  • SWAT team called in over landscaping flap

    WTHR
    Wednesday, July 8, 2009

Indianapolis – A call to the city’s SWAT team was the final move against one property owner who let his grass grow higher than a foot.

Specially trained officers were called out to the 9000 block of Harrison Run Drive as city crews tried to groom one unruly yard on the northeast side.

Harrison Run is a neighborhood well cared for. At home after home in this subdivision near 71st and Fall Creek Road, neighbors tend to their yards. That’s why one in particular stood out – or in this case, stood up.

“We’re talking about a foot and half tall,” said Luis Araoz, neighbor.

But the high grass produced more than just dandelions. Monday morning, it called out Metro’s SWAT team.

“This is a first for something I had to run up against,” said Lt. Jeff Duhamell, IMPD.

    1. Cut The Crap Says:

This is what taxpayers get for their contributions to the government. Do you even know how much it costs to send out the SWAT team? People heve to wake up to the fact that We The People are paying for police and other officials to harass us. All we need to do is stop paying them and THEY WILL GO AWAY! Easy!

    2. gimmeabreak Says:

I hope they brought lawnmowers! Cities are decrying budget crisis so lets think this problem through: send the SWAT team (expensive) and still have long grass OR pay a kid $75 and get the yard mowed. Yes, obviously they need to raise taxes- no financial mismanagement in INDY.

      gimmeabreak Reply:

I should have read the full article before I posted my comment- the headline fired me up, my bad. The big problem with living in a neighborhood controlled by a homeowners association is that you have no private property rights.

      Rob Reply:

One problem with the homeowners association, the city is no right or obligation to enforce and rules in the bylaws only civil court has any authority. The city staff that called in the SWAT should be fired and charged for the time of the SWAT team and any and all damages done to the property.

      Kenjo Reply:

I agree Rob but I think what brought the SWAT team there was the guy pointing a gun at the landscaper. True he was tresspassing but he would have been better off if he would have just told them to leave instead. Also he should not have JOINED the homeowner Assn. in the first place. Don’t you think that people should have the freedom to volintarily form such an Assn? I know I wouldn’t live in one!

hundreds around here all owned by banks with the tall grass

We have the same anal retentive, manicured lawn and lollipop tree, mobs here too. mind you we get a month to comply and just phone in and say its done, if they wanna come look, at least we don’t get a fee for someone doing a job they are already well enough paid to do.
cracked up at the comment about oh eek it may harbour bugs, and encourage rats..oh puhleeeeze In truth h e probably has the healthiest soil and ecosystem in the street:-)
Some fool woman in my town got a stunning health yellow gum 50ft tall cut down as “it dropped leaves and made their yard and gutters messy” tree was 40+ feet away, block 2 doors down, on the footpath!
It was also shielding her home from 40C heat in summer and 100+km hr winds on bad days.
I hope she bakes this summer, and the roof lifts next year in a storm. Tree has a 100+yr lifespan, she will move , in about 5? but the town looses that tree forever.
I do dislike people who will not leave some nature IN nature.
I wonder how the neighbours would like it if this chap started complaining about something in their yards???? and had been doing it for 9? years. I suspect he is fed up, and does it to annoy them as much as they annoy him.

    4. Jim Zinc Says:

Bunch of goons, like they got nothing better to do. Who pays for all this @#^&?

    5. I'm So Bored With The U-S-A Says:

The SWAT Team didn’t come out because of how high the grass was, but because the owner pulled a shotgun on the lawn crew.

      fast eddie Reply:

They should of respected the homeowners rights.

    6. PropertyOwner Says:

HOAs have many times taken things to far. Don’t know that pulling a shotgun on a lawn crew was the right way to handle it. However many HOAs have powers that should never be allowed. The ability to foreclose on an owner’s house for not paying HOA dues? This is insanity! Most HOAs that I have seen do a better job of harrassing the members than maintaining the areas that they are “contracted” to maintain. Members have no means to counter the HOA, follow or face the penalty. So much for property owner rights… and lets not forget the folks that pay their house mortgage off and then loose the home due to rent, oh excuse me land tax….

      fast eddie Reply:

A man’s house is his castle, goons gotta stick their nose’s everywhere. Pretty soon were going to have to show an I.D. just to take a poop.

