Texas Lawyer Takes On Bloodthirsty Cops

The prospect of cops forcibly jabbing a needle into your arm and taking a blood sample on the side of a highway in suspected DWI cases is perhaps the most egregious portend of police state America in history, but one Texas lawyer has taken a stand to denounce the program as completely illegal.
Law enforcement programs in Texas, Ohio and other areas have trained cops to pull suspected drunk drivers over and forcibly extract blood, even against their will, a form of legalized police brutality that outstrips anything in Soviet Russia or Communist China.
A cadre of jackbooted vampires are set to be out in force this holiday weekend in search of your blood. Citing the fact that the 4th amendment protects against “unreasonable searches and seizures” matters not to these thugs, who will hold you down if need be while sinking a needle into your arm in another case of “guilty until proven innocent”.

Dallas lawyer Avery McDaniel told CBS 11 News, “If an officer believes that you’re intoxicated and you refuse, they will get a search warrant and they will physically hold you down and take your blood.”
“What if someone is diabetic, or if the person’s on blood thinners,” McDaniel asks. “They’re not prepared or trained if something goes wrong.”
“McDaniel represents a client who was stopped by police in December 2005 and had blood taken from her forcibly, leaving bruises along her arm. He is asking the judge to throw out the blood evidence that he says was obtained illegally,” reports Raw Story.
An Arizona lawfirm that specializes in DWI cases explains on their website why the 20 hours training that officers receive to carry out such a procedure is not sufficient: “Up until a few years ago, when officers opted for a blood test, they would transport the DUI suspect to a hospital or other similar type medical facility where trained medical personnel would draw blood in a clinical setting. … The vast majority of the police officers calling themselves phlebotomists are not graduates of a full phlebotomy program and certainly cannot be considered medical personnel. … While these police ‘phlebotomists’ are performing an invasive medical procedure, their first concern is not for the safety of the blood draw subject, but gathering evidence.”
McDaniel’s point about cops performing an invasive medical procedure on the side of a highway being a completely unsafe environment is correct, but the main outrage here is the fact that this program is flagrantly unconstitutional and downright un-American.
Attacking the program on the foundation that the cops aren’t trained properly to carry out the procedure may be an alternative avenue through which to shoot it down, but officials could easily beef the training program and claim the contention has been resolved.
The central core of opposition to this nightmare should be that the program is completely anathema to any notion of a free society, due process and the right to be treated as innocent until proven guilty.

I really am surprised how far the fascist pigs have gone with their bullshit already,I consider any bodily excretions,or fluids,including my exhaled breath,to be my personal property,and I believe that law enforcement is not allowed to use ones personal property to conduct business against the property owner without the property owner’s consent,or use ones’ property to conduct business with a third party without the property owners’ consent.
Let alone ask someone who is supposedly debilitated from alcohol or drug abuse to make decisions or sign documents regarding legal infractions they may have committed……
The people of the United States are just so fucking dumb that I stand and look upon the whole mess in awe,I am dumbstruck at the amount of stupidity and illegal bullshit the american people will tolerate.

Ah come on now, how hard is it to figure out that the CCA needs crime cause it pays. What else are the fat cats gonna retire on? After all, everything else has already been sold down the river by and through the common purpose of Brussels, EU. All the sustainable warm and fuzzy everywhere – it is the EU’s energy stock that the US is purchasing for its Oregon schools retirement funds, for example. This is the biggest threat of all and we’ve not even begun to realize just how insidious the take-over truly is. Study the website of each state and the Treasurer is the cue. The WORLD MAYOR webpage for Potter in Portland, is eerily in our faces as to what really is happening. http://www.ourcommission.org is about the children and Hitler Youth comes to mind watching the children stand up to the rock shout video, color red – and then GREEN the children sit down. No CONSTITUTION is taught at the MYC (Multnomah Youth Commission), not the US or Oregon.
Dumb Americans is the understatement of the 21st Century. Our GREEN is the monster alright and protect/save the planet and children is being slimed by the evil EU, everywhere as a COMMON PURPOSE. This reminds me of the gun confiscation in New Orleans… a test to see how much crap we will take. When the New Orleans police Chief said no one would be allowed to be armed, how was it tolerated? The right to bear arms wasn’t a conditional amendment to the Constitution. It didn’t specify any conditions under which that right could be taken away. It didn’t say that convicted felons could have that right taken away and it did not allow for that right to be taken away during a flood. The right to be secure in your person and property and to be protected against unlawful search and seizure was also not a conditional amendment. The Texas police state vampire patrol is another test that we must not fail to pass. Stand up Texans! Don’t tolerate this.

