White House: Acquitted detainees may not be released

The Obama Administration signaled Tuesday it may keep terrorism detainees even if they’ve been acquitted.
Chief Department of Defense lawyer Jeh Johnson told a Senate committee “that releasing a detainee who has been tried and found not guilty was a policy decision officials would make based on their estimate of whether the prisoner posed a future threat,” according to a report by Jess Bravin in the Wall Street Journal.
Bravin notes that the Bush administration maintained the same stance, “but its legality was never tested.”
Spencer Ackerman at The Washington Independent characterized Johnson’s response as moving the Obama administration “into new territory from a civil liberties perspective.”
“Asked by Sen. Mel Martinez (R-Fla.) the politically difficult but entirely fair question about whether terrorism detainees acquitted in courts could be released in the United States, Johnson said that ‘as a matter of legal authority,’ the administration’s powers to detain someone under the law of war don’t expire for a detainee after he’s acquitted in court,” Ackerman wrote.

“If you have authority under the law of war to detain someone” under a Supreme Court ruling, Johnson remarked, “that is true irrespective of what happens on the prosecution side.”
Martinez purportedly appeared surprised. “So the prosecution is moot?” he asked.
“No, no, not in my judgment,” Johnson said.

Also at the hearing, Obama administration officials differed with the Navy’s senior uniformed lawyer over whether coerced statements could be used to obtain convictions before military commissions.

When running last year for president, Mr. Obama criticized the Bush administration’s military-commission program, which stumbled through years of internal disarray and legal setbacks in an effort to convict aliens of war crimes without affording them constitutional rights.
Johnson also signaled that Guantanamo might remain open after January 2010: “You can’t prosecute some significant subset of 220 people before January,” he said. The Obama Administration plans to continue to detain some of those inmates suspected of terrorist ties, “whether at Guantanamo or somewhere else.”

Just because they are acquitted doesn’t mean they are innocent.
If you are a CIA officer undercover and work you did 10 years ago that lead to the arrest of a shit head terrorist got him landed in Gitmo, would you want to come out of hiding to stand trial just to prove something everyone already knows?
Look how many have returned to the battlefield. Would you want your neighbor, brother, sister father mother,. whatever killed by that guy? FUCK NO.

Wow. Incredible logic. How do undercover COPS testify? Timely trials, grand juries? Dont you worry your pretty little head about arresting, torturing, and incarcerating innocent people. Stay loyal to the criminals who sign your pay-check. By the way, lets figure out how many detainees have returned to the battlefield VS how many “shit head terrorists” are inspired to join the fight against a country that tortures innocent people? Many, at least, of those held are known to have been innocents turned over by bad guys so they could collect bounties paid by our tax dollars thru our corporate government. Bounties that would help further the bad activities that the government and jarhead here want to continue, as an excuse to continue and expand war. Why? They are warmongers/profiteers.

Speaking of “justice”, there is none here. It is all selectively enforced as Alex says.
Twelve years ago this month, my brother was murdered in front of scores of eyewitnesses by the bouncers of BB King’s night club in Memphis. NO ONE WAS ARRESTED. But my brother had an armed guard around his unconscious body in the Baptist Memorial Hospital when we arrived. All eyewitnesses agreed that my brother did nothing to provoke this attack. It was eight against one and they beat and crushed and choked and mudered him because he was a big guy and they wanted to play prison–yes, the bouncers were ex-cons from New Jersey, both black and white. My brother was white, in case anyone reading is wondering. The bouncers hand-cuffed his hands behind his unconscious body and when their friends, the Memphis police, arrived, they tossed his body behind a running police car. He died from his injuries [being choked] and from asphyxiation from the running police car. Still none of the murderers were ever arrested. There was a civil trial and the bar was found liable–but never a criminal trial and never an arrest. My parents died prematurely from grief shortly afterwards. My mother, especially was very courageous and insisted on the civil trial when it became evident that the murder was to be swept under the rug in Memphis.
How does this relate to our federal justice?
I tried tirelessly to have the state of Tennessee prosecute, contacting the Attorney General of Clinton’s and Bush’s administrations. They did nothing. I knew that I lived in a land run by crooks, but I wanted to try every official channel to proscute these murderers in case some decency or common sense could be found within it, perhaps a vestige of all we fought to set up in this country to protect the citizenry from thuggery and murder….to no avail. In the end, my mother believed that the court on high, of “karma” and heaven, if , you will, would have the last, and perhaps, only say about what had happened to her child.
God bless us all for trying to bring justice to this earth. It is further away than any of us can imagine. Still , we must try. When we allow injustice to any innocent persons, we and ours may be next. While the murderers of my brother roam free, even still work as bouncers, persons found innocent are tortured and imprsoned.

If adhereing to the law is going to be completly ignored which we see it is, then I say it time for patriot groups wherever they reside to go out and capture any NWO elite gang member and hold a citizens court for their crimes agains Americans and against humanity. Murder will be at the top of the list of crimes. Once found guilty, a quick execution should be carried out with no mercy and the execution should be recorded to document the event. Once the so called elite masters know we are coming for them wherever they hide and no matter where they reside, you can bet they will scatter like roaches. While I realize that they control nukes, chemicals, biologicals, and armies of thousands you can be assured of internal converts that will help bring the guilty to justice at the end of a rope or by firing squad. We must begin to use the lack of justice to our advantage by going after the law breakers ourselves and then letting the world see why as Americans we are ticked off with all the lies, theft of trillions, eugenics plans and all the murder these NWO types have perpetuated. It is time to bring the guilty NWO elite to trial and to real justice.
