did this and did that—they want the big headline, “Bush guilty of murder” or “Cheney confesses to war crimes” but when it comes to doing anything to them FOR it—–who fucking cares? Even the liberals are AFRAID.

    24. rich Says:

    25. winston smith Says:

what the fuck man..our vice president publicly announces hes a war criminal and nothing is done about it. these people have totally taken over and we’re probably all going to die for standing up for our freedom. i cant take it any more

    26. Masked Man Says:

It’s merely Machiavellian tactics, used to justify reprehensible actions.

This is the way of tyrants – committing crimes in plain view and then daring anyone to prosecute.

Cheney is using the same logic that was used by the Nazis. They were prosecuted and many were sentenced to death.

Cheney will someday give an account of his life to God. I wouldn’t want to be in his shoes when he does.

    27. Duke Says:

America lives in denial – lives ON denial. Nixon resigned and was not prosecuted. Cheney and Bush will not be prosecuted; they will die in their beds, surrounded by loved ones. Whatever. America has had its chance to be a beacon of democracy and righteousness, and has blown it. Americans let themselves become distracted with racism, financial well-being, Zionism, Anarchism, Communism, Capitalism, fighting over whose god is bigger and more real, fighting over whether God is good or bad; then collecting “friends,” “diggs,” “kudos,” hip new books, mangas, novels, prognostications, big-screen HD-TVs, and – above all – watching the shit hit the fan on the same god damn TVs and then preaching to the fucking choir about it.

Does anybody know what they want? Or who they are? Do you know who your friends are? Your enemies? Do you love your friends? How about your enemies? Yourself? Do you love your country? The one who loves his country the most is invariably the one who complains the loudest, the one who loves his country enough to be outraged at what it has become.

America has not been the America people love for the better part of a century. Actually prosecuting a war criminal in the White House would not be the norm; it would be a break with tradition.

    28. Bob Says:

What we need to do, is enlighten our neighbors, with videos and pamphlets. When our numbers grow then collectively we can go to our local congress person. When they fear us we will be free. Download videos like loose change and wake up call, burn dvds and give them to your neigbors, local police, etc. Print up flyers and hand them out in shopping malls.
We are angry because we know the truth. Use that anger to inform others. Then they will get angry.

    29. Busker Says:

So this ‘opinion’ has to be converted into a prosecution.

What is the next step? Another money-bomb day to prosecute him?

    30. Social Viability Says:

This man calls himself a scholar?

      3:13
“What occurred in the last 8 years was an assault on who we are.”

What the Federal Reserve System has been doing for the past 90+ years is an assault on who we are.

These criminal bankers have been corrupting and infecting the government and business activities of the United States in what amounts to crimes against humanity of historical proportions.

It is a travesty of intellect and rationality to harp on about these issues. While war crimes are not insignificant, they pale in comparison to the crimes that the bankers that own the Federal Reserve have perpetrated.

Criminals run your society and all you have to do to dissolve their power is to stop using their money. The money is the control mechanism that keeps all of us economically enslaved. When we stop using the currency that they supply to us, the Federal Reserve will dissolve and the politicians they employ will be out of a job.

    33. lightbeamer Says:

This is another real epic of Nazism at work in our Own country. Why are people so afraid to speak up and say this just isnt fair, nor is this right? We put these people into control of our country and this certainly isn’t why we put them into these control jobs so they can make laws up to make themselves allowed to do anything. that is certainly a dictatorship characteristic. Why have people laid so low, be afraid to stand up for what is not only right but what there doing is UNLAWFUL. Is it easier to not rock the boat and still keep going on cause we don’t want to be bothered or know what we could loose for speaking out against this. they Knew and have used this scare tactic and people are Just mesmorised and don’t know how to react. Well, the way things are going in this economy, many are going to loose what they’ve worked so hard for anyways, so why not speak up for what your parents held sacred and tried to teach us. many of our Fathers and Grandfathers died supporting against what this Government is doing, and it is UNLAWFUL. They believe we won’t do anything for fear they will implement rash consequences. Whats worse then being told you must leave your Home you worked for because you can’t keep up payments because you can’t sustain work, while these Bankers can just steal these trillions away from us and say its NOT OUR BUSINESS? When you all finally wake up,Let’s hope you didn’t sleep past being able to save what is YOURS, and put a stop to these THIEVES stealing all of us blind and passing legislationso these Bankers can protect themselves from Stealing trillions of dollars that would help all of us KEEP what is ours and what we worked hard for. Those dollars are What we’ll be left to Pay off in a debt we don’t even know where the money went for to supposedly pay them off in the first place. Time to get Mad and stand up for what is right and Get a backbone to be able to say, We don’t agree with the Debts you all (Meaning European Banks) have stolen from us and put us in the weakest economy this Nation has ever been in. Then tell us, it’s Not Our concern what they done with all these trillion dollars! Its BULLSHIT AMERICA! There doing what they di before World War II. EXACTLY what they did. Then they’ll support one war to pay for another and they’ll hold the leans again. History, AGAIN REPEATING ITSELF. Why should we just allow them to Hoard this Money from each and everyone of us? We Shouldn’t! It’s Unethical Unjust and Just down Right Criminal! Just like Cheney saying he knew what they were doing was Unlawful But they didn’t care. They did it anyways! BECAUSE people are to affraid or too Lax on how to handle a situation. It’s time we learn again why our Fathers and Grandfathers lost there lives for! Apparently, they must have felt it was worth sacrificing there lives to make the world better for all of us at one time. We just forgot to open our eyes and see whats important today, and what was important yesterday. Whats it like to be moved out of a house you worked all your life and hours for? What are you and I going to be able to leave to our own kids. Today, it doesn’t look like much! Was all that work, too done for nothing? Was it so we could just hand over our paychecks to these Bankers. I don’t think so. So why would they? They just haven’t seen a Nation just waking up to the truth. It’s time to Put God Back where he belongs in our lives. He gave it to us in the first place. There just trying to Play God, Imagining they are above all and everything . Wake up and educate ourselves America. Work at remembering what it is to feel Pride and Thanks for what we have. And also, ask God for Help knowing right from wrong. He’ll steer us in the right path and way. We just have to learn to Let him do for us, by least giving him thanks again for what we still do have. That will be our strength again to know then what were fighting for and believing in is worth fighting and dieing for. Not just handing it all to them one trillion at a time!