It’s always been assumed that if you refuse a blood, breath or urine sample, then you get punished equally as someone who gave an illegal-level of alcohol sample, so justice wins either way.
Therefore this is the most sinister, criminal development I have so far heard of in the catalog of ‘police state’ crackdowns. The goons are not doctors or experienced nurses working in clean peaceful environments. There will be huge risk of lethal bugs being injected into you blood stream during such a dirty procedure while they ‘hold you down’. What is to stop them injecting you with something sinister anyway? We all know there are some twisted bastards in police uniforms as well as good cops.
I would fight this with lethal force. You will have to make your own judgement about if being a compliant serf for NWO goons is preferable. If they get away with this -WHAT THE HELL IS NEXT?

Whatever happened to breathalysers? Are they not reliable anymore? And if not, why are car manufacturers looking to have them installed in all new cars by 2012? By then they’ll be behind the curve. I suppose they’ll upgrade it to give a blood sample every time you start the car.
If a cop wants to take your blood tell him you have AIDS, hepatitis, herpes, bird flu, SARS and a sore throat. Perhaps that will deter them from wanting to take your blood.

Bet none of these children of the elite would be subject to this kind of treatment. Chevez wouldn’t have this done in Venezuela, it would be something ‘Bush would do’ so it would never go into law. Last week i played a show at the lake and the police set up road blocks to check people’s ID , insurance, and suspected dwi.
Totally unconstitutional but they are getting away with it every day.
Our republican convention was almost shut down and I almost went to jail for saying something against the grain without cursing.

I have already contacted the Austin Police Department and told them this practice is appalling. I also reminded them it is unconstitutional. There are many complications that can occur from this invasive procedure. Every vein is different in each person. Each person has arteries running very close to veins. Occasionally even the most expert will hit an artery, blow a vein, cause a thrombosis, and or introduce a blood borne infection. This is a precursor to allow police to begin INJECTING meds for control/sedation purposes. Pharmaceuticals are running the world. Once every one is accustomed to the blood draw, then it will be considered humane and compassionate to sedate rather than taze. O do I see it coming.

Alex and David Icke pretty much summed up the current situation: while some are awakening, there is an ever growing number who are narrowing down their scope of vision. How is a cop supposed to deal with one of these stunted souls when he finds him careening down the road, drunkenly endangering the lives of others? Perhaps drawing blood goes a bit far, but get this individual off the road, in custody, and repremanded with all expeditious haste.
There is a problem: There are a large number of people (a ‘vast majority’ to quote Alex) who are narrowing down under the pressure of current times. They not only haven’t yet earned the rights that were fought for by the forefathers of this country, but they aren’t even on a path to do so. In my own mind, I consider them as dangerous as the elitist control freaks. In fact, a case can be made that the one creates the other. But if I had to guess which came first, the chicken or the egg, I would guess that it was the self-willfully dumbed-down individual, without whom there would be no need for excessive control.
Cops, like the rest of us, are good/bad people. It would behoove the ‘Truth’ movement to befriend them as much as possible, instead of finding ever new ways to equate them with the New World Order. They are a natural militia spread ubiquitously amongst us who could be very benificial allies in the times ahead.
Again, it is very important to perceive the equal, if not greater danger of the moronic, brain-enlarged-from-TV couch potato, many of whom squawk the loudest for their individual rights. It is as detrimental for any ‘Truth’ movement to use these individuals as voices for its cause as it is unconscionable for the elitists to use them as slaves. Allow them to awaken, of course, but if it is perceived that there is a type of individual that doesn’t even have the capacity to do this, what do you do? The cops have decided to stick needles in their arms. Understandable. The corporate elite have dedided to use them as slaves. Understandable. Sio if you get pulled over and lets sya you smoked some pot a few days before you get pulled over and its still in your system and even though you are totaly straight when you get pulled over this seems to me like you will be charged for driving under the influence or charged with possession is this the case?If thats the case a person could get jail time for ingesting a poppy seed cake,that will show up as a narcotic in your system.This is unreal we must put a stop to this people must stand up against this.What the heck was wrong with the test they have used for years?This is obviously desinged to ruin lives if anything we should be alowed to know whats in there system because you have to be on something to think this is ok to do.

