The officer involved in a New Year’s Day shooting that left a passenger dead in a crowded Oakland, California, subway station resigned Wednesday, a Bay Area Rapid Transit spokesman said.
BART spokesman Linton Johnson said in a statement that the officer’s attorney and his union representative submitted the resignation at a meeting Wednesday morning with BART police investigators. The officer was going to be at the meeting but did not show up, Johnson said.
The resignation was effective immediately.
Shortly before the funeral for the passenger, 22-year-old Oscar Grant, Johnson said the officer had received death threats.

The BART officer fatally shot Grant in the back after he and some friends were pulled from a train car following a report of an altercation, according to a BART statement.
On Tuesday, attorney John Burris filed a $25 million claim with BART in which he identified the officer as Johannes Mehserle. Several local media outlets had already identified the officer.
Burris alleges in the claim, “Without so much as flinching the Officer Mehserle stood over Grant and mercilessly fired his weapon, mortally wounding Mr. Grant with a single gunshot wound to the back.”

Yet this ‘cop’ thinks that by resigning, he will be exonerated from punishment. he said “I’m sorry” and that makes it ok, while Grant is still dead. But because he is a ‘cop’ his ‘rights’ will be protected…while Grant is still DEAD. Where were Grants “rights”?

There are many possibilities, he said: His office could find no basis for criminal charges; the office could file involuntary manslaughter charges if Mehserle exercised gross negligence, voluntary manslaughter if Mehserle reasonably believed that he was acting in self-defense or murder if Mehserle acted with malice and forethought.>>>
How can he say he was acting in “Self Defense” when Grant had another cop on his neck and in handcuffs, prone on his face on the floor… what was Mr Grant going to do to elicit a bullet in the back? If the cops are so much in fear of their “safety” shouldn’t they be finding work less stressful and start flipping burgers somewhere?

What a P**SY!!!! Ohhh, i’m soooo afraid for my personal safety that I will shoot the ‘perp’ that is being held down by two other officers….yeah, that’s it, that’s the ticket, I was afraid…yeah, and the officer with his knee on the neck of the perp, that wasn’t safe enough for me….blah blah blah.

Cops are psychopaths and designed to kill. Look at what is happening in Palestine. It’s already here, slowly but surely the is ra hell model crept in, homeland security is a sound stop gap, from the 1947 decision for the western rulers to “have their shitty little country” as a French leader put it.
We’re trapped here in the US insane prison, just like the Palestinians are in a concentration camp for cleansing …. foreign partners have made big deals with the US, and now pay dirt is coming home. Palestinians are peaceful people who happen to be sitting on top of what the rulers of earth want: natural resources, lots and lots.
Personally, I was peppers prayed to the ground in my own bathroom, charged with “resisting arrest” and then, when acquitted on 04/01/08, the cop had the temerity to state on the stand that he did what he did with FULL IMMUNITY, because his “employers” tell him to EXPECT LAWSUITS, but he will always be protected.
AND LAWYERS.
Oh, yes, all the “lawyers” in America are earning so much money by greasing the machine, they do not give a care unless it is “a minimum million dollar case,” against the tyranny.
What a tragic place the US has become and the worst is yet to come.

What it sounds like is the officer mistakenly drew his sidearm instead of his taser. Very likely considering we don’t know the extent of the situation as far as hostility between the perp/victim and the officer. We don’t know the reason why these young men were pulled off the subway in the events leading up to the shooting. When adrenaline levels are crazy it is very possible to make mistakes in high stress situations. Regardless, the officer should suffer the consequences of his actions, intentional or not. He should be held accountable for his neglegence.
I agree with a lot of what goes on here at prisonplanet BUT some of the members here are so quick to jump on the “crooked cop” bandwagon and assume the officer just killed this kid in cold blood for no reason. It most likely was a mistake, a costly one and he should be held accountable none the less.

If a cop cannot determine what is a taser and what is a gun, then they should have neither and should not be a cop in the first place. The guy who was shot was already restrained by another cop and in handcuffs. There is no excuse for what he did and he needs to be in prison for the rest of his life. He knew exactly what he was doing. Making a “mistake” and high adrenaline aren’t excuses. he deserves jail and being bankrupted financially, period!