    7. Avinger Says:

To be fair, it’s Indianapolis. This is a pretty big deal for ‘our’ SWAT team.

      sick-of-goons Reply:

Great, a bunch of bumkins playing with guns and other people’s lives.

      fast eddie Reply:

Great, more bumkins ruining other peoples lives

    8. trace Says:

I’m beginning to Notice that it seems to be *US* against *Them* like the *North* and the *South* and I don’t mean just the folks on the hill, the nwo..etc.. I mean US against US! A month ago I moved into a Apt. Complex… I tried to get a moving company to move me but they were all booked up so I found some friends that were willing to help on their day off. The only day that they could help was on a Sunday Afternoon. We got to my new place around 6:45pm… being that it’s summer it doesn’t get dark around here until 10pm. I know that people have to get up and work Monday morning but again it was 6 – 7 pm.. We barely got the ramp out on the U-Haul when this lady comes down to tell us we need to keep it down…because they had a 1 month old baby that was sleeping…I told her I would do the best I could but I’m moving in and will be done in a couple hours…I noticed that she was in the Apt right above mine… All her windows were open and all apts have Air… So.. I thought to myself… why couldn’t she help the situation by closing her windows…turning on the air for a couple hours so we wouldn’t disturb her 1 month old sleeping baby..? The answer came to me … It wasn’t about her helping the situation out… it was about me bending over backwards and not disrupting her and her families life. 2 days later as I was putting things away in the kitchen I heard a knock on the door around 7-8pm… it was her telling me that she heard some *Rattling*… I thought to myself.. ARE YOU KIDDING ME?? Without saying a word I shut the door. I thought to myself are you being selfish? The answer I got was no. I got a call from the apt. management saying that they received some complaints about *Noise* when trying to explain to them I noticed they weren’t interested in the answer they just wanted all problems to go away. I thought long and hard about the whole thing and if I could I would love to slap the common sense into this lady upstairs. (thankgod I got the apt under her.. I couldn’t imagine it reversed.. I’d be fucked…*Your walking to hard on the floor.. my babies sleeping.. KEEP IT DOWN!!!* g’lord… N E ways… again.. I thought about what had happened and wondered what I would have done in that situation… honestly I told myself I know what I would have done… I would have introduced myself and welcomed these people to the neighborhood.. if I could I would offer my help in any way.. because that’s just being *Human* I would have thought about the little extra noise that would be going on when someone moves in… normally it takes people about a week to get things un-packed and hung up…etc..etc.. and things to settle down. The woman above me it turns out has 2 little kids on top on the little 1 month old… do you want to know what I hear all the time on my ceiling? Have I once complained.. No…kids will be kids and I don’t hear them after 9pm anyways.

Again.. I’ve noticed it’s US against US…I’ve noticed soooooo many selfish people. If you upset their lives in N E way.. LOOK OUT.. HOW DARE YOU… so many people want to control your life and tell you how you should do things.. their way!!! If you don’t.. they’ll show you…Hence the story above. I would love to hear from this guy…I bet he’s had to endure more then just.. *Cut your lawn please.. it’s over an inch and a half!!!*

    9. JF Says:

Good God, a damn SWAT team for an effing lawn issue? What the heck is wrong with people these days? Maybe the owner was elderly and could not mow it himself? If that is the case, then a few neighborhood high school or even middle school age kids could whip that yard into shape in a few hours. Whatever happened to being neighborly? Out the window apparently. Now if you have an issue with your neighbors instead of being civilized and asking if they need help, just call the police on them. Losers!!

    10. American Dummy Says:

These sorts of incidents illustrate exactly why we are in the dillema of self destruct.

    11. Fifer Says:

My son mows the lawn and weeds the garden for the elderly ladies next door to us. They can’t do it themselves and can’t afford to pay to get it done. It’s no big deal.

I don’t see why this guy’s neighbors can’t knock on his door and ask if he needs a hand or if he even owns a working lawnmower. It wouldn’t kill them to help their neighbor. No shotguns, no swat teams, no fuss.

      sick-of-goons Reply:

Fifer, your a dreamer. Maybe it was his neighbors who snitch on the poor man!

    12. Time&Again Says:

The person in question was not an elderly individual as suggested, but a highly charged and unstable unit.

      sick-of-goons Reply:

Who is the unstable one? The poor citizen defending his home or the goons trampling all over the rights of this patriot?

      Ha ha ha Reply:

Citizen?! Patriot?! The guy is an anti-establishmental scumbag who was hated by his neighbourhood and thinks he’s cool for waving killing tools around.

He doesn’t give a shit about his own property, what makes you think he gives a shit about his country?

You don’t even know what a god-damn Patriot is, do you?

      Matt Reply:

I’m not a patriot either. I’m a Bundy (not in name, but in spirit)… Bundys hate cops.