This nation went wrong so very long ago when so many people begged the government and police to take charge of certain responsibilities we, as free citizens, have a moral duty to do for ourselves, including personal protection. The police are meant to assist businesses and serve the common good. Freedom is not free because it is a balance with nature; good and bad; positive and negative. Anyone who cannot also enjoy the hard days of life, does not truly desire freedom, but merely releif from the inequities manifest by their refusal to commit to the daily activities which keep them free. Allowing a citizen in a black uniform to draw blood from other citizens, on the side of the road of all places, is maniacal and illogical, and has absolutely nothing to do with police work…if someone is intoxicated to an incapicate state, a breathalizer or field sobriety test is perfectly sufficient to allow any properly trained police officer detect it.
A cheek swabbing, jack-booted system like this, ruled by fledgling blood thirsty neo mad-scientists, employing the tactics of a paranoid SS Guard, is just ripe for corruption and perversion. This is as anti American as the Swastika used to be and the Crescent was taught to be.

Just a simple point. If the cop taking your blood placed just a dust-particle of heroin or similar illegal drug in the tube before drawing blood, it would be a very easy way to set someone up and destroy their life or career.
Bent cops are a minority of officers, but by god they do exist we all know that. They will use this to set people up.

What will happen when all the police need is some saliva from your mouth to tell if you are drunk or not? I agree that this law must be fought from the argument that it’s unconstitutional. As technology evolves there will come a day that the police will be able to read the alcohol content of your blood stream simply by having you breath into a small device that will not only read your alcohol content but will also tell what drugs are in your blood stream.

Absolutely horrific! I am appalled that this program has been in effect in the State of Colorado for several years and is spreading like a cancer in American society! I don’t trust over zealous agents with taser devices let alone hypodermic needles on the road side. Do these ‘trained’ agents (officers) have sufficient training in prevention of the spread of infectious disease and preventing septicemia (common in hospital environments)? Do these ‘trained’ agents have the ability to conduct blood draws with minimal chances of introducing blood clots or “collapsed veins” in the procedure? Are they required to “intern” for a period of months or a few years under a fully-certified medical professional while being regularly reevaluated and corrected? Are these agents carefully trained to deal with serious reactions that some people may have even with the sanitizing solutions (if any) that are used in the preparation stage?
If the answer to any of these questions is in doubt: They are NOT PROPERLY TRAINED!
WE need to forcibly scrap this dangerous program, regardless of the excuses our politicos offer.
Yes, this is an outrage against the right to be secure in one’s own person and his(her) effects.

One swift martial arts move could put that needle in a cops eye. I say that to put a worst case scenario on what could happen to a cop. Physically attacking someone with a needle is cause for self defense. A sudden reaction that just may be inevitable over time.
And as someone else pointed out hepatitis C. Whatever happened to the cops that were afraid of getting aids from blood? I thought they were afraid of that.
How about we require cops to have mandatory steroid tests? That would be protecting the public as much as getting drunken drivers off the road. I mean if the reason really is to protect the public.
Seriously, do you really want to attack citizens? When cops get pulled over by other cops will they be jabbed with a needle?
Please try and understand that this sort of police state is predatory and absolutely horrifying. Officers, Try and imagine your own family members being attacked like this, or tasered. Or even living in fear of it.
It is not right and you need to have the courage to say so down at the station and to the local press. Where are the heroes for crying out loud?