If i were to even accidentaly kill someone, i would get manslaughter and 15 years in a max security prison. The same rules should apply. All are equal under the law.

The riots are beginning, but oddly the video shows no protesters, only police approaching. This makes me sick and I hope it becomes a catalyst to a rise and awakening of people. But as an American I can honestly say (and I just argued with my entire office, who all believe the police are right and that mob mentalities are all violent) that the people in this country are hopeless, they will let anything happen to them, as long as more batman movies come out and they have Tivo…

Hey Reaper… what the Fuck did he need to grab for his taser for if Grant was already subdued and under control? He shot him to put the cuffs on him?…gimme a break! Pull your head out of your ass and quit defending the bad cops and start prosecuting them for their actions. This ‘Cop’ lost any priveledges the badge afforded him and should be executed like he executed Grant. post haste… or Oakland will be burned to the ground in the ensuing riots. Then the ‘cops’ will really be in fear of their lives…
To the citizens of Oakland, and the rest of the country…don’t burn down your stores and neighborhoods…attack the police stations and city hall…focus on the real problem and take corrective action. Its time to disarm the cops. take away their power. shoot to kill, just like they do to us. remember…head shots…or…shots in the back.

It amazes me how much outrage people express everytime a Cop makes yet another tragic “MISTAKE” and blows someone away or Tasers them to death – you’ll recall the taser death at Vancouver International Airport by so-called “Highly Trained” Airport Security.
You all need to keep in mind the Mentallity of individuals who choose this “JOB” in the first place. They are the type that were sadistic bullies all their lives – they get there kicks from having all this new-found power and control over people. You must realize the average cop has an IQ equal to his or her shoesize, because only a complete moron would want the job in the first place. The old days of “To Serve and Protect” are long gone. Today it’s all about intimidation and control. Cops choose this career because they are morons unable to think for themselves – they need a superior telling them how to think and act.
They are just goon puppets for the NWO. When the shit hits the fan this year and they are lying bleading on the ground they may just clue in just before they “Checkout”. Don’t be amazed by their behavior – they are just robots afterall and this is what we should expect from them, nothingless.

Surely he wouldn’t have just shot him in the back? Is it really that bad over there? I am speechless at this shooting of an innocent civilian by a sworn officer, it must have been some kind of mistake, he must pay the price for what he’s done, it’s just that I can’t imagine a police officer would just shoot someone in the back like that. What are we coming to. I sure hope New Zealand doesn’t get this bad.

This is a terrible tragedy. This cop f%cked up badly and will have to face this for the rest of his life.

Remember the border patrol agents (ramos and compenion) that got like 15 yrs in prison for shooting a drug dealer in the butt. the dealer did not die and he smuggled drugs into the country another time. Those agents got the book thrown at them, this officer should get in BIG trouble, or the sheeple are going to start seeing the truth: you don’t mess with drug smugglers because the govt is involved in the smuggling and if you are a cop, you can kill any of the regular citizens, we don’t matter anymore.

Some think that the shooting was an accident, but someone is dead and someones has to pay.
This callous attitude that you need to pull out a weapon to solve every problem leads to these incidents
The training for these cops doesn’t even contain common sense.
No. 1. The tasers should never been designed to look and feel like a hand gun.
No. 2. The tasers should only be worn on the opposite side of the gun. Example: a guy is right handed then the taser should be worn on the left side and his gun on the right side that way he will never get the two confused. This is why scuba divers wear their snorkles on the opposite side from there regulators, because, believe it or not, some dumb asses actually grab the snorkle in a panic, and inhale water. And that taser should not be used unless emanate danger is present.

The second amendment is going to be taken away by Obama, to leave Americans defenseless against cops like Mehserle, who shot Mr. Grant in the back in cold blood. But officer Mehserle is not the only cop to be judge Jury and executioner. There are many cases in the U.S. of officers shooting unarmed victims. Don’t get me wrong, but there are a few good cop’s out there, who believe in to serve and protect U.S. citizens. As far as I’m concerned Officer Mehserle should be in custody, awaiting trial without bond, just like anyone who shoots a person in the back in cold blood! instead of being free to go on with his life as if nothing happened. And the second amendment will be gone, allowing him and other officers to do the same thing over and over again with impunity. Americans have the God given right to keep and bare arms, against a rouge government and their sub servants.