Seriously, this guy just sounds like a misanthrope. And YES, he probably doesn’t mow his lawn because it pisses you off. Get over it. No one gives two squirts about your property value, because the Chinese really own your house anyway.

      sick-of-goons Reply:

Someone who doesn’t let pigs push him around, someone whose father took a bullet in the leg on the battlefields of Europe and spent four months in a stinkin P.O.W. camp for you to say that “ha,ha,ha”. That’s what you are, a bad joke “ha, ha, ha”
Yes, I know what a true patriot is, a man who doesn’t let some pig or goon push him around. Maybe we should send a swat team over to your house “ha, ha, ha”, I heard that your cat is pissing on your neighbors shrubs.

    13. ICE CUBE Says:

The city should of just called gardeners instead of S.W.A.T.

      YA DUMB FUCKS!
      – ICE CUBE

      Someone who isn't witless Reply:

Did you actually read the article, dipshit?
They did send a lawn crew. Then the homeowner pulled a shotgun on them and was threatening to shoot them.

That’s why they sent in the SWAT team. It had nothing to do with the fucking grass, it was the delinquent loser who thought he had the right to aim his overcompensation at people doing their job.

    14. Hereward Says:

Don’t ever move into a neighborhood with a homeowner’s association! The world is full of people who want to rub your nose in it, so the best thing to do is to try and stay away from them.

    15. Joe in JT Says:

I have one peice of advice for all of you. Don’t ever live in an area that has a “home owners committee”. These people are power hungry Nazi’s. It’s always a small group of local neighbors that “elect themselves” as oversee’rs of every house in the area. They come up with bullshit fee’s that you have to pay or they can put a lean on your house. Can you imagine this? And they will sell your house right out from under you while your living in there. I’ve heard in Palmdale CA. that a group of homeowner nazi’s force one guy to “paint his rocks green” in his front yard. Just because all of them thought it looked good in their yard. (It’s to hot for grass in Palmdale) But this is the kind of crap these self elected homeowners do. It’s rediculous.

    16. Jim Says:

It was a justified use of taxpayer funds and a valid SWAT mission considering the man’s conduct (threatening a clean up crew with a SHOTGUN) . HE caused it by elevating a yard mowing dispute to armed conflict. Had they violated any of his constitutional rights, he could have sued them at his leisure. It was NOT a self defense issue except for the city work crew. Any one of them could have legally killed the homeowner if he pointed that weapon in their direction as opposed to brandishing it.

SWAT guys have special armor and HELMETS that can withstand more punishment over wider body areas than regular BP cop vests. It’s not fair for some cop to get wacked just because the homeowner dislikes the mowing rule. It should have been a PURELY civil matter until the Homeowner made it criminal.

I am no fan of SWAT teams as a rule and they look just like terrorists to me. The more gear you put on them, the more you think of a military force.

    17. Skunkbait Says:

We lived in a place like that. It was aweful. One of our neighbors called the city over everything, (grass, a car parked in the yard, a new chimney, etc.). So, we bought the house next door, then we moved out into the country, and we rent both houses to the loudest most obnoxious people we can. Seriously. I derive a great deal of satisfaction from that.

    18. Satan Says:

i like this unwritten reasoning that says, when a citizen is unconstitutionally violated in Amerika, the citizen’s reaction to the violation is a crime but, there’s no crime in the actual violation so, now the gov’t can legally exterminate you however ,if you comply and conform you may live in one of their fine cages..

This thinking allows law enforcement to violate citizens until they snap then prosecute or kill them. I see a lot of this in Amerika. I like I liiiike…….

    19. AlGoreCarbonWhore Says:

Coming soon: get tazed for bread mold. All part of Obama’s cowardly new world, enforced by his jack booted goon squads, where wrong is right, up is down, intelligence is banned, and dumb asses reign supreme.

    20. k. Says:

The guy has to learn proper tactics regarding his tall grass rather than pointing shotguns at people.

Claymore mines and tripwires is the way to go.

    21. john Says:

Yep…knew there was more to the story…

He pointed a shotgun at the grass cutting crew…who were there to cut his grass for him…

go on fear mongers….twist, twist, twist them stories…..

The Onion is more believable then this f’ing website and its demented leader.

    22. john Says:

Ice Cube…did you even read the article?

    23. lovephileo3 Says:

Both parties had its share of excessive and violent reaction to the situation!! The lawn owner has no right whatsoever to point a shotgun to the lawnman whose only purpose is to clean his lawn; while the law officers likewise over-reacted by sending highly trained trigger men to the scene! Their neighbors also over-reacted to the landscape problem; crossed the boundary of privacy of home. They should mind their own backyard! If parents are not allowed to open and read the letters of their siblings, how much more do we have the right to force our neighbor whose not even our relative to cut his grass!