That has been around here in Australia since 1985. They make us count to ten into a device that measures alcohol content.
Only now are the beginning to drug test randomly too. Last week my friend had to wait on the side of the road for 25 minutes for a drug test. Upon a negative result, he was allowed to go (25 minutes late).

I hate it when legal cases completely miss the crux of the matter. This legal case could probably do more harm than good. All the totalitarian state will do if they loose is get complete training for the blood-sucking vampire cops or make a law that says their 20 hrs of training is sufficient. The real issue here is “Unreasonable search and seizure,” not their training. The constitution violating cops are the issue. The directive they have been given is unconstitutional, period. What happened to honoring your oath? If they did not mean the oath they took they should resign. Including the district attorney that defends this illegal action. Criminals using the law as their cover. Using the law against the people in a way that no gangster ever has ever done. They hide their disgusting law breaking behind their badges and authority and thinks it gives them the right to break the supreme law of the land, the U.S. Constitution.

I have worked in the medical field for over 25 years and will not voluntarily submit my arm to someone with 20 hours training, a vacutainer syringe and a scorching case of Roid Rage.Besides this
totally goes against the Fourth Amendment of the Constitution which protects the American public from unreasonable search and siezure without sufficient probable cause. This is even a bigger farce than the on the job random drug testing. I saw more injustice involving that program. Time to wake up Americans! Your worst enemy is not drunken drivers and drug addicts, It’s some Jack booten uniformed thug trying to jab something into your body like poison vaccines, harmful drugs, Flouride, Taser prongs and yes the occasional 16 gauge needle.

I think the people in power need to be reminded of the constitution and what it stands for. I think maybe a new law needs to be added to the constitution which is those who dont follow the constitution will be held accountable. I am so tired of these new big brother type no respect for freedom laws being passed.I often wonder why we need so many new laws. I think a lot of people just use it as a tool to get elected.I think everyone needs to get active on a local level and get others to just care.It just seems like so many people dont care.That is part of the infowar itself.Just waking people up so they care. I hope we can bring positive peaceful change so things can get better and stop these type of just following order thug vampires from using the law to go around our constitution. If some Pig on the side of the highway tried to take my blood, I would let them at first, then jerk my arm so blood get all over them, maybe even bite my own lip till it bleeds, spit in their eyes and claim I had AIDS and HEP-c. I agree with what r jones said. These abuses of power will only stop when enough people start sending rounds toward these people. Of course you will lose your life in this process, but what is freedom if you are not willing to give your life for it. Enough people do this, then this abuse will stop. Not too many people will be willing to lose their life in order to just take your blood.

but to add to my previous posting, it will not happen. The American people have lost the desire for true freedom. We are too concerned about keeping our Ipods, wide screen tv’s, hunting and fishing trips, shopping, and other anemities that we used to having. The American people as a whole, have lost the character of the founders of this country. If something becomes the law, we accept it whether it is right or wrong. By the time we wake up and try to do something about it, it will be to late. We will have lost the last means to protect our freedom, our weapons.

This is revolting. This lawyer needs to bring up the fact that it is about the violation of constitutional rights. Yes, it is disgusting that they do it on the side of a road, but people need to call or e-mail his office and give him support for figting for the rights of us all in the long run.
As dirty as cops can be, you know someone is trying to make a name for himself and keeping the blood of someone he’s arrested just to plant it on a murder scene somewhere. A young officer can rise up pretty quickly in the ranks that way, especially if he’s got a shady homicide detective as a friend.

it seems our police in the UK have a little more restraint.
if they suspect you are intoxicated and and ask you to blow into a breathiliser you have the righ to refuse, althought the police have the right to take you to the police station and use a breathiliser that looks like the huge xerox machine i have at work.
this also applies if you are too drunk to blow into the breathaliser.
although, im sure if our police had half the chance they would be trying to take everyones blood.
infact, the funny thing is if you are suspected of ANY crime in the UK they take your DNA…. i have never had a run in with the law since i was 15 (long time ago for a tiny bit of herb) so im yet to find out what happens when i flatly refuse to give them my DNA…. im sure it will happen one of these days…. hence im going to start learning Jeet-Kun-Do and Ju-Jitsu, im not a voilent person but if the police are wanting to take my DNA unlawfully i want the ability to defende myself and Ju-Jitsu is perfect.

oh yeah, and further to my below post, if you have ANY involvement with the police in the UK they take you DNA for the national database EVEN IF YOU ARE INNOCENT.
Many innocent people are fighting to get their DNA removed from the database but the Police and government flatly refuse…. Hitler would be proud of the state we live in today.