    37. Wize1 Says:

I unfortunately had a neck injury and was collecting work bennys while healing. I saw the entire war on TV every day it was on. The General Briefings about weapons factories, mobile weapons labs and several other excuses to invade Iraq. The day the bombs began falling, I was shocked. I knew they had no reason to go to war. Anybody could see they had no reason. We were’nt attacked. Saudi Arabia doesnt and those other countries dont care about Saddam, Why the fuk should we. I said to my self, “They cant fukin do that” These people have done nothing, they have no evidence.” I was shocked and saddened that the leadership began bullying countries with the military. That’s like me going to my next-door neighbor’s house and killing him because I think he’s got guns and wont turn them in. Just a hunch, a suspicion, some hear say.
This is how I saw it. This is how I perceived their actions regarding the war and the entire presidency. I developed this opinion while sitting on the couch watching the war/TV/news every day thereafter. It’s like going to the movies and then telling your friend what the movie was about. Or it was like reading a book and explaining its contents. I am Veteran and not bias. I am a successful professional and make a comfortable salary.
The bush admin’s attitude was like Fuk it. We don’t care what any other countries say. Lets kill that mutha phucka we don’t care what people think. Weez got a piece of paper that says they’re not complying with our mandates, so weez can take our army men and open a can of woopass. An example of despicable arrogant media ignorance was when Uday and Kusay were killed. Then they posted Suddams dead son’s pictures on the News. All I could think of was how I would have felt if they were my kids. And I was angered at the American leadership

Now we have control of Iraq, now all my Oil rich pals can get richer, and private armies like Backwater can rake in some dough. Yee haaa.

Oh yeah. Lets let all our corporate hommies get rich while we break every fuking law ever invented because I’m da phuckin president. Lets create bullshit loans, let’s raise gas prices, lets take away basic freedoms to ensure no special groups are catching onto our bullshit. And my girl Katrina told me to tell ya’ll phuck da niggas. 8 years later
Gas prices are not as hefty as they were in the past. Because the con is over. Make as much money as you can while I’m president because it’s gonna be all phuck up when I’m done.
I felt what they did during the war and after was illegal. However people who had the audacity to mention the thought of War crimes was ripped apart in the media. Especially Fox. If you said anything bad about George you were targeted by the media. Dixie Chicks, Kanye West, etc etc well now its’ gonna hit the fan you have everybody in fear of this New World Order and we’re supposed to become victims of some mass depression/martial law type atmosphere. Bush Cheney and Rumsfeld should hang like Saddam. They were and are all bad people. As for the fear instilled by the New World Order. I’m not sweating you sissys. You step into the wrong neighborhood or break down the wrong door and you’ll question your motives thereafter.

Flat-out confessing like that on national TV probably gave him the biggest, most shriveled, scaly and reptilian boner since the masked dry humping party out in The Grove in 1914.

    39. Rob in CT Says:

Cheney needs to be arrested, taken to the War Crimes Tribunal in The Hague, and tried.

Can’t some cowboy lasso him so we can get him going?

    40. BobSam Says:

For Travis #40….I have not laughed so damn loud in an age. Exactomundo.

    41. BobSam Says:

      To everyone:

Wake the @#*& up. These gangsters have not been held accountable for 8 years. A Democratic majority was elected to Congress to do confront the illegalities of this illegitamate administration. They have done nothing.
What the hell do Bloody George and Heartless Dick have to worry about. The will not answer for their crimes and they will not be brought to justice.
The only way they will, is for a million of us to march on the Capital and take it back and to arrest and adjudicate the criminals.

    42. Deborah Says:

      Holy Cow!
      How arrogant.
I wish I had a “Get out of Jail Free Card” like Cheney.
He shoots a guy in the face while bird hunting, nothing done. But, he wants to take your guns away?
Then he confesses to war crimes, as if it were no big deal.
      Ok, wake me up.