We don’t need police departments anymore. Get rid of this overfunded beauracracy, take away their guns and fancy cars, and have them pick up garbage on the side of the road as they walk around. Its time for all American’s to defend themselves, their families and their homes. Not all police are bad but my guess is at least 50% of them have bought into the fascist system they are now protecting.

Last I checked the Fourth Amendment was part of the Constitution.
Last I checked police are sworn to defend and protect the Constitution.
Am I so far behind the learning curve that this is no longer the case?

I’m a law enforcement officer in ohio and if we are receiving training to forcibly take blood from driver’s I missed that class. The only time blood can be taken without a driver verbally giving consent is when they are in a condition where they are unable to communicate, they pretty much have to be unconscious or dead. That law is called implied consent. And even then the only person who can retrieve the blood is someone licensed to do so.

If everyone just started off with 10 like minded people who were willing to meet twice a month, and show documentaries, and have a chat n chew social mixer, and those ten people invited just 2 people to their first meeting, the group would triple the first month of their first meeting. Then all of the new people invited just one or two people, just think if you could keep it simple in the beginning, outlining your goals / mission statement very early on, and organize a simple newsletter. Call yourself something proactive and creative like the “We Are Change” group. Then members in other cities could form groups. If that didn’t work, Then the group could form a sister group of “We Are Change.” But I think starting something new with a different specific targeted goal would be nice. If each of these groups did their thing and agreed to meet each year at Washington etc…we could have forward movement.
I suggest that Alex Jones ( I know he is busy) , train young people who could start their own radio programs or work in some part of the media in their own cities. Perhaps Alex could give a media workshop, which we should pay like $50-$75 and some volunteers could help put together a media kit / packet. We could conduct this training on a weekend in Austin or in Houston. Other like minded professional could
be invited to volunteer and speak in their perspective field such as film, audio, broadcasting, PR, how to handle right wing TV personalities or how to be prepared to defend the cause on talk radio with confidence.
The problem I see is God forbid Alex has an accident or gets sick or worst, part of this movement will be greatly affected. There would be no real continuity. But if we continue to train young and old constantly, I am sure we will have strong leaders coming out of this, look at the kid with “We Are Change.” He isn’t even 30 and look at the difference he is making. Look at the “Loose Change” guys. I strongly believe that if we don’t give um everything thing we have, this movement will depend on the work of a few. We need thousands of producers to train at public access while it is still public. We need 1 million cd and dvd to be distributed. Look at how AOL got its start. They sent free CDs to everyone. Keeping copyrights loose is an excellent idea, but I must ad folks should keep in mind that the folks creating the various documentaries have to feed their families.
We need to stop behaving like we have another year. Look around you and see the difference. Remember your childhood? Well I remember my father leaving me in a car alone and no one dared harmed me, nor did he for once thought I would be in danger, those days are long gone.
People 1984 is here now. America has lost it’s status and respected name. We borrow from China but communist Cuba is a problem? Give me break. We have been dumbed down to the ground – how much more low can we go?
Our time is now. I wanted to talk about the political process, I will let someone else talk about that.

Canada has passed law allowing forced body fluid samples by police.
It is illegal to refuse ( just like breathilizer test ) and you will be fine automatically for refusal.
They are targetting ‘drugged’ and drunk drivers with more emphasis on marijuana users. Canadian Harper government is importing America’s failed ‘War On Drugs’ policy.

all these fears are quite well-based.
Recently, both the DNA lab and the Toxicology lab here in Houston were shut down because of faking evidence. If we can’t trust the lab guys not to fake it, how can we possibly trust the officers on the street.
As a sometime forensic expert, I personally witnessed fakery. When, in response to a direct question by the DA on the wittness stand, I tried to tell a jury about it, the judge threatened to throw me in jail for contempt if I repeated it again.
Friend of mine with seizures got busted by the Houston DUI squad for looking “confused”. He had had a DUI about a decade before. Broke, so couldn’t bail out.
Was told by the judge (completely contrary to Texas law) that if he bailed out he could not get a court-appointed attorney. But, if he pleaded guilty, he would get released immediately.
I bailed him out myself when I found out the cops had “lost” all videotapes from the arrest– there may have been as many as three. From my expereince, I fugured the videotape did not correspond to the arrest report. Ya can’t change the arest report, so lose the videotape.
And now they want to give these guys the power to take blood by the side of the road…

nobody has brought up the fact that lab results are not always correct even when they are obtained in the best of circumstances. blood can and will hemolyze and give false results, especially when someone doesn’t know what they are doing.

Here in Australia, it’s already happening. ALSO, cops can hold you down and forcibly draw blood if they want a DNA sample. Most Aussies, are too frigin’ stupid, to realise that we are in a Fascist Country.

All these examples are just the begining in laying the legal ground work for forced DNA collection….later to become pretexts for sub-dividing and marshalling the populace into managable groups…alcoholics here, cancer folks there, potentially insane over ther, etc.
These metrics, once codified into law and more commonly used by the authorities, will be the hammer to beat the citizenry of every nation with. Imagine being denied employment on the basis of “genetic markers”, the abilty to marry, to immigrate….you get the idea….this is to become part of the infrstructure of a total contol society.

Reminds me of my SOBER DUI.. In El Dorado County, the officer’s name is Chris Stelz of the El Dorado County Sheriffs Org…
basically the guy pulled me over cause I was the only person on the road… and when he came to my window I said “Good evening officer! what seems to be the problem?”
he replies…
“ILL BE THE ONE ASKING THE QUESTIONS SON”
right there I knew I was in trouble, not because I did anything wrong, but because this guy was a total Nazi, especially when it came to respect..
He basically continues to use verbiage like “your playing my game, with my rules, in my world”
and
“wheres your boyfriends ID?”
and then he had me sign a ticket for a “broken tail light” that I actually just got signed off by the CHP a mere weeks before this encounter, but apparently “it was the wrong color of red” the guy must of been color blind cause the CHP thought it was OK…
he had me sign the ticket 3 times, 1st cause my signature went out side of the 5mm box, the second time cause it did not match my signature on my drivers license, and then on the third signing he said “what kind of faggot signature is that?”
then I asked for his badge # because that was the last straw for me…
so he decided that I was a threat so he pulled his fire arm on me, forced me out of the car, and hand cuffed me…
the first sobriety test was not until after he arrested me, and processed me into the jail, at which time he took my blood test because i stated that “i have a phobia of needles”… which came back 0.00% BAC….
Onece again he gave me a choice to do either the blood test or the piss test, but when I told him that I absoutly hate needles, he thought I said I love needles or something, he was just trying to play his little games with me.
but the DA still pursued the case, so I had to hire a lawyer, spent thousands of dollars, and then denied a fair jury trial… not to mention that this whole thing was a major contributor of me loosing my long dream career designing recording studios and theaters for an internationally acclaimed firm…
It gets way messier too, cause, even though I was denied a trial, apparently there is currently a warrant out for my arrest, they still suspended my license, and destroyed my DMV record, not to mention my insurance quadrupled,,, apparently the DMV courts are different then the county and state courts, but none the less thay are all just broken fragments of the same government who brought us Guantanamo…
I’m moving to Europe, cause this shit makes me want to puke out of every orifice of my face… I used to stand up for the law enforcement and the government when ever i herd people talk shit about them,,, now im the one talking shit!!!

No, this is very American. America has been this way for many years now. Only in America are military troops deployed to kill college students and beat or tase people to death for no reason. The Soviet Union is tame compared to the U.S. As long as people continue believing in the two-party system, it will only get worse. In fact, it has gotten so bad that ordinary people are plotting ways to leave this country for good. The U.S., without a doubt, has the most evil government and most hypocritical citizens on the face of the earth.
